Chattanooga,TN37402OPINIONFILED:___________________ AFFIRMED PAULG.SUMMERS, Judge@ OPINION   ` X Theappellee,MaynardMorris,wasconvictedofsimpleassaultfollowingabenchtrialinHamiltonCountyGeneralSessionsCourt. ,   ׀Heappealedtothecriminalcourtand,throughappointedcounsel,filedamotiontodismisstheprosecution.Thetrialjudgegrantedthemotionfindingthatthearrestwasillegal.Thestatebringsthisappealofthetrialjudgesfinding. TherecordrevealsthatChattanoogapoliceofficersrespondedtoanassaultcomplaintataKrystalrestaurant.Thevictimtoldthemthattheappelleehadhitherintheheadwithhisfistandthatshehadfledtotherestaurant.Theofficersobservedaknotonherforeheadandseveralknotsonthebackofherhead.Theappelleewaslocatedandarrestedwithoutawarrant.Subsequently,thearrestingofficersworetotheaffidavitofcomplaintandsignedthewarrantchargingtheappelleewithsimpleassault,amisdemeanor. TennesseeCodeAnnotatedsection407103providesthat [a]nofficermay,withoutawarrant,arrestaperson...[f]orapublicoffensecommitted...inhis[orher]presence.Tenn.CodeAnn.407103(a)(1)(1990).Thestateconcedesthattheappelleesarrestviolatedthissectionbutmaintainsthatdismissaloftheprosecutionwasimproper. Morespecifically,thestatearguesthatalthoughthearrestwasillegal,theprosecutionisnotbarred.Insupportofitsposition,thestatecitesStatev.Jimmerson,No.01C019207CR00223(Tenn.Crim.App.Feb.11,1993).InJimmersonthetrialcourtdismissedtheindictmentwhenitdeterminedthatthemisdemeanorwasnotcommittedintheofficerspresence.Slipop.at3.However,thisCourtdeterminedthattheillegalarrestdidnotinvalidatetheindictment.Slipop.at4.Weagreewiththeappelleethatthiscaseisdistinguishablefromourpresentfactualscenario. Intheinstantcase,thecharginginstrumentwasnotanindictment.Instead,theappelleewasbroughtbeforethegeneralsessionscourtonawarrantissuedaftertheappelleesarrest.Theaffiantonthewarrantwastherespondingofficerandnotthevictim. Wehavenoexplanationintherecordastowhyawarrantwasnotobtainedpriortotheappelleesarrest.Althoughtheofficerwhosworeoutthewarrantindicatedthatthevictimdroveherselftothehospital,wehavenoreasontobelievethatshecouldnothaveobtainedawarrantpriortotheappelleesarrest.Withoutquestion,theproceduresfollowedviolatedTenn.CodeAnn.407103.Thearrestwasillegalandthesubsequentwarrantwasinvalid.
