Theappellantfiledasecondprosepetitionforpostconvictionreliefallegingthathiscounselhadbeenineffective.Afterahearing,thetrialcourtdeniedrelief.Theappellantappealsthisdenial.̀ Theappellantwassentencedto50yearsat45%asaRangeIII,persistentoffender.Hisreleaseeligibilitydateis22years.Theappellantcontendsthathistrialcounselhadmistakenlyrepresentedthathis50yearsentencecouldbeservedbytwoandonehalftothreeyearsincarceration.Heclaimsthatthisbadadviceledtoanunknowing,involuntaryguiltyplea.Trialcounseldeniedshegavetheappellantthisadvice.  Inorderfortheappellanttobegrantedreliefonthegroundofineffectiveassistanceofcounsel,hemustestablishthattheadvicegivenortheservicesrenderedwerenotwithinthecompetencedemandedofattorneysincriminalcasesandthat,butforhiscounselsdeficientperformance,theresultofhistrialϜwouldhavebeendifferent.Stricklandv.Washington,466U.S.668(1984).Thistwopartstandard,asitappliestoguiltypleas,ismetwhentheappellantestablishesthat,butforhiscounselserror,hewouldnothavepledguiltyandwouldhaveinsistedontrial.Hillv.Lockhart,474U.S.52,59(1985). Therecordrevealsthatatthepostconvictionhearingtheappellantadmittedthetrialcourtjudgeinformedhimthathemustserve45%ofhis50yearsentencebeforebecomingeligibleforparole.Healsoadmittedthathehadcompletedtheeleventhgradeandcouldmultiply50times45%.Itseemslogicalthattheappellantdidnotneedhistrialcounseltoperformsuchelementarymathtoadequatelyapprisehimofhisreleaseeligibilitydate.
