àOn€January€17,€1995,€the€Grainger€County€Grand€Jury€returned€anÏindictment€charging€the€appellant€with€aggravated€burglary,€arson,€and€publicÏintoxication.€€The€appellantððs€case€proceeded€to€trial€on€April€11,€1995.€€At€trial,Ïthe€State€established€that€the€appellantððs€brother,€Steve€Munsey,€had€rented€aÏhouse€from€the€victim,€Bertie€Hodge.€€At€some€point,€the€appellant€began€livingÏwith€his€brother€in€the€rental€house.€€Subsequently,€Ms.€Hodge€learned€thatÏnumerous€individuals€were€residing€at€the€house€without€her€permission,€andÏshe€ÌÌÌinitiated€eviction€proceedings.€€On€December€10,€1994,€at€approximately€11:39Ïa.m.,€Deputy€Todd€Loveday€with€the€Grainger€County€Sheriffððs€DepartmentÏexecuted€a€ð ðWrit€of€Possession€of€Personal€Property,ðð€removing€the€occupantsððÏbelongings€from€the€house€and€placing€them€in€the€front€yard.€€While€DeputyÏLoveday€was€at€the€home,€a€man€sent€by€Ms.€Hodge€changed€the€locks€on€theÏhouse.€€Before€leaving€the€home,€the€Deputy€confirmed€that€all€appliances€inÏthe€house€had€been€turned€off,€and€he€secured€the€doors€and€windows.ÌÌà àAt€approximately€3:40€p.m.€in€the€afternoon,€Sandy€and€Darren€Bean,Ïacquaintances€of€the€appellant,€drove€past€the€rental€house.€€They€observed€theÍappellantððs€car€parked€in€front€of€the€house.× ƒ" ×€€Ten€or€fifteen€minutes€later,€theÏBeans€again€drove€past€the€house€and€noticed€smoke€rising€from€the€house.€ÏThe€appellantððs€car€was€gone.€€The€Beans€notified€Ms.€Hodge€about€the€fire.€ÏMs.€Hodge€called€the€Sheriffððs€Department,€and€the€Beans€returned€to€theÏburning€house€and€attempted€to€extinguish€the€fire.€€At€this€time,€they€noticedÏthat€a€window€had€previously€been€broken.ÌÌà àApproximately€twenty€or€thirty€minutes€later,€after€the€fire€had€beenÏextinguished,€the€Beans€drove€to€Jessieððs€Market€and€Deli,€located€less€thanÏfive€minutes€from€the€rental€house.€€The€appellantððs€car€was€parked€outside€theÏMarket,€and€the€appellant€and€his€girlfriend€were€inside.€€Subsequently,€DeputyÏLoveday,€who€had€been€contacted€concerning€the€fire€and€had€spoken€to€theÏBeans,€arrived€at€the€market.€€He€encountered€the€appellant€and€his€girlfriendÏas€they€were€leaving€the€store.€€The€Deputy€informed€the€appellant€that€he€wasÏinvestigating€the€fire€at€Ms.€Hodgeððs€rental€house€and€advised€the€appellant€ofÏhis€constitutional€rights.ÌÌà àAt€trial,€the€Deputy€described€the€appellantððs€condition:ÌÓÓà8 àI€observed€that€[the€appellant]€had€the€odor€of€an€alcoholic€typeÍbeverage€about€him.€€That€he€had€sort€of€stuttered€type€speech.€ÏHis€eyes€were€a€little€watery,€a€little€bit€off€balance.€€He€gave€meÏthe€impression€of€him€being€slightly€intoxicated€or€under€theÏinfluence€of€something.× ƒ# ××  ×ÌÌÓÓThe€Deputy€additionally€noticed€that€the€appellant€had€suffered€various€cuts€onÏhis€hands,€which€were€bleeding€a€very€small€amount.€€Upon€closer€examination,ÏDeputy€Loveday€observed€small€fragments€of€broken€glass€between€theÏappellantððs€fingers.× ƒ$ ××  ×€€According€to€Deputy€Loveday,€the€appellant€claimed€thatÏhe€had€cut€his€hands€while€he€was€changing€the€battery€in€his€car.€€However,Ïwhen€the€Deputy€examined€the€battery,€he€noticed€a€layer€of€dust€or€oil€on€theÏbattery€and€the€absence€of€tool€marks€on€the€battery.€€The€appellant€thenÏclaimed€that€he€had€cut€his€hands€on€the€engineððs€fan.€€The€fan€also€appearedÏto€be€untouched.€€The€appellant€next€stated€that€he€had€installed€a€fan€belt,€butÏthe€belts€appeared€to€be€worn.€€Finally,€the€appellant€informed€Deputy€LovedayÏthat€he€had€cut€his€hand€striking€his€girlfriend.€€The€appellant€denied€setting€fireÏto€Ms.€Hodgeððs€rental€house,€but€admitted€to€Deputy€Loveday€that€he€hadÏpassed€by€the€house€at€approximately€10:00€a.m.,€and€had€seen€the€furnitureÍoutside€the€house.€€Loveday€arrested€the€appellant,€charging€him€withÏaggravated€burglary,€arson,€and€public€intoxication.ÌÌà àArson€Investigator€Roy€Chinault€with€the€State€Fire€Marshallððs€OfficeÏexamined€Ms.€Hodgeððs€rental€house€on€December€14.€€He€concluded€that€theÏfire€had€been€intentionally€ignited€from€four€different€locations€inside€the€house:Ïtwo€bedroom€closets,€the€living€room,€and€the€kitchen.€€In€all€four€locations,€theÏperpetrator€had€used€a€vinyl€material€as€an€accelerant.€€Deputy€LovedayÏtestified€that,€when€he€executed€the€eviction€order€on€the€morning€before€theÏfire,€the€material€was€stored€in€two€bedroom€closets.ÌÌà àThe€appellant€testified€at€trial.€€He€stated€that,€at€the€time€of€the€offense,Ïhis€brother,€Harvey€Munsey,€was€living€in€a€dairy€barn€on€Lawrence€MorganððsÏfarm.€€The€appellant€and€his€girlfriend,€Connie€Strange,€spent€the€night€prior€toÏthe€offense€at€his€brotherððs€barn.€€On€the€day€of€the€offense,€the€appellantÏhelped€his€brothers,€Harvey€and€Bill,€and€his€sister„in„law,€Rachel,€work€on€theÏtobacco€crop,€and€he€worked€on€his€car€at€his€brotherððs€barn.€€At€approximatelyÏ3:30€p.m.€or€3:35€p.m.,€Harvey€Munsey€gave€the€appellant€twenty€dollars€andÏsent€him€and€Connie€Strange€to€the€store€in€order€to€purchase€beer€andÏcigarettes.× ƒ% ××  ×€€The€appellant€and€his€girlfriend€first€stopped€at€the€Valley€MarketÍand€purchased€beer.€€The€appellant€stated€that€the€drive€from€his€brotherððs€barnÏto€the€Valley€Market€is€approximately€fifteen€or€twenty€minutes.€€He€concededÏthat€he€passed€by€Ms.€Hodgeððs€rental€house€òòenóó€òòrouteóó€to€the€Valley€Market€butÏclaimed€that€he€did€not€stop€at€the€house.€€After€purchasing€beer€at€the€ValleyÏMarket,€the€appellant€and€Ms.€Strange€proceeded€to€Jessieððs€Market€in€order€toÏbuy€cigarettes,€as€cigarettes€were€less€expensive€at€Jessieððs€Market.ÌÌà àOn€cross„examination,€the€appellant€testified€that€Deputy€LovedayÏgrabbed€him€as€he€was€leaving€Jessieððs€Market€and€threw€him€against€aÏfreezer,€informing€him€that€he€was€under€arrest€for€arson.€€The€Deputy€thenÏasked€if€he€could€examine€the€appellantððs€car.€€The€appellant€raised€the€hood€ofÏhis€car,€permitting€the€Deputyððs€inspection.× ƒ& ××  ×€€The€appellant€was€subsequentlyÏplaced€in€the€Deputyððs€vehicle.€€The€appellant€denied€that€he€was€subjected€to€aÏbreathalyser.€€ÌÌà àThe€appellant€additionally€introduced€the€testimony€of€Christine€Hodge,Ïwho,€on€December€10,€1994,€was€working€at€the€Valley€Market.€€She€stated€thatÏthe€appellant€and€his€girlfriend€entered€the€store€at€approximately€3:50€p.m.€ÏShe€did€not€notice€anything€unusual€about€the€appellantððs€hands,€but€concededÏat€trial€that€she€had€no€reason€to€pay€attention€to€the€appellantððs€hands.€€TheÍappellant€and€his€girlfriend€left€the€store€at€approximately€4:05€p.m.€€They€didÏnot€appear€to€be€intoxicated€at€that€time.€€Finally,€Ms.€Hodge€testified€that€it€is€aÏfifteen€minute€drive€to€Jessieððs€Market€from€the€Valley€Market.ÌÌà àConnie€Strange€confirmed€that€she€was€with€the€appellant€all€day€onÏDecember€10,€1994.€€On€that€day,€the€appellant€worked€on€his€car€at€hisÏbrotherððs€dairy€barn€and€helped€his€brothers€and€sister„in„law€with€the€tobaccoÏcrop.€€At€approximately€3:30€p.m.€or€3:35€p.m.,€she€and€the€appellant€left€theÏfarm€to€purchase€beer€and€cigarettes.€€Ms.€Strange€denied€ever€stopping€at€Ms.ÏHodgeððs€rental€house.€€On€cross„examination,€Ms.€Strange€denied€that€theÏappellant€was€intoxicated€on€December€10.€€She€asserted€that€the€appellantÏhad€drunk€four€beers€during€the€day.ÌÌà àFinally,€the€appellantððs€brothers,€Harvey€and€Bill,€and€his€sister„in„law,ÏRachel,€testified€on€behalf€of€the€appellant.€€They€confirmed€that€the€appellantÏhad€been€at€the€Morgan€farm€on€the€day€of€the€offense,€had€worked€on€his€car,Ïand€had€helped€his€family€with€the€tobacco€crop.€€According€to€the€appellantððsÏbrothers,€he€left€the€farm€with€his€girlfriend€anytime€between€3:00€p.m.€and€3:30Ïp.m.€€They€testified€that€they€had€all€drunk€a€few€beers€during€the€day.€€ÌÌà àThe€jury€found€the€appellant€guilty€of€aggravated€burglary,€arson,€andÏpublic€intoxication.€€On€May€15,€1995,€the€trial€court€conducted€a€sentencingÍhearing.€€Both€the€State€and€the€appellant€relied€upon€the€evidence€adduced€atÏtrial€and€the€pre„sentence€report.€€In€imposing€the€appellantððs€sentence,€the€trialÏcourt€found€the€following€enhancement€factors:ÌÓÓà8 à(1)à8 àthe€appellant€has€a€previous€history€of€criminalÏconvictions€or€criminal€behavior;Ìà8 à(4)à8 àa€victim€of€the€offense€was€particularly€vulnerableÏbecause€of€age€or€physical€or€mental€disability;Ìà8 à(6)à8 àthe€amount€of€damage€to€property€sustained€by€theÏvictim€was€particularly€great;€andÌà8 à(15)à8 àthe€appellant€abused€a€position€of€private€trust.ÌÌÓÓTenn.€Code€Ann.€ðð€40„35„114€(1994€Supp.).€€Additionally,€the€trial€court€foundÏthe€mitigating€factor€that€the€appellantððs€criminal€conduct€neither€caused€norÏthreatened€serious€bodily€injury.€€Tenn.€Code€Ann.€ðð€40„35„113(1)€(1990).ÌÌà@ àò òòòII.€€Analysisó óóóÌò òa.à8 àExculpatory€Evidenceó óÌà àThe€appellant€first€contends€that,€pursuant€to€his€discovery€requests,× ƒ' ××  ×€theÏState€should€have€furnished€the€appellant€with€photographs€of€the€appellantððsÏhands,€taken€soon€after€his€arrest.€€In€support€of€his€argument,€the€appellantÏcites€Tenn.€R.€Crim.€P.€16(a)(1)(C)€and€òòBradyóó,€373€U.S.€at€87,€83€S.Ct.€at€1196„1197€(the€United€States€Supreme€Court€held€that€ð ðthe€suppression€by€theÏprosecution€of€evidence€favorable€to€an€accused€upon€request€violates€dueÏprocess€where€the€evidence€is€material€either€to€guilt€or€to€punishment,Íirrespective€of€the€good€faith€or€bad€faith€of€the€prosecutionðð).€€€The€appellantÏasserts€that€the€photographs€were€material€to€the€appellantððs€defense,€as€theÏalleged€cuts€and€glass€fragments€on€the€appellantððs€hands€at€the€time€of€hisÏarrest€constituted€circumstantial€evidence€that,€on€December€10,€1994,€theÏappellant€entered€Ms.€Hodgeððs€rental€house€by€breaking€a€window.€€The€StateÏargues€that€the€photographs€are€such€poor€quality€that€they€disclose€nothingÏabout€the€condition€of€the€appellantððs€hands.ÌÌà àAt€the€hearing€on€the€appellantððs€Motion€for€New€Trial,€Deputy€LovedayÏtestified€that€he€had€taken€Polaroid€photographs€of€the€appellantððs€hands€soonÏafter€his€arrest.€€He€further€stated€that€the€photographs€are€ð ðbadlyðð€out€of€focus.€ÏTherefore,€he€never€showed€the€photographs€to€either€the€prosecutor€orÏdefense€counsel.€€In€order€to€illustrate€the€poor€quality€of€the€photographs,ÏLoveday€testified€that€letters,€spelling€the€words€ð ðLove€to€Fuckðð€and€tattooedÏprominently€on€the€appellantððs€fingers,€could€not€be€discerned€on€theÏphotographs.€€The€trial€court€made€the€following€observations:ÌÓÓà8 à[L]et€the€record€reflect€that€the€letters€are€quite€visible,€quite€clear,Ïby€the€naked€eye€in€looking€at€[the€appellantððs]€hands.€€...€[B]ut€theÏphotographs,€well,€they€speak€for€themselves.€€You€cannot€seeÏany€of€the€tattooing€of€the€lettering€that€I€just€saw€with€my€ownÏeyes.€...€[W]ell,€there€is€nothing€that€I€see.€...€[T]he€photographsÏhave€absolutely€no€probative€value€at€all.× ƒ( ××  ×ÌÌÓÓÌà àIn€òòState€v.€Edginóó,€902€S.W.2d€387,€389€(Tenn.€1995),€our€supreme€courtÏset€forth€the€four€prerequisites€to€a€successful€òòBradyóóòò€óóchallenge:ÌÓÓà8 à1.à8 àThe€defendant€must€have€requested€the€informationÏ(unless€the€evidence€is€obviously€exculpatory,€inÏwhich€case€the€State€is€bound€to€release€theÏinformation€whether€requested€or€not);Ìà8 à2.à8 àThe€State€must€have€suppressed€the€information;Ìà8 à3.à8 àThe€information€must€have€been€favorable€to€the€ÌÌÌà àà àaccused;€andÌà8 à4.à8 àThe€information€must€have€been€material.ÌÌÓÓThe€standard€of€materiality€is€whether€ð ðððthere€is€a€reasonable€probability€that,Ïhad€the€evidence€been€disclosed€to€the€defense,€the€result€of€the€proceedingÏwould€have€been€different.ðððð€òòIdóó.€at€390€(Opinion€on€Petition€for€Rehearing)(citingÏòòKyles€v.€Whitleyóó,€òò€€€óó€U.S.€òò€€€óó,€115€S.Ct.€1555,€1566€(1995)).€€Additionally,€Tenn.€R.ÏCrim.€P.€16(a)(1)(C)€provides:ÌÓÓà8 àUpon€request€of€the€defendant,€the€state€shall€permit€theÏdefendant€to€inspect€and€copy€or€photograph€...€photographs€...Ïwhich€are€within€the€possession,€custody€or€control€of€the€state,€theÏexistence€of€which€is€known,€or€by€the€exercise€of€due€diligenceÏmay€become€known,€to€the€district€attorney€general€and€which€areÏmaterial€to€the€preparation€of€the€defense€...€.× ƒ, ××  ×ÌÌÓÓAssuming€that€all€other€prerequisites€have€been€satisfied,€we€simply€concludeÏthat€the€photographs€of€the€appellantððs€hands€do€not€satisfy€the€standard€ofÏmateriality€under€either€òòBradyóó€or€Rule€16.€€This€issue€is€without€merit.ÌÌò òb.à8 àTenn.€R.€Crim.€P.€33(f)ó óÌà àThe€appellant€additionally€contends€that€the€evidence€weighed€againstÏthe€juryððs€verdicts,€warranting€a€new€trial€pursuant€to€Tenn.€R.€Crim.€P.€33(f).€ÏRule€33(f)€imposes€upon€the€trial€court€judge€the€mandatory€duty€to€serve€as€theÏthirteenth€juror€in€every€criminal€case.€€òòState€v.€Carteróó,€896€S.W.2d€119,€122Ï(Tenn.€1995).€€However,€ÌÓÓà8 àRule€33(f)€does€not€require€the€trial€judge€to€make€an€explicitÏstatement€on€the€record.€€Instead,€when€the€trial€judge€simplyÏoverrules€a€motion€for€new€trial,€an€appellate€court€may€presumeÏthat€the€trial€judge€has€served€as€the€thirteenth€juror€and€approvedÏthe€juryððs€verdict.ÌÌÓÓòòIdóó.€€Only€if€the€record€contains€statements€by€the€trial€judge€indicatingÏdisagreement€with€the€juryððs€verdict€or€indicating€that€the€trial€judge€refused€toÏact€as€the€thirteenth€juror€may€an€appellate€court€reverse€the€trial€courtððsÏjudgment.€€òòIdóó.€€Otherwise,€appellate€review€is€limited€to€sufficiency€of€theÏevidence€pursuant€to€Tenn.€R.€App.€P.€13(e).€€òòSee€alsoóó€òòState€v.€Burlisonóó,€868ÍS.W.2d€713,€718„719€(Tenn.€Crim.€App.€1993).€€The€record€in€the€instant€caseÏdoes€not€reflect€any€failure€by€the€trial€judge€to€comply€with€Rule€33(f).€€Indeed,Ïat€the€conclusion€of€the€appellantððs€trial,€in€denying€the€appellantððs€motion€toÏremain€on€bond€pending€a€sentencing€determination,€the€trial€judge€informedÏthe€appellant€that€he€agreed€with€the€juryððs€assessment€of€the€appellantððsÏcredibility€implicit€in€the€juryððs€verdicts.€€This€issue€is€without€merit.ÌÌò òc.à8 àSufficiency€of€the€Evidenceó óÌà àThe€appellant€next€challenges€the€sufficiency€of€the€evidence€supportingÏhis€convictions.€€A€jury€conviction€removes€the€presumption€of€innocence€withÏwhich€a€defendant€is€initially€cloaked€and€replaces€it€with€one€of€guilt,€so€that€onÏappeal€a€convicted€defendant€has€the€burden€of€demonstrating€that€theÏevidence€is€insufficient.€€òòState€v.€Tuggleóó,€639€S.W.2d€913,€914€(Tenn.€1982).€ÏThe€defendant€must€establish€that€the€evidence€presented€at€trial€was€soÏdeficient€that€no€"reasonable€trier€of€fact"€could€have€found€the€essentialÏelements€of€the€offense€beyond€a€reasonable€doubt.€€òòJackson€v.€Virginiaóó,€443ÏU.S.€307,€319,€99€S.Ct.€2781,€2789€(1979);€òòState€v.€Cazesóó,€875€S.W.2d€253,Ï259€(Tenn.€1994);€Tenn.€R.€App.€P.€13(e).€€This€rule€is€applicable€to€findings€ofÏguilt€based€upon€direct€evidence,€circumstantial€evidence,€or€a€combination€ofÏthe€two.€€òòState€v.€Matthewsóó,€805€S.W.2d€776,€779€(Tenn.€Crim.€App.€1990).€€ÌÌÌà àThis€court€has€frequently€remarked€that€a€criminal€offense€may€beÏestablished€by€circumstantial€evidence€alone€if€the€facts€and€circumstances€ofÏthe€case€are€ð ðððso€strong€and€cogent€as€to€exclude€every€other€reasonableÏhypothesis€save€the€guilt€of€the€defendant.ðððð€òòIdóó.€at€779„780€(citing€òòState€v.ÏCrawfordóó,€470€S.W.2d€610,€612€(Tenn.€1971).€€Nevertheless,€on€appeal,€theÏState€is€entitled€to€the€strongest€legitimate€view€of€the€evidence€and€allÏreasonable€inferences€which€may€be€drawn€therefrom.€€òòState€v.€Williamsóó,€657ÏS.W.2d€405,€410€(Tenn.€1983).€€òòSee€alsoóó€òòState€v.€Harrisóó,€839€S.W.2d€54,€75Ï(Tenn.€1992).€€An€appellate€court€may€neither€reweigh€nor€reevaluate€theÏevidence€when€determining€its€sufficiency.€€òòState€v.€Cabbageóó,€571€S.W.2d€832,Ï835€(Tenn.€1978).€€Accordingly,€this€court€may€not€substitute€its€inferences€forÏthose€drawn€by€the€trier€of€fact€from€circumstantial€evidence.€€òòState€v.€Boydóó,€925ÏS.W.2d€237,€242€(Tenn.€Crim.€App.€1995),€òòperm.€to€appeal€deniedóó,€(Tenn.Ï1996)(citing€òòLiakas€v.€Stateóó,€286€S.W.2d€856,€859€(Tenn.€1956)).€€QuestionsÏconcerning€the€credibility€of€witnesses€and€the€weight€and€value€to€be€given€theÏevidence,€as€well€as€all€factual€issues€raised€by€the€evidence,€are€resolved€byÏthe€trier€of€fact,€and€not€the€appellate€courts.€€òòState€v.€Pruettóó,€788€S.W.2d€559,Ï561€(Tenn.€1990).€€"A€jury€verdict€approved€by€the€trial€judge€accredits€theÏtestimony€of€the€witnesses€for€the€State€and€resolves€all€conflicts€in€favor€of€theÏState's€theory."€€òòWilliamsóó,€657€S.W.2d€at€410.ÌÌà àWe€conclude€that€the€evidence€amply€supports€the€appellantððsÍconvictions€for€aggravated€burglary€and€arson.€€òòSeeóó€Tenn.€Code€Ann.€ðð€39„14„403€(a)€(1991);€Tenn.€Code€Ann.€ðð€39„14„301€(a)(1)€(1991).€€However,€weÏagree€with€the€appellant€that€there€is€virtually€no€evidence€in€the€record€that,€atÏthe€time€of€his€arrest,€he€was€under€the€influence€of€an€intoxicant€in€a€publicÏplace€òòto€the€degree€that€he€may€have€been€endangeredóó.€€Tenn.€Code€Ann.€ððÏ39„17„310€(a)(1)€(1991).€€Tenn.€Code€Ann.€ðð€39„17„301€provides:ÌÓÓà8 à(a)€€A€person€commits€the€offense€of€public€intoxication€whoÏappears€in€a€public€place€under€the€influence€of€a€controlledÏsubstance€or€any€other€intoxicating€substance€to€the€degree€that:ÌÓÓÓÓà8 àà8 à(1)à8 àThe€offender€may€be€endangered;Ìà8 àà8 à(2)à8 àThere€is€endangerment€to€otherÏpersons€or€property;€orÌà8 àà8 à(3)à8 àThe€offender€unreasonably€annoysÏpeople€in€the€vicinity.ÌÌÓÓÓ ` ÜŽX¹(0*ŒX ÓThe€indictment€specifically€charged€the€appellant€pursuant€to€subsection€(a)(1)Ïof€the€statute.€€ÌÌà àThe€objective€of€the€public€intoxication€statute€is€not€to€penalize€theÏòòconditionóó€of€being€intoxicated€in€a€public€place,€but€to€ð ðproscribe€and€preventððÏòòconductóó€flowing€from€the€condition.€€òòSeeóó€Tenn.€Code€Ann.€ðð€39„11„101(1)Ï(1991)(a€general€objective€of€the€criminal€code€is€to€ð ðproscribe€and€preventÏòòconductóó€that€unjustifiably€and€inexcusably€causes€or€threatens€harm€toÏindividual,€property,€or€public€interest€for€which€protection€through€the€criminalÏlaw€is€appropriateðð)(emphasis€added).€€The€proof€at€trial€established€that,€shortlyÏafter€the€appellantððs€arrest€at€Jessieððs€Market,€the€appellantððs€blood€alcoholÍcontent€was€.26€percent.€€However,€Christine€Hodge,€an€employee€of€the€ValleyÏMarket,€testified€that,€shortly€before€his€arrest,€the€appellant€did€not€appear€to€beÏintoxicated.€€The€arresting€officer€testified€that€the€appellant€appeared€to€beÏð ðslightly€intoxicated.ðð€€The€appellant€did€not€create€any€disturbance€or€engage€inÏany€altercations€at€the€Valley€Market€or€Jessieððs€Market.€€òòContrastóó€òòState€v.ÏWhiteóó,€No.€02C01„9501„CC„00025€(Tenn.€Crim.€App.€at€Jackson,€SeptemberÏ20,€1995),€òòperm.€to€appeal€deniedóó,€(Tenn.€1996)(the€evidence€established€thatÏthe€appellant€was€potentially€a€danger€to€himself€or€others,€as€the€arrestingÏofficer€testified€that€the€appellant€had€exited€the€passenger€side€of€a€vehicle€andÏengaged€in€a€heated€debate€with€another€individual).€€Moreover,€it€wasÏundisputed€at€trial€that€the€appellantððs€girlfriend,€Connie€Strange,€was€drivingÏthe€appellantððs€car€on€the€day€of€the€offense.€€There€is€no€evidence€that€Ms.ÏStrange€was€intoxicated€or€otherwise€unable€to€drive€on€that€day.€€òòContrastóóÏòòWhiteóó,€No.€02C01„9501„CC„00025€(when€the€driver€of€a€vehicle€was€arrestedÏfor€DUI,€the€intoxicated€passenger€was€properly€charged€with€publicÏintoxication,€because,€had€he€been€allowed€to€leave,€he€would€have€been€aÏdanger€to€himself).€€Accordingly,€we€reverse€the€appellantððs€conviction€for€publicÏintoxication.ÌÌò òd.à8 àSentencingó óÌà àFinally,€the€appellant€asserts€that€concurrent€sentences€of€six€yearsÏincarceration€in€the€Tennessee€Department€of€Correction€for€aggravatedÍburglary€and€arson€are€excessive.× ƒ. ××  ×€€Specifically,€while€conceding€thatÏconsideration€of€the€appellantððs€criminal€history€was€appropriate,× ƒ/ ××  ×€theÏappellant€challenges€the€trial€courtððs€consideration€of€enhancement€factor€(4),Ïconcerning€the€vulnerability€of€the€victim,€factor€(6),€concerning€the€amount€ofÏproperty€damage,€and€factor€(15),€concerning€the€appellantððs€abuse€of€aÏposition€of€private€trust.€€Tenn.€Code€Ann.€ðð€40„35„114.€€The€appellant€asks€thatÏhis€sentences€be€reduced€to€three€years.€€The€State€concedes€that€the€recordÏdoes€not€support€the€abuse€of€a€position€of€trust,€but€argues€that€the€remainingÏfactors€are€applicable.€€Moreover,€the€State€contends€that€enhancement€factorÏ(10),€the€appellantððs€lack€of€hesitation€in€committing€a€crime€when€the€risk€toÏhuman€life€was€high,€is€applicable,€and,€therefore,€the€trial€court€erroneouslyÏfound€that€the€appellantððs€criminal€conduct€did€not€threaten€serious€bodily€injury.€ÏTenn.€Code€Ann.€ðð€40„35„113,€„114.ÌÌà àReview,€by€this€court,€of€the€length€a€sentence€is€òòde€novoóó€with€aÍpresumption€that€the€determination€made€by€the€trial€court€is€correct.€€Tenn.ÏCode€Ann.€ðð€40„35„401(d)€(1990).€€This€presumption€only€applies,€however,€ifÏthe€record€demonstrates€that€the€trial€court€properly€considered€sentencingÏprinciples€and€all€relevant€facts€and€circumstances.€€òòState€v.€Ashbyóó,€823€S.W.2dÏ166,€169€(Tenn.€1991).€€If€the€trial€court€applies€inappropriate€factors€orÏotherwise€fails€to€comply€with€the€1989€Sentencing€Act,€the€presumption€ofÏcorrectness€falls.€€òòState€v.€Sheltonóó,€854€S.W.2d€116,€123€(Tenn.€Crim.€App.Ï1992).€€Again,€the€State€concedes€that€the€trial€court€improperly€consideredÏenhancement€factor€(15)€in€sentencing€the€appellant.€€Accordingly,€theÏpresumption€of€correctness€does€not€accompany€the€trial€courtððs€determination.ÌÌà àNevertheless,€the€appellant€bears€the€burden€of€establishing€that€theÏsentences€imposed€by€the€trial€court€are€erroneous.€€òòState€v.€Leeóó,€No.€03C01„9308„CR„00275€(Tenn.€Crim.€App.€at€Knoxville,€April€4,€1995).€€In€determiningÏwhether€the€appellant€has€met€this€burden,€this€court€must€consider€the€factorsÏlisted€in€Tenn.€Code€Ann.€ðð€40„35„210(b)(1990)€and€the€sentencing€principlesÏdescribed€in€Tenn.€Code€Ann.€ðð€40„35„102€(1995€Supp.)€and€ðð€40„35„103Ï(1990).ÌÌà àMoreover,€Tenn.€Code€Ann.€ðð€40„35„210€provides€that€the€minimumÏsentence€within€the€appropriate€range€is€the€presumptive€sentence.€€If€there€areÏenhancing€and€mitigating€factors,€the€court€must€start€at€the€minimum€sentenceÍin€the€range€and€enhance€the€sentence€as€appropriate€for€the€enhancementÏfactors€and€then€reduce€the€sentence€within€the€range€as€appropriate€for€theÏmitigating€factors.€€òòIdóó.€€If€there€are€no€mitigating€factors,€the€court€may€set€theÏsentence€above€the€minimum€in€that€range,€but€still€within€the€range.€€òòIdóó.€€òòSeeÏalsoóó€òòState€v.€Diesóó,€829€S.W.2d€706,€710€(Tenn.€Crim.€App.€1991).€€"[T]here€is€noÏparticular€value€assigned€by€the€1989€Sentencing€Act€to€the€various€factors€andÏthe€'weight€afforded€mitigating€or€enhancement€factors€derives€from€balancingÏrelative€degrees€of€culpability€within€the€totality€of€the€circumstances€of€the€caseÏinvolved.'"€€òòState€v.€Marshallóó,€870€S.W.2d€532,€541€(Tenn.€Crim.€App.Ï1993)(citation€omitted).ÌÌà àWe€conclude€that€the€record€supports€the€imposition€of€the€maximumÏsentences€authorized€by€law.€€Tenn.€Code€Ann.€ðð€40„35„112€(a)(3)€(1990).€ÏFirst,€we€agree€that€the€victim€in€the€instant€case€was€particularly€vulnerable.€€AÏvictim€is€particularly€vulnerable€when€she€lacks€the€ability€to€resist€theÏcommission€of€the€offense€due€to€age,€a€physical€condition,€or€a€mentalÏcondition.€€òòState€v.€Boggsóó,€932€S.W.2d€467,€473€(Tenn.€Crim.€App.€at€Knoxville),Ïòòperm.€to€appeal€deniedóó,€(Tenn.€1996).€€The€State€bears€the€burden€of€provingÏthe€victimððs€limitations.€€òòState€v.€Adamsóó,€864€S.W.2d€31,€35€(Tenn.€1993).€€In€theÏinstant€case,€the€record€reflects€that€the€victim€is€eighty„six€years€old€andÏconfined€to€a€wheelchair.€€Ms.€Hodge€testified€at€trial€that,€although€her€rentalÏhouse€is€within€sight€of€her€home,€she€is€unable€to€visit€her€rental€house€due€toÍher€physical€condition.€€Certainly,€she€would€have€been€unable€to€extinguishÏthe€fire€without€assistance.€€Accordingly,€she€was€particularly€vulnerable€to€theÏappellantððs€burglary€and€attempted€destruction€of€her€property.€€Similarly,€weÏagree€that€the€damage€sustained€by€Ms.€Hodge€was€particularly€great.€€At€trial,Ïthe€victim€testified€that€her€insurance€proceeds€amounted€to€two€thousandÏdollars,€but€were€insufficient€to€completely€repair€the€damage€caused€by€theÏappellantððs€conduct.€€Moreover,€Ms.€Hodge€has€lost€the€income,€apparently€oneÏhundred€and€fifty€dollars€per€month,€which€she€formerly€derived€from€leasing€theÏhouse.€€These€factors€alone€support€the€sentences€imposed€by€the€trial€court.ÌÌÌà
