àFor€a€better€understanding€of€the€issues,€it€is€necessary€to€briefly€reviewÏthe€facts€of€the€underlying€offenses€as€presented€in€the€record€before€us.€ÏAccording€to€the€presentence€report,€which€includes€a€lengthy€and€graphicÏconfession€by€the€Defendant,€the€Defendant€and€his€co„defendant,€DerrickÏGilbert,€accosted€a€young€couple€who€were€sitting€in€a€parked€vehicle€in€KnoxvilleÏon€June€7,€1988.€€Armed€with€a€pistol€and€knife,€the€two€men€robbed€the€coupleÏof€a€stereo€equalizer€and€purse.€€ÌÌà ` àLater€that€same€evening,€the€Defendant€and€his€co„defendant€approachedÏanother€young€couple€sitting€in€a€parked€vehicle.€€Again€using€the€pistol€and€knife,Ïthey€robbed€the€couple€of€jewelry,€a€stereo,€and€other€items,€and€then€forced€theÏcouple€to€fully€disrobe,€throwing€articles€of€their€clothing€into€the€nearby€woods.€ÏThey€forced€the€male€victim€to€lie€nude€in€the€floorboard€of€the€car,€threateningÏto€kill€the€female€victim€if€he€moved.€€The€two€men€then€transported€the€nudeÏfemale€victim€in€their€vehicle€to€a€more€isolated€location€in€the€woods,€where€theyÏeach€raped€her€repeatedly,€both€orally€and€vaginally,€while,€according€to€theÏDefendant,€she€ð ðjust€[lay]€there€.€.€.€like€she€was€dead.ðð€€At€one€point,€they€placedÏa€pistol€in€her€mouth€and€threatened€to€kill€her€if€she€vomited€on€them.€€After€theÏassault,€the€Defendant€and€his€co„defendant€left€the€female€victim,€who€was€nudeñLññLññNñÌñNññOññLñÐ  4 *, ÐñLññOññMñ€ñMñand€bleeding,€alone€in€the€woods€and€drove€away.€€As€they€departed,€they€wereÏmet€by€arriving€police€officers,€who€placed€them€under€arrest.Ð ð5,. Ð(1985);€òòBankston€v.€Stateóó,€815€S.W.2d€213,€215€(Tenn.€Crim.€App.€1991).€€TheÐ à7€.0 Ðprejudice€requirement€is€modified€so€that€the€petitioner€ð ðmust€show€that€there€isÐ Ð9p02 Ða€reasonable€probability€that,€but€for€counselððs€errors,€he€would€not€have€pleadedÏguilty€and€would€have€insisted€on€going€to€trial.ðð€€òòHillóó,€474€U.S.€at€59.Ð °  ÐÌà ` àThe€Defendant€first€argues€that€he€received€ineffective€assistance€ofÏcounsel€because€he€was€improperly€advised€to€plead€guilty€to€two€counts€ofÏaggravated€kidnapping.€€He€argues€that€the€proof€does€not€support€hisÏkidnapping€convictions€and€that€his€attorney€failed€to€properly€advise€him€aboutÏthe€law€of€kidnapping.€€He€contends€that€his€kidnapping€convictions€wereÏessentially€incidental€to€his€rape€and€robbery€convictions€and€therefore€that€hisÏconvictions€for€kidnapping€violate€his€due€process€rights.ÌÌà ` àIn€support€of€this€argument,€the€Defendant€relies€on€the€TennesseeÏSupreme€Court€case€of€òòState€v.€Anthonyóó,€817€S.W.2d€299€(Tenn.€1991),€whichÐ `(  Ðsets€forth€the€standard€for€determining€whether€movement€or€confinementÏincidental€to€a€crime€such€as€robbery€or€rape€is€sufficient€to€sustain€a€separateÏkidnapping€conviction.€€In€òòAnthonyóó,€the€supreme€court€concluded€that€the€properÐ 0.Ð$& Ðinquiry€isÌÓö!Óà8 ` àwhether€the€confinement,€movement,€or€detention€is€essentiallyÏincidental€to€the€accompanying€felony€and€is€not,€therefore,Ïsufficient€to€support€a€separate€conviction€for€kidnapping,€or€whetherÏit€is€significant€enough,€in€and€of€itself,€to€warrant€independentÏprosecution€and€is,€therefore,€sufficient€to€support€a€conviction.€.€.€.Ï[O]ne€method€of€resolving€this€question€is€to€ask€whether€theÏdefendantððs€conduct€ð ðsubstantially€increased€[the]€risk€of€harm€overÏand€above€that€necessarily€present€in€the€crime€of€robbery€itself.ððÐ ` ü!` ü! ð[m]ust€.€.€.€make[]€the€other€crimeÏsubstantially€easier€of€commission€or€substantially€lessen[]€the€risk€of€detection.ðð€ÏòòId.Ð Ø8x/1 Їà ` àóóWe€first€note€that€the€Defendant€entered€his€guilty€plea€in€1989,€two€yearsÐ `  Ðbefore€the€release€of€òòAnthonyóó€in€1991.€€The€Defendant,€however,€argues€that€theÐ P ð Ðruling€in€òòAnthonyóó€was€based€at€least€in€part€on€previous€cases€which€wereÐ @ à Ðavailable€to€his€counsel€at€the€time.€€òòSeeóó€òòid.óó€at€304„06.€€The€Defendant€wouldÐ 0Ð Ðhave€us€conclude€that€had€his€counsel€informed€him€of€a€potential€òòAnthonyóó„typeÐ  À Ðdefense,€either€the€State€would€have€dropped€all€kidnapping€charges€against€him,Ïor€he€would€have€proceeded€to€trial€and€prevailed€on€the€òòAnthonyóó€issue.€€We€findÐ    Ðneither€of€these€outcomes€likely.€€ÌÌà ` àThe€Defendant€confessed€to€horrific€crimes.€€The€facts€which€we€haveÏgleaned€from€the€record,€the€majority€of€which€come€from€the€Defendantððs€ownÏstatements€to€police,€though€not€tantamount€to€all€evidence€which€would€likely€beÏproduced€at€a€complete€trial,€indicate€extremely€strong€proof€against€theÏDefendant.€€Furthermore,€as€our€supreme€court€noted€in€òòAnthonyóó,€ð ðdespite€theÐ "0 Ðrules,€there€is€inevitably€some€unevenness€in€the€application€of€the€law€to€theÏfacts,€even€within€jurisdictions,€principally€because€the€determination€of€whetherÏa€detention€or€movement€is€incidental€to€another€offense€is€highly€dependent€onÏthe€facts€in€each€case.ðð€€òòId.óó€at€306.€€Thus,€it€is€totally€uncertain€whether,€if€theÐ Ðsentencing€hearing.€€This€victim,€who€did€not€testify€at€the€sentencing€hearing,Ïwas€the€victim€of€one€of€the€aggravated€robberies,€an€aggravated€kidnapping,€andÏboth€aggravated€rapes.€€There€is€no€record€of€the€private€conversation€betweenÏthe€judge,€the€victim,€and€her€mother.€€However,€€the€trial€judge€testified€at€theÏpost„conviction€proceeding€and€denied€having€been€unduly€influenced€by€theÏconversation.ÌÌà ` àIt€is€not€within€our€realm€of€review€to€second„guess€trial€strategy€decisions.€ÏòòHellard€v.€Stateóó,€629€S.W.2d€4,€9€(Tenn.€1982).€€Suffice€it€to€say€that€there€areÐ "0 Ðnumerous€possible€reasons€for€Defendantððs€counsel€to€choose€not€to€object€toÏthe€òòexóó€òòparteóó€conference.€€As€the€post„conviction€judge€pointed€out,€ð ð[theÐ p& ÐDefendantððs€counsel]€knew€the€emotional€nature€of€the€case.€€He€had€theÏopportunity€to€see€[this€victim]€testify€at€the€preliminary€hearing.€€He€knew€theÏimpact€that€testimony€could€have€at€the€sentencing€hearing.€€There€was€nothingÏfor€him€to€gain€by€objecting€to€this€suggested€meeting.ðð€€€We€therefore€decline€toÏfind€that€the€lack€of€an€objection€to€the€conference€resulted€in€deficientÏrepresentation€for€the€Defendant.€€In€addition,€there€is€no€showing€of€prejudice.ÌÌà ` àThird,€the€Defendant€argues€that€he€received€ineffective€assistance€ofÏcounsel€due€to€his€attorneyððs€failure€to€challenge€any€of€the€enhancement€factorsÏat€the€sentencing€hearing€or€on€appeal.€€In€response€to€this€argument,€we€noteÐ Ð9p02 Ðthat€this€Court€fully€reviewed€the€Defendantððs€sentence€on€appeal€and€affirmedÏthe€sentences€imposed€by€the€trial€court.€€The€record€shows€that€this€CourtÏconsidered€all€enhancement€factors€and€noted€that€some€of€the€factors€wereÏinappropriately€applied.€€This€Court,€however,€upheld€the€sentence€imposed€byÏthe€trial€court,€concluding,€ð ð[W]e€are€satisfied€that€[the€Defendantððs]€sentences€asÏfixed€by€the€trial€judge€are€of€a€length€commensurate€with€his€crimes.ðð€€Therefore,Ïthe€Defendant€has€shown€no€prejudice€caused€by€his€counselððs€failure€toÏchallenge€the€applied€enhancement€factors,€and€this€issue€is€without€merit.ÌÌà ` àFinally,€the€Defendant€claims€that€his€counsel€was€ineffective€on€appealÏand€lists€a€number€of€reasons€to€support€his€claim.€€He€states€thatÌÓÓà8 ` à[w]hen€the€[appellate]€brief€first€became€due,€counsel€did€not€file€aÏbrief,€and€the€Court€of€Criminal€Appeals€issued€a€show€cause€order.€ÏIn€response€to€the€show€cause€order,€counsel€attempted€toÏwithdraw.€€The€Court€refused€to€allow€him€to€withdraw€and€orderedÏhim€to€file€a€brief.€€The€attorney€then€filed€a€brief€which€substantivelyÏis€five€pages€long.€€The€attorney€did€not€file€a€reply€brief.Ð ` ü!` ü! ÐÌÓÑ?ÓIn€addition,€he€states€that€his€counsel€ð ðfailed€to€file€a€motion€to€reconsider€theÏCourt€of€Criminal€Appeals€opinion,€affirming€the€sentence€after€the€enhancingÏfactors€were€found€to€be€inapplicable,€and€failed€to€file€a€Motion€For€PermissionÏto€Appeal€to€the€Supreme€Court.ðð€ÌÌà ` àReviewing€the€record€before€us,€we€are€unable€to€find€ineffectiveÏrepresentation€concerning€the€appellate€brief.€€Although€Defendantððs€counsel€filedÏthe€brief€late,€the€Court€of€Criminal€Appeals€nevertheless€accepted€the€brief€andÏconsidered€it.€€For€this€reason,€the€Defendant€has€not€shown€prejudice€resultingÏfrom€the€late€filing€of€the€brief.€€Furthermore,€the€submission€of€a€five„page€briefÏdoes€not€constitute€ineffective€assistance€of€counsel€òòperóó€òòseóó.€€From€a€review€of€theÐ Ø8x/1 Ðrecord,€we€do€not€find€any€deficiency€of€representation€regarding€the€brief€itself.€ÏHowever,€even€assuming€deficiency€of€representation,€the€Defendant€has€failedÏto€show€prejudice€resulting€from€the€length€or€content€of€the€brief.ÌÌà ` àHowever,€with€regard€to€counselððs€failure€to€file€an€application€forÏpermission€to€appeal€to€the€Tennessee€Supreme€Court,€we€conclude€that€theÏDefendant€should€be€granted€a€delayed€opportunity€to€appeal.€€Tenn.€R.€Sup.€Ct.Ï28€ðð€9(D).€€Rule€14€of€the€Rules€of€the€Supreme€Court€requires€that€counsel€forÏan€indigent€defendant€obtain€the€consent€of€this€Court€before€withdrawing€asÏcounsel€following€first„tier€review.€Tenn.€R.€Sup.€Ct.€14.€€Rule€14€also€states€thatÏcounsel€must€forward€a€copy€of€his€motion€to€withdraw€and€written€notificationÏcontaining€certain€specific€information€to€the€defendant.€€òòId.óó€€ð ð[U]nilateralÐ °P Ðtermination€of€a€direct€appeal€following€first„tier€review€entitles€a€prospectiveÏDefendant€to€relief€in€the€form€of€a€delayed€appeal.ðð€€òòPinkston€v.€Stateóó,€668Ð "0 ÐS.W.2d€676,€677€(Tenn.€Crim.€App.€1984).ÌÌà ` àIn€the€case€before€us,€Defendantððs€counsel€testified€at€the€post„convictionÏproceeding€that€he€sent€to€the€Defendant€a€copy€of€the€opinion€from€this€CourtÏaccompanied€by€a€letter€explaining€the€Defendantððs€options.€€He€testified€that€theÏDefendant€never€responded.€€However,€Defendantððs€counsel€did€not€file€anÏapplication€for€permission€to€appeal€to€the€supreme€court,€nor€does€it€appear€thatÏhe€filed€a€motion€to€withdraw€as€counsel.€€Although€we€find€that€this€error€aloneÏdoes€not€necessarily€rise€to€the€level€of€ineffective€assistance€of€counsel,€weÏconclude€that€the€Defendant€should€be€granted€the€opportunity€to€pursue€aÏdelayed€appeal€to€the€Tennessee€Supreme€Court.€€òòSeeóó€Tenn.€R.€Sup.€Ct.€28€ððÐ à7€.0 Ð9(D).Ð Ð9p02 Їà ` àIn€conclusion,€in€the€words€of€the€post„conviction€judge,€the€DefendantÌÓAEÓà8 ` àgave€a€detailed€account€of€his€participation€in€this€brutalization€of€theÏ[rape€victim]€in€the€pre„sentence€report.€€He€went€on€for€some€threeÏpages€describing€the€sexual€acts€that€he€himself€committed,€andÏthat€the€other€individual€committed,€and€fully€acknowledged€theÏhorrendous€nature€of€this€crime€to€the€pre„sentence€officer€.€.€.€.Ð ` ü!` ü!
