'+ AFFIRMED DavidG.Hayes  3,1 Judge  x4p-2 @+ OPINION    ` Theappellant,ThomasHarlanMartin,appealshisBedfordCountyjuryconvictionformisdemeanorassault.=== =  #  1      ׀Thetrialcourtsubsequentlyimposeda x p sentenceofelevenmonths,twentyninedayswithareleaseeligibilityofseventyfivepercent.Inhissoleissueonappeal,hecontendsthattheevidenceisinsufficientasamatteroflawtosustainhisconviction. ` Afterreviewoftherecord,weaffirmthejudgmentofthetrialcourt.@ff) Background     ` Attrial,Mrs.MartintestifiedthatsheandtheappellantweremarriedonNovember5,1996,anddivorcedinJuly1997.Aftertheirdivorce,theappellant waskindoflivingoffandonwith[Mrs.Martin]atherresidence.OnSaturday,October25,1997,theappellantcommenceduponafourdaybingeofinflictingphysicalabuseuponhisexwife.Throughoutherfourdayordeal,Mrs.Martin wasforbidden[bytheappellant]...toleavetheresidence.Finally,onOctober28,fourdaysaftertheabusebegan,Mrs.Martinwasabletoescapewhentheappellantfellasleeponthecouch.Attrial,Mrs.Martinconcededthatshewroteanoteexculpatorytotheappellant;= ===  #  2      ׀however,sheexplainedthatsheonlydidsoto get +$( himoffof[her]back. ` AtapproximatelysevenoclockontheeveningofOctober28,BedfordCountyDeputyJanetHammackwasonpatrolwhenshereceivedadispatch @28+0 directinghertotheBirchStreetresidenceofThomasMcClendon,whereMrs.Martinhadsoughtrefuge.DeputyHammackrelatedthat [Mrs.Martins]wholefaceandneckwastotallyblackandblueandpurple; hereyeswereveryswollenduetoglassbeinginherfaceandinhereyes.AfterbrieflyspeakingwithMrs.Martin,DeputyHammacktransportedhertothehospital,whereMrs.Martinremainedforthenextfivedays. ` Dr.NormanSalibawasintroducedasanexpertwitnessinthefieldofgeneralmedicine.HetestifiedthathewasMrs.MartinsattendingphysicianwhenshewasadmittedtotheemergencyroomonOctober28.Dr.Salibaobserved manybruisesfromhertopofherheaddowntoabouthermidthigh.Mostofthosewereonthefrontpartofherbody.BecauseMrs.Martinhadsustainedaratherlargeinjurytoherleftcheekresultinginafracturetotheinteriorrimoftheeye,Dr.SalibaadmittedMrs.Martinintothehospital.Duringhistestimony,Dr.Salibaexplainedthatbruisesdevelopandhealthroughvariousphasesofcoloration.Usingthisknowledge,hedeterminedthatthebruisesonMrs.Martinspersonwererecentlyinflicted.HealsoopinedthatMrs.Martinsinjurieswereneitheraccidentalnorselfinflicted. ` Theappellanttestifiedinhisowndefense.HedeniedinflictinganyformofphysicalabuseuponhisexwifeduringtheperiodfromOctober25throughOctober28,1997.Rather,heexplainedthathiswifesustainedmultiplefallsasaresultofadrunkenstuporinducedfromdrinkingacombinationof corncobwineandseveralquartsofSilverThunderbeer.HeexplainedthatheaskedMrs.Martintowritethenoteexculpatinghimbecauseheanticipatedtheveryallegationsthatresulted.Althoughtheappellantdeniedanyphysicalabuseofthevictim,hedidacknowledgethatMrs.Martin bustedapictureframeovermyheadandthatheretaliatedby bust[ing]oneoverhers. ` Baseduponthisevidence,thejuryfoundtheappellantguiltyofassault.
