AsentencinghearingwasscheduledforApril9,1997.Atthehearing,notestimonywaspresentedbytheappellantorbytheState.Theappellantrelieduponasentencingmemorandumpreviouslyfiledandthepresentencereport.Additionally,wenotethatthetranscriptoftheguiltypleahearingwasnotincludedintherecord,therefore,weareprecludedfromareviewofthenatureandcircumstancesoftheoffense. .   ׀Indenyinganonincarcerativesentence,thetrialcourtnoted:8 [T]hisCourtfindsasitsreasonsfornotgrantingatotalsuspendedsentenceoracompletecommissiontoCommunityCorrectionsfortheentireperiodthefollowingreasons.Thecircumstancesofthisoffense.Thismanknowinglyandintentionallyplacedhimselfdirectlyinthemiddleofanongoingdopeoperationandvoluntarilyparticipated.Totalsuspensionwouldnotbeinthebestinterestofjustice,itwouldnotbeinthebestinterestofthisdefendant,anditcertainlywouldntbeinthebestinterestofthepublic.8 Ihaveconsideredthedeterrenteffect,perhapsmoresointhiscasethanothercasesofalikenature,becauseofthepeculiarcircumstancesofthecase.Lastly,Iamoftheopinionthatconfinementisnecessarytoavoiddeprecatingtheseriousnessoftheoffense. Reviewbythiscourt,ofthelength,range,ormannerofserviceofasentenceisdenovowithapresumptionthatthedeterminationmadebythesentencingcourtiscorrect.Tenn.CodeAnn.4035401(d)(1990).Thispresumptiononlyapplies,however,iftherecorddemonstratesthatthesentencingcourtproperlyconsideredrelevantsentencingprinciples.Statev.Ashby,823S.W.2d166,169(Tenn.1991).Inthecasebeforeus,therecordreflectsthatthesentencingcourtconsideredrelevantsentencingprinciples;thus,thepresumptionapplies.Theburdenisontheappellanttoshowthatthesentenceimposedwasimproper.SentencingCommissionComments,Tenn.CodeAnn.4035401(d). TheappellantarguesonappealthatthefactsofthiscaseareanalogoustothoseinStatev.Ashby,823S.W.2dat166.However,suchacomparisonismisplaced.ThedefendantinAshbywasconvictedofaclassCfelonyand,therefore,wasentitledtothepresumptionofanalternativesentence.TheappellantinthiscasewasconvictedofaclassBfelonyand,thus,wasnotentitledtothepresumptionofanalternativesentence.Moreover,inAshbythetrialcourtimposedapenitentiarysentence.Inthiscase,thetrialcourtgrantedanalternativesentence.
