àThe€record€indicates€that€beginning€in€August€of€1995,€Appellant€beganÏmaking€regular€visits€to€the€home€of€her€eighty„four„year„old€wheelchair„boundÏuncle,€J.€C.€Biles,€in€order€to€check€on€him€and€help€take€care€of€his€house.€€AtÏsome€time€thereafter,€Appellant€began€taking€steps€to€have€Biles€put€in€a€nursingÏhome€and€began€discussions€with€other€family€members€about€who€should€haveÏcontrol€of€Bilesðð€assets.€ÌÌà ` àAfter€some€discussions€between€Appellant€and€her€brother€and€sister,ÏAppellantððs€brother€took€Biles€to€the€office€of€a€notary€for€the€purpose€of€havingÏBiles€grant€a€power€of€attorney€to€Appellantððs€sister.€€While€Appellantððs€brotherÏwas€taking€Biles€into€the€notaryððs€office€in€order€to€complete€the€power€ofÐ \8ü.0 Ðattorney,€Appellant€arrived,€took€the€documents€that€granted€the€power€ofÏattorney,€and€tore€them€up.€ÌÌà ` àIn€August€of€1996,€Appellant€forged€Bilesðð€signature€on€a€document€whichÏpurported€to€grant€her€a€power€of€attorney.€€Appellant€then€took€the€document€toÏher€codefendant€and€had€the€codefendant€notarize€the€document.€€A€few€daysÏlater,€Appellant€and€her€codefendant€went€to€Bilesðð€bank€and€withdrewÏ$39,892.00€from€Bilesðð€account.€€Appellant€then€took€the€money€and€depositedÏit€in€another€bank€in€an€account€under€the€names€of€Appellant€and€Biles.€ÏAppellant€subsequently€gave€$5,000.00€of€the€money€to€her€codefendant€and€sheÏused€another€$2,000.00€to€post€their€bond€after€they€had€been€charged€in€thisÏmatter.€ÌÌà@>>#®àò òII.€€LENGTH€OF€SENTENCEó óˆÐ "0 ÐÌà ` àAppellant€contends€that€the€trial€court€erroneously€sentenced€her€to€aÏlonger€term€than€she€deserves.€€Specifically,€Appellant€argues€that€the€trial€courtÏmisapplied€an€enhancement€factor€when€it€determined€the€length€of€herÏsentence.ÌÌà Ða€Range€I€offender€convicted€of€a€Class€C€felony€is€between€three€and€six€years.€ÏTenn.€Code€Ann.€ðð€40„35„112(a)(3)€(1997).€€When€both€enhancement€andÏmitigating€factors€are€applicable€to€a€sentence,€the€court€is€directed€to€begin€withÏthe€minimum€sentence,€enhance€the€sentence€within€the€range€as€appropriate€forÏthe€enhancement€factors,€and€then€reduce€the€sentence€within€the€range€asÏappropriate€for€the€mitigating€factors.€€Tenn.€Code€Ann.€ðð€40„35„210(e)€(1997).ÌÌà àIn€enhancing€Appellantððs€sentence€from€three€to€four€years,€the€trial€courtÏfound€that€enhancement€factor€(4)€applied€because€the€victim€was€particularlyÏvulnerable€due€to€age€or€physical€or€mental€disability.€€òòSeeóó€Tenn.€Code€Ann.€ððÐ à7€.0 Ð40„35„114(4)€(1997).€€The€trial€court€also€found€that€mitigating€factor€(1)€appliedÐ Ð9p02 Ðbecause€Appellantððs€conduct€neither€caused€nor€threatened€serious€bodily€injury.€ÏòòSeeóó€Tenn.€Code€Ann.€ðð€40„35„113(1)€(1997).Ð P ð ÐÌà ` àAppellant€claims€that€the€trial€court€erred€when€it€applied€enhancementÏfactor€(4)€because€there€was€no€proof€that€Biles€had€any€disability€other€than€age.€ÏHowever,€the€record€indicates€that€Appellant€stipulated€at€the€sentencing€hearingÏthat€this€factor€was€applicable.€€Indeed,€the€record€indicates€that€the€followingÏcolloquy€took€place€during€the€sentencing€hearing:Ìñ<ñÓÓñ<ñà0
