àOfficer€Ragan€McDevitt€with€the€Hamilton€County€Sheriffððs€DepartmentÏtestified€as€follows.€At€approximately€9:30€p.m.€on€June€22,€1996,€he€wasÏdispatched€€to€the€scene€of€a€single€motor€vehicle€accident€in€Hamilton€County,ÏTennessee.€€When€McDevitt€arrived,€other€emergency€personnel€were€present,Ïand€Appellant,€his€wife,€and€his€fifteen€(15)€year€old€niece,€Jessica€Long,€wereÏstanding€outside€of€the€vehicle.€€When€McDevitt€inquired€as€to€how€the€accidentÏâ âoccurred,€Appellant€informed€the€officer€that€he€had€lost€control€of€the€vehicleÐ 1¨'( Ðwhile€maneuvering€a€curve€and€traveling€down€a€hill.€€Appellant€advised€theÏofficer€that€he€had€been€driving€the€vehicle€and€did€not€have€his€driverððs€license.Ìâ âà ` àThe€vehicle€involved€in€the€accident€was€a€Toyota€pickup€with€a€benchÏseat.€€When€McDevitt€questioned€the€passengers€as€to€their€relative€positions€inÏthe€truck€when€the€accident€occurred,€Cheryl€Mingie,€Appellantððs€wife,€advisedÏthe€officer€that€she€had€been€sitting€in€the€middle€of€the€seat.€€Jessica€stated€thatÏshe€was€sitting€next€to€the€passenger€door.€€Ìà ` àWhile€investigating€the€accident,€the€officer€noticed€that€Appellant€wasÏhaving€difficulty€keeping€his€balance.€€McDevitt€observed€that€Appellant€hadÏbloodshot€eyes€and€smelled€of€alcohol.€€Further,€McDevitt€noticed€that€AppellantððsÏspeech€was€slow€and€he€was€unstable€on€his€feet.€€€Officer€McDevitt€arrestedÏAppellant€for€driving€under€the€influence€of€an€intoxicant€and,€while€escortingÏAppellant€to€the€police€car,€had€to€ð ðhold€on€to€him€to€keep€him€from€falling.ðð€Ìà ` àSubsequently,€Appellant€signed€an€implied€consent€form€and€acquiescedÏin€a€breathalyser€test.€€Appellantððs€blood€alcohol€content€was€found€to€be€0.17.€Ìà ` àAt€trial,€€Jessica€Long€testified€on€behalf€of€the€defense.€€She€stated€thatÏCheryl€Mingie,€not€Appellant,€had€been€driving€the€vehicle€at€the€time€of€theÏaccident.€€Jessica€testified€that,€when€Officer€McDevitt€inquired€as€to€who€was€theÏdriver€of€the€vehicle,€Appellant€responded,€ð ðIf€I€tell€you€I€was€driving€this€truck,€willÏyou€let€the€ladies€go?ðð€€On€cross„examination,€however,€Long€acknowledged€thatÏshe€failed€to€advise€anyone€that€Cheryl€Mingie€was€the€driver€of€the€vehicle€untilÏthe€day€of€trial,€which€was€approximately€eighteen€(18)€months€after€the€date€ofÏthe€incident.€Ìà ` àThe€jury€found€Appellant€guilty€of€driving€under€the€influence€of€anÏintoxicant.€€The€parties€submitted€the€issue€whether€Appellant€was€guilty€of€a€fifthÐ à7€.0 Ðoffense€to€the€trial€court.€€The€trial€court€found€Appellant€to€be€a€fifth€offender€ofÏdriving€under€the€influence.€€Appellant€also€pled€guilty€to€driving€on€a€revokedÏlicense.׃×Ý ƒ #ÃÝòòÚ  Ú2Ú  ÚóóÝ àIn€his€sole€issue€on€appeal,€Appellant€challenges€the€sufficiency€of€theÏconvicting€evidence.€€Specifically,€he€claims€that€he€cannot€be€convicted€solelyÏon€the€basis€of€his€uncorroborated€extra„judicial€confession.€€He€further€arguesÏthat€because€Jessica€Long€was€present€at€the€time€of€the€accident,€her€testimonyÏis€more€reliable€than€that€of€Officer€McDevitt.€€Therefore,€he€contends€that€theÏjury€should€have€afforded€Longððs€testimony€greater€weight€than€McDevittððs.Ìà@EE-®àò Ðà ` àIn€the€case€òòsub€judiceóó,€Appellant€informed€the€officer€that€he€was€the€driverÐ `  Ðof€the€vehicle€when€the€accident€occurred.€€This€inculpatory€statement€wasÏcorroborated€when€the€other€passengers€of€the€vehicle€informed€Officer€McDevittÏthat€Appellantððs€wife€was€sitting€in€the€middle€of€the€seat,€and€Jessica€was€by€theÏpassenger€door.€€Neither€Mrs.€Mingie€nor€Jessica€contradicted€AppellantððsÏstatement€that€he€was€the€driver€of€the€vehicle.€€Officer€McDevitt€testified€at€trialÏthat€he€received€ð ðno€indicationðð€from€the€passengers€that€Appellant€was€not€theÏdriver€of€the€vehicle.ÌÓÓà8 ` àÐ ` ü!` ü!
