[J]ustas[he]turnedoutofthedriveway,theappellantfiredthepistoland theroundcamethroughthewindshield. p9h28 ..[and]hittheseat,missingMr.Taylorbyinches.Mr.Taylordrovetoanearbyresidencewherehenotifiedlocallawenforcementofficers. ` OnSeptember20,1994,theJeffersonCountyGrandJuryreturnedanindictmentchargingtheappellantwithonecountofaggravatedassaultbyuseofafirearm.OnJune24,1998,theappellantenteredaguiltypleatothischarge.9> >>>999  #  1      כ   Pursuanttothenegotiatedpleaagreement,theappellantreceivedathreeyearsentenceasarangeIoffender.Themannerofserviceofthesentencewassubmittedtothetrialcourtfordetermination. ` AsentencinghearingwasheldonSeptember17,1998.TheStateintroducedtwopresentencereportsintoevidence,onepreparedinOctober1994andthesecondsubmittedSeptember1998.Bothreportsindicatethattheappellantwasfortyeightyearsoldatthetimeoftheoffense,fiftytwoyearsoldatthetimeofsentencing.Hismaritalstatusvariedduringthetimebetweenthedateoftheoffenseandthesentencinghearing.Atthetimeoftheoffense,theappellantwasdivorcedfromhisfirstwifeandlivingwithBrendaCollins.Whenthesecondpresentencereportwasprepared,hewasintheprocessofdivorcinghissecondwife,TinaNewcom,andwaslivingwithhisgirlfriend,DebraHill.Bythetimeofthesentencinghearing,theappellantwasmarriedagain. ` AlthoughtheappellanthadbeentheproprietorofBillsAutoSalesinKnoxvillesince1972;in1994,hewasforcedtorelinquishhisinterestinthebusinessduetomedicalproblems.Atthetimeofthesentencinghearing,theappellantwasreceivingfoodstampsandwasintheprocessofapplyingfordisability.Theappellantsmedicalhistoryrevealsthattheappellantsuffersfrom severecarotidarterydisease...,seizuredisorder,alcoholism,depressionand 5.4 anxietyorder,hypertension,hyperlipidemia,tobaccoaddiction...anddegenerativediscdisease....Despitehisnumerousmedicalconditions, [theappellants]abilitytosee,speak,[and]walkisnotimpaired.Therecordalsoindicatesthatthereisnodisputeastohisabuseofalcohol.Theappellantdeniesanyprioropportunitiesforrehabilitativetreatmentofhisaddiction.Notwithstanding,therecorddoesindicatethattheappellantfailedtoappearattwoscheduledcounselingsessionswithDr.WilliamConklin.999 9  #  2      ׀Moreover,theappellantsmedicalrecordsofFebruary25,1996,   revealhisphysiciansrecommendationsforalcoholrehabilitation. ` Additionally,theappellanthasapriorcriminalhistoryreflectinghislongstandingabuseofalcoholandhisproclivitytogoarmed.Specifically,theappellantscriminalrecordconsistsofsixconvictionsforpublicintoxication,threeconvictionsforunlawfulpossessionofaweapon,oneconvictionofdisorderlyconduct,andoneconvictionformaliciousmischief.9 99 9  #  3      ׀Indeed,hismostrecent d\ arrestsandresultingconvictionsforpublicintoxicationandunlawfulpossessionofaweaponoccurredwhileonbailforthepresentcharge.Therecordalsoindicatesthattheappellanthaspreviouslybeengrantedasuspendedsentence.Bothpresentencereportsconcludedthattheappellantwas ahighriskcandidateforprobationand wouldbeconsideredamaximumrisktosuccessfullycompleteprobation. ` Insupportofhisrequestforprobation,theappellanttestifiedonhisownbehalf.Hedescribedtothecourthisaccountoftheextenuatingcircumstancesthatledtotheinstantconvictionforaggravatedassault.Heexplainedthat,sevenoreightmonthspriortotheincidentinvolvingMr.Taylor,hewasresponsibleforajudgmentof$15,000beingenteredagainsthisformerbusinesspartner.Consequently,hetestified,hislifewasthreatenedbyhisformerpartner.Because 5.4 ofhisfearofretaliationbyhisformerpartner,hefeltthreatenedbyMr.TaylorsunexpectedpresenceonhispropertyandfiredawarningshottofrightenMr.Taylorfromthepremises.9999  #  4      ׀TheappellantmaintainedthathehadnotintendedtohitMr.   Taylorsvehicle;rathertheimpactwastheresultoftheappellantsintoxicatedstateandthehairtriggeronthepistol. ` Theappellantadmittedthathehadnotsufferedanysymptomsofalcoholwithdrawalsincebeingincarceratedinthecountyjail.Healsodeniedanypreviousplacementonprobation.Moreover,heexplainedhisfailuretoappearforcourtonnumerousoccasionsintheinstantmatterasaresultofhismedicalconditionandthedeathofhismother.Finally,inresponsetoapendingchargeoffailuretoappearonanothermatter,theappellantdeniedtheallegation,averringthathewasincourt. ` Inareasonedrecitationofitsfindings,thetrialcourtdeniedanyformofalternativesentencingandorderedthattheappellantreporttoconfinementonOctober5,1998.Specifically,thetrialcourtfoundthatthenatureandcircumstancesoftheoffense,theappellantscontradictorytestimonyatthesentencinghearing,theappellantshistoryofalcoholrelatedpriorconvictions,theappellantsrecentconvictionscommittedwhileonbailforthependingcharge,andtheappellantspoorpotentialforrehabilitationsupportedthedenialofasentenceotherthanoneoftotalconfinement. ` Inthisappeal,theappellantchallengesthetrialcourtsfindingarguingthatanalternativesentencecannotbedeniedbecause hehasneverhadanytreatmentorrehabilitationtoaddresshis[alcohol]problem,heexhibitedremorseoverthe6 5.4 6incident,andhewasfearfulofretaliationbyhisformerbusinesspartner.Wefindnomerittotheappellantscontentions. ` Whenachallengeismadetothemannerofserviceofasentence,thiscourtconductsadenovoreviewwiththepresumptionthatthedeterminationmadebythe 80 trialcourtiscorrect.Tenn.CodeAnn.4035401(d)(1997).Thispresumptiononlyappliesiftherecorddemonstratesthatthetrialcourtproperlyconsideredrelevantsentencingprinciples.SeeStatev.Ashby,823S.W.2d166,169(Tenn.1991),In   thepresentcase,thetrialcourtproperlyconsideredsuchprinciplesandthepresumptionofcorrectnessapplies.Moreover,theappellantbearstheburdenofshowingthatthesentenceimposedbythetrialcourtisimproper.SeeTenn.Code  Ann.4035210(b)(3)(1997). ` Theappellanthasfailedtocarryhisburden.First,theappellantsassertionthattheabsenceofanypreviouslyimposedsubstanceabusetreatmentprogrambytheStateprohibitsafindingthatpasteffortsatrehabilitationhavefailedismisplaced.Theappellanthasatwentyyearhistoryofcriminalbehaviorresultingfromhisabuseofalcoholandhispropensitytocarryaweaponwhileintoxicated.SeeTenn.CodeAnn.4035103(1)(A)(1997).Despitehisnumerousconvictions d'\ $ andpriorrecommendationstoobtainsuchtreatment,theappellanthasignoredsuchwarningsandcontinueshisdestructiveconduct.Next,thecircumstancesoftheoffenseareparticularlyseriousinthattheappellant,withoutprovocation,hadnohesitationinfiringaweaponatanunarmedandinnocentperson.Additionally,Mr.Taylortestifiedthat,atthetimeoftheincident,childrenwereplayingintheyardnextdoortotheappellantsresidenceandcouldhavebeeninjured.SeeTenn.Code ,2$+0 Ann.4035103(1)(B).Finally,theappellantcommittedsimilaroffensesandfailedtoappearfornumerouscourtdateswhileonbailpendingresolutionofthepresentcharge.This,inandofitself,reflectsgreatlyupontheappellantslackof7 \9T28 7rehabilitativepotentialandupontheobviousrisksofplacingtheappellantonanyformofrelease. ` Therecordsupportsthefindingsofthetrialcourt.WeconcludethatasentenceoftotalconfinementisappropriateandjustifiedundertheSentencingAct.Thejudgmentofthetrialcourtdenyingtheappellantanonincarcerativesentenceisaffirmed.88 `     h   ____________________________________ `     h   DAVIDG.HAYES,JudgeCONCUR:44________________________________0/john/01JOHNH.PEAY,Judge1551________________________________JOHNEVERE121T123TTWILLIAMS,Judge3
