FACTS    Thepoliceconfiscatedtheappellant'sautomobile,morethantwothousanddollarsincash,andotherpersonalproperty.Theappellantwasservedwithanoticeofseizure.Thenoticeadvisedhimthathehad30dayswithinwhichtofileaclaimifheintendedtocontestforfeitureofhisproperty.Theappellant,however,chosenottofileaclaim.Thepropertywasaccordinglysubjectedtoadministrativeforfeiture.   ANALYSIS    Afterbeingnotifiedoftheproceedings,appellantelectedtoneitherfileaclaimnorenteranappearancetocontesttheforfeiture.Accordingly,wemustdecidewhetheranontrialadministrativeforfeitureconstitutespunishmentwhichwouldoperatetobarsubsequentcriminalsanctions. Apartyassertingdoublejeopardymusthavebeenapartytoapriorproceeding.UnitedStatesv.Schinnell,80F.3d1064,1068(5thCir.1996);UnitedStatesv.Torres,28F.3d1463,1465(7thCir1994).Toattainpartystatusinacivilforfeiture,onemust,attheveryleast,fileaclaiminresponsetothenoticeofseizure.SeeUnitedStatesv.Walsh,873F.Supp334,33637(D.Ariz.1994)(citingTorresforpropositionthatjeopardydidnotattachtoforfeitureproceedingwheredefendantdidnotmakeanyclaimincivilforfeitureproceeding).
