Havingreviewedthestatesmotioninlightofthepetitionersbriefandtherecordasawhole,weconcludethatthemotioniswelltakenandshouldbegranted.Indismissingthepetition,thetrialcourtfoundthatthepetitionerhadfailedtoshowuponthefaceofthejudgmentortherecordoftheproceedingsuponwhichthejudgmentwasrenderedthattheconvictingcourtwaswithoutjurisdictionorauthoritytosentencethepetitionerorthatthepetitionerssentenceofimprisonmentorotherrestrainthasexpired.SeeStatev.Archer,851S.W.2d157(Tenn.1993).  Weagreewiththetrialcourtsruling.Theconvictingcourtinthiscasehadjurisdictionoverboththesubjectmatterandperson,andnothingintherecordbeforeusdemonstratesthattheconvictingcourtsactionswereunauthorized.Norhasthepetitionershownthathissentencehasexpired.Contrarytothepetitioner'sargument,theTennesseeCriminalSentencingReformActof1989,whichrepealedthehabitualcriminalstatute,specificallystatesthat"[t]hisactshallnotaffectrightsanddutiesmatured,penaltiesthatwereincurred,orproceedingsthatwerebegunbeforeitseffectivedate."1989Tenn.Pub.Actsch.591,115.Moreover,thehabitualcriminalstatutehasrepeatedlybeendeclaredconstitutionalbythecourtsofthisstate.Seee.g.Pearsonv.State,521S.W.2d225(Tenn.1975);Statev.Kilby,763S.W.2d389,39394(Tenn.Crim.App.1988).Therefore,sincethepetitionerisnotchallengingtheappropriatenessofhissentenceatthetimeitwasimposed,hispresentclaimmustfail.SeeStatev.Russell,866S.W.2d578,58182(Tenn.Crim.App.1991).  Accordingly,wecannotfindanyerroronthepartofthetrialcourtindismissingthepetition.ItisthereforeORDEREDthatthestatesmotionisgranted.PursuanttoRule20oftheRulesoftheCourtofCriminalAppeals,weaffirmthetrialcourtsdismissalofthepetitionerspetitionforwritofhabeascorpus.
