àThe€victim€was€twelve€years€old€at€the€time€of€trial.€€She€was€born€inÏ1982,€and€the€appellant€was€her€stepfather.€€She€testified€that€when€she€was€sixÏyears€old,€the€appellant€instructed€her€to€run€out€of€the€house€if€he€ever€cameÏinto€her€bedroom€"to€do€something."€€Shortly€thereafter,€the€appellant€enteredÏthe€victim's€bedroom€and€instructed€her€to€remove€her€clothing.€€She€removedÏeverything€but€her€shirt.€€She€stated€that€the€appellant€undressed.€€He€thenÏplaced€her€blanket€over€her€face€and€inserted€his€penis€into€her€vagina.€€SheÏstated€that€the€penetration€hurt€and€made€her€cry.ÌÌà àThe€victim€testified€that€when€she€was€in€the€second€grade,€or€sevenÏyears€old,€the€appellant€again€"put€his€privates€in€[her]."€€That€summer,€theÏappellant€took€her€into€his€bedroom€after€her€mother€had€left€for€work.€€SheÏstated€that€if€she€cried,€he€would€hit€her€and€tell€her€to€"shut€up."ÌÌà àThe€victim€next€testified€to€sexual€assaults€occurring€during€her€thirdÏgrade€year.€€She€stated€that€when€her€mother€was€home,€the€appellant€wouldÏtake€her€into€the€woods.€€The€appellant€would€place€a€blanket€on€top€of€the€car.€ÏShe€stated€the€appellant€would€make€her€undress€and€have€intercourse€withÏhim.€€Following€the€sexual€act,€they€would€go€shopping.€€She€could€not€recallÏhow€many€times€the€appellant€sexually€penetrated€her€during€that€time€frame.€ÏShe€did,€however,€testify€that€it€happened€"a€lot."ÌÌà àThe€victim€next€testified€that€when€she€was€nine€years€old,€she€and€theÏappellant€took€showers€together.€€She€also€stated€that€he€would€approach€herÏafter€she€showered€but€before€she€had€time€to€get€dressed.€€She€stated€that€heÏwould€then€"take€me€into€his€room€.€.€.€and€put€his€privates€in€me."€€She€statedÏthat€this€happened€on€more€than€one€occasion.€€She€stated€that€he€raped€herÏvaginally€and€anally.€€She€also€stated€that€she€rubbed€his€privates€and€"whiteÏstuff€came€out."ÌÌà àThe€victim€testified€that€the€appellant€took€naked€pictures€of€her.€€SheÏstated€that€he€kept€them€in€his€drawer.€€She€testified€that€later€he€cut€up€theÏpictures€"and€threw€them€away€.€.€.€in€the€garbage€can."ÌÌà àThe€victim€testified€that€in€1992€she€had€head€lice.€€€She€stated€that€afterÏshe€washed€her€hair€with€the€lice€shampoo,€the€appellant€took€her€into€hisÏbedroom.€€He€then€"put€his€privates€in€[her]."ÌÌà àLouise€Head€testified.€€She€worked€at€the€victim's€day€care.€€SheÏdescribed€the€victim€as€being€"real€shy"€and€"timid."€€She€stated€that€the€victimÏisolated€herself€and€had€a€low€self€worth.€€When€she€complimented€the€victim,Ïshe€stated€the€victim€would€respond€"I'm€ugly."€€She€further€stated€that€the€victimÏpulled€away€from€her€whenever€she€tried€to€communicate€with€her.ÌÌà àMs.€Head€testified€that€when€the€victim€was€around€six€years€old,€she€hadÏtold€day€care€workers€that€the€appellant€sexually€abused€her.€€Ms.€HeadÏinformed€the€victim's€mother€of€the€sexual€abuse€allegations.€€Ms.€Head€statedÏthat€the€mother€wrote€the€allegations€off€as€lies.€€Approximately€four€years€later,Ïin€1992,€the€allegations€resurfaced.€€The€1992€allegations€were€brought€to€theÏattention€of€the€police.ÌÌà àThe€victim€was€interviewed€and€examined€at€a€child€sex€abuse€clinic.€€ÏMedical€examinations€revealed€physiological€findings€consistent€with€theÏvictim's€allegations€of€abuse.€€The€victim€had€a€damaged€hymen.€€MedicalÏtestimony€also€established€that€vaginal€penile€penetration€was€not€onlyÏpossible,€but€was€consistent€with€their€findings.ÌÌÓ  Óò òIó óÌÓ  ÓÌà àThe€appellant's€first€assignment€of€error€is€that€the€evidence€wasÏinsufficient€to€support€the€convictions.€€He€argues€that€the€victim's€testimony€wasÏnot€credible,€and€she€was€motivated€to€lie.€€Therefore,€pursuant€to€òòTome€v.ÏUnited€Statesóó,€___€U.S.€___,€115€S.€Ct.€696€(1995),€he€argues€that€theÏconviction€cannot€€be€based€solely€upon€her€testimony.ÌÌà àAppellant's€argument€is€misguided.× ƒ, ××  ×€€Assessing€witness€credibility€isÏexclusively€"the€purview€of€the€jury."€€òòState€v.€Barnesóó,€874€S.W.2d€73,€78€(Tenn.ÏCrim.€App.€1993).€€The€jury€may€take€into€consideration€all€the€evidence€andÏdraw€whatever€reasonable€inferences€that€may€exist€therefrom.€€òòState€v.ÏCopelandóó,€677€S.W.2d€471,€474€(Tenn.€Crim.€App.€1984).€€We€will€not€reweighÏthe€evidence.€€Nor€will€we€supplant€the€jury's€inferences€with€those€of€our€own.€ÏòòIdóó.€(citing€òòHawkins€v.€Stateóó,€469€S.W.2d€515€(Tenn.€Crim.€App.€1971)).ÌÌà àAppellant's€first€issue€further€alleges,€under€a€separate€heading€"OtherÏSex€Crimes,"€that€the€victim's€testimony€did€not€relate€specific€dates€or€instancesÏand,€therefore,€cannot€support€the€conviction.€€Appellant€intertwines€anÏargument€that€the€non„date€specific€testimony€was€improper€and€violated€òòStateÏv.€Rickmanóó,€876€S.W.2d€824,€829„30€(Tenn.€1994).€€Again,€appellant'sÏargument€is€misguided.ÌÌà àEvidence€of€other€sex€crimes€is€admissible€when:€€(1)€€the€indictment€isÏnot€time€specific,€and€(2)€€the€evidence€related€to€sex€crimes€that€allegedlyÏoccurred€during€the€time€frame€as€charged€in€the€indictment.€€òòRickmanóó,€876ÏS.W.2d€at€829.€€In€such€cases,€however,€the€state€must€elect€at€the€close€of€itsÏproof€the€particular€incident(s)€for€which€a€conviction€is€being€sought.€€òòIdóó.ÌÌà àThe€victim€testified€to€acts€occurring€within€the€time€span€charged€in€theÏindictment.€€The€victim€was€a€young€child.€€The€state€was,€therefore,€properlyÏgranted€latitude€while€prosecuting€the€appellant's€crimes€against€a€young€victimÏunable€to€identify€the€specific€dates€of€the€charged€offenses.€€òòIdóó.€€(citing€òòSheltonÏv.€Stateóó,€851€S.W.2d€134,€137€(Tenn.€1993)).ÌÌà àThe€state,€however,€points€out€that€the€prosecution€may€have€failed€toÏproperly€elect€the€particular€offenses€for€which€the€appellant€was€charged€inÏcounts€4€and€5€and€in€counts€6€and€7.€€The€state€argues€that€the€appellant€eitherÏwaived€the€issue€or,€in€the€alternative,€that€the€evidence€was€sufficiently€specificÏto€sustain€convictions€on€counts€4€and€6.€€The€appellant's€reply€brief€concurs€inÏthe€state's€assertion€of€probable€error€and€argues€that€the€error€is€ofÏconstitutional€dimension€and,€therefore,€cannot€be€waived.ÌÌà àWe€have€reviewed€the€entire€record.€€As€to€count€1,€the€appellant€wasÏcharged€with€rape€for€the€vaginal€penetration€occurring€when€the€victim€was€sixÏyears€old.€€Count€2€was€the€vaginal€penetration€occurring€when€the€victim€wasÏseven€years€old.€€Count€3€was€the€anal€penetration€occurring€when€the€victimÏwas€seven€years€old.€€Count€8€charged€the€appellant€with€aggravated€sexualÏbattery€for€forcing€the€victim€to€masturbate€him€to€a€climax.€€For€count€9,€theÏappellant€was€charged€with€raping€the€victim€when€she€was€approximately€tenÏyears€old.€€Accordingly,€we€find€that€reasonable€minds€could€not€differ€as€to€theÏparticular€offenses€that€constituted€counts€1,€2,€3,€8,€and€9.ÌÌà àFor€counts€4€and€5,€the€state€relied€upon€the€victim's€testimony.€€SheÏtestified€that€when€she€was€eight,€the€appellant€took€her€into€the€woods.€€SheÏstated€that€he€would€place€a€blanket€over€the€hood€of€the€car.€€Then€he€wouldÏrape€her.€€She€stated€that€after€the€appellant€raped€her,€"sometimes"€they€wouldÏgo€to€the€store€and€buy€her€mother€flowers.€€She€testified€that€she€could€notÏcount€how€many€times€this€happened€but€stated€that€it€happened€"a€lot."ÌÌà àOn€counts€6€and€7,€the€appellant€was€charged€with€rape€for€incidentsÏoccurring€when€the€victim€was€nine.€€She€testified€that€on€one€occasion,€theÏappellant€caught€her€getting€out€of€the€shower.€€She€stated€that€before€sheÏcould€get€dressed,€he€took€her€into€his€room€and€"put€his€privates€in€[her]."€€SheÏstated€that€sometimes€they€showered€together€before€he€would€rape€her.ÌÌà àAt€the€close€of€the€state's€proof€in€chief,€the€judge€had€a€duty€to€requireÏthe€state€to€elect€the€particular€offenses€for€which€it€was€seeking€convictions.€ÏòòBurlison€v.€Stateóó,€501€S.W.2d€801,€804€(Tenn.€1973).€€Election€shall€be€requiredÏto€ensure€unanimity€in€jury€verdicts.€€òòSheltonóó,€851€S.W.2d€at€137.€€The€electionÏrequirement€is€"fundamental,€immediately€touching€on€the€constitutional€rightsÏof€an€accused."€€òòState€v.€Purvisóó,€No.€02C01„9412„CC„00278€(Tenn.€Crim.€App.ÏSept.€20,€1995)€(quoting€òòSheltonóó,€851€S.W.2d€at€137).€€The€duty€is€incumbentÏupon€the€trial€court€even€in€the€absence€of€a€specific€request€by€the€defendant.€ÏòòBurlisonóó,€501€S.W.2d€at€804.€€òòSeeóó€òòState€v.€Claboóó,€No.€03C01„9307„CR„00217Í(Tenn.€Crim.€App.€Jan.€12,€1995)€(holding€trial€court's€failure€to€order€electionÏwas€plain€error).ÌÌà àThe€victim€testified€that€the€appellant€had€penetrated€her€on€more€thanÏone€occasion€when€she€was€eight€years€old.€€She€did€not€however,€distinguishÏone€crime€or€event€from€another.€€She€merely€stated€that€it€happened€"a€lot"€andÏ"sometimes"€they€bought€flowers€at€the€store€afterwards.€€Likewise,€counts€6€andÏ7€charge€two€counts€of€rape€occurring€when€the€victim€was€nine€years€old.€€WeÏfind€that€the€state's€failure€to€require€election€on€counts€4,€5,€6,€and€7€constitutesÏreversible€error.€€Accordingly,€counts€4,€5,€6,€and€7€are€reversed€and€remandedÏfor€a€new€trial€at€the€state's€discretion.ÌÌà àAppellant€also€contends€that€the€state's€expert€"commented€on€the€factÏthat€[the€victim's]€statements€to€her€were€very€credible."€€He€argues€that€suchÏcomments€were€harmful€error.€€He€cites€òòState€v.€Ballardóó,€855€S.W.2d€557€(Tenn.Ï1994)€in€support€of€his€contention.€€We€have€reviewed€that€portion€of€the€recordÏhe€cites.€€However,€we€are€unable€to€find€the€comments€which€the€appellantÏclaims€to€have€occurred.€€Accordingly,€the€issue€is€waived€pursuant€to€Tenn.€R.ÏCt.€Crim.€App.,€Rule€10.ÌÌÓ  Óò òIIó óÌÓ  ÓÌà àThe€appellant's€next€assignment€of€error€is€that€the€"direct€and€cross„examination"€of€the€victim€were€unduly€prejudicial€and€violated€his€right€to€dueÏprocess.€€The€appellant€argues€that€the€trial€court€abused€its€discretion€inÏpermitting€the€state€to€ask€the€victim€leading€questions.ÌÌà àTrial€courts€are€vested€the€authority€to€supervise€the€presentation€ofÏevidence.€€Tenn.€R.€Evid.,€Rule€611.€€Trial€courts€may€permit€leading€questionsÏto€victims€in€child€sexual€abuse€cases.€€òòSwafford€v.€Stateóó,€529€S.W.2d€748,€749Ï(Tenn.€Crim.€App.€1975);€òòseeóó€òòalsoóó€òòUnited€States€v.€Rossbachóó,€701€F.2d€713€(8thÏCir.€1983)€(holding€leading€questions€were€permissible€on€direct€examination€ofÏfifteen€and€seventeen€year€old€victims€hesitant€to€testify€about€sexual€assault).€ÏThe€trial€court's€exercise€of€its€broad€discretion€in€permitting€leading€questionsÏwill€not€be€reversed€absent€a€showing€of€abuse€of€discretion.€€òòSeeóó€òòState€v.ÏLewisóó,€No.€€01C01„9307„CC„00232€(Tenn.€Crim.€App.€Jan.€12,€1995)€(holdingÏalthough€all€questions€were€leading€and€most€answers€comprised€of€only€oneÏor€two€words,€no€abuse€of€discretion).ÌÌà àThe€record€clearly€demonstrates€that€eliciting€the€victim's€testimony€wasÏparticularly€difficult.€€The€difficulty€may€be€attributed€to€her€age,€the€fact€that€herÏown€mother€refused€to€believe€her,€and€the€nature€of€her€testimony.€ÏAccordingly,€we€find€no€abuse€of€discretion.ÌÌÓ  Óò òIIIó óÓ  ÓÌà àThe€appellant's€third€issue€asserts€that€his€due€process€rights€wereÏviolated€by€introduction€of€evidence€that€his€father€was€a€homosexual.€€On€directÏexamination,€however,€appellant's€own€trial€counsel€"opened€the€door"€byÏasking€the€appellant€whether€his€father€was€a€homosexual.€€The€appellantÏresponded€"no."€€On€cross„examination,€the€state€attempted€to€impeach€theÏappellant's€veracity€by€challenging€this€denial.€€The€appellant€did€not€raise€aÏproper€contemporaneous€objection€to€the€state's€cross„examination.€€Relief€willÏnot€be€accorded€to€a€party€either€responsible€for€the€error€or€who€has€failed€toÏtake€whatever€action€reasonably€available€to€nullify€the€harmful€effect€of€anÏerror.€€Tenn.€R.€App.€P.,€Rule€36(a).€€This€issue€is€without€merit.ÌÌÌÌÌÓ àThe€defendant€is€convicted€of€two€(2)€or€more€statutory€offensesÏinvolving€sexual€abuse€of€a€minor€with€consideration€of€theÏaggravating€circumstances€arising€from€the€relationship€betweenÏthe€defendant€and€victim€or€victims,€the€time€span€of€theÏdefendant's€undetected€sexual€activity,€the€nature€and€scope€ofÏthe€sexual€acts€and€the€extent€of€the€residual,€physical€and€mentalÏdamage€to€the€victim€or€victims.ÌÌÓÓÌTenn.€Code€Ann.€ðð€40„35„115(b)(5)€(1990).ÌÌà àThe€appellant€began€sexually€abusing€his€stepdaughter€when€she€wasÏsix€years€old.€€He€then€continued€to€sexually€abuse€her€over€a€significant€periodÏof€time.€€His€conduct€ranged€from€having€her€masturbate€him€to€a€climax€toÏvaginal€and€anal€intercourse.€€When€she€cried€out,€he€would€slap€her€in€the€faceÏand€instruct€her€to€"shut€up."€€There€was€also€evidence€that€the€victim€hadÏsuffered€emotional€damage.€€She€was€extremely€introverted€and€unsocial€withÏother€children.€€She€seldom€looked€anyone€in€the€face€and€whenÏcomplimented,€she€stated€"I'm€ugly."€€Accordingly,€we€find€that€consecutiveÏsentencing€was€appropriate.×
