Ðlaw€in€a€building€which€he€owned€and€in€which€he€rented€space€to€Richard€Taylor,€currentlyÏan€Assistant€Public€Defender€in€the€23rd€Judicial€District.€€Approximately€one€week€beforeÏtrial,€which€was€set€for€February€11,€1997,€Gregory€sought€the€assistance€of€Taylor.€€TaylorÏreviewed€petitionerððs€file€as€requested€by€Gregory€and€prepared€a€handwrittenÐ @506 Ðmemorandum€outlining€prior€convictions€for€possible€enhancement€purposes;€laboratoryÏreports€on€the€drugs€found€in€petitionerððs€van;€and€possible€sentencing€ranges€for€each€ofÏthe€counts€against€petitioner.€€Gregory€received€this€memo€from€Taylor€five€or€six€days€priorÏto€the€trial€date.€€In€the€memo,€Taylor€incorrectly€identified€Count€II,€possession€with€intentÏto€sell€742.4€grams€of€cocaine,€as€a€Class€B€felony€when€it€was€in€fact€a€Class€A€felony.€ÏFor€a€Range€III€offender,€this€meant€a€possible€sentence€of€forty€to€sixty€years€rather€thanÏtwenty€to€thirty€years.€€Taylor€did€not€recall€what€was€the€source€of€his€information.€€Also,ÏCount€VI€was€listed€in€Taylorððs€memo€as€a€Class€B€felony,€and€that€count€was€actually€aÏClass€C€felony€with€a€punishment€of€ten€to€fifteen€years,€not€twenty€to€thirty.€€In€summingÏup,€Taylor€listed€the€following€on€his€memo€to€Gregory:ÌÓÓà àPrior€to€the€trial€date€of€February€11,€1997,€Donald€Gregory€met€with€AssistantÏDistrict€Attorney€General€John€Zimmermann€to€discuss€settlement.€€These€settlementÏnegotiations€were€held€twice€in€October€and€twice€in€December€of€1996.€€ZimmermanÏtestified€at€the€post„conviction€relief€hearing€that€in€his€discussions€with€Gregory€he€wentÏthrough€petitionerððs€criminal€record,€including€a€conviction€for€voluntary€manslaughter,Ïcircling€the€convictions€showing€that€petitioner€was€a€Range€III€offender.€€Zimmerman€alsoÏtestified€that€he€discussed€the€fact€that€the€punishment€on€the€cocaine€charge€alone€wasÏforty€to€sixty€years€for€a€Range€III€offender.€€ÌÌà ` àIn€October€of€1996,€the€State€offered€petitioner€a€forty„year€sentence€as€a€RangeÏI€offender.€€This€settlement€offer€was€rejected.€€Petitioner€claimed€that€he€rejected€the€offerÏbecause€Gregory€had€told€him€that€the€charges€against€him€carried€a€total€possibleÏsentence€of€only€fifty€years.€€Petitioner€decided€that€the€offer€was€not€good€enough€and€thatÏhe€would€rather€just€plead€guilty€and€let€the€judge€decide€the€sentence.€€The€State€madeÏa€second€offer€to€settle€on€December€5,€1996€at€forty€years€as€a€Range€III€offender.€€ThisÏwas€still€the€settlement€offer€at€a€final€discussion€on€December€19,€1996.€€At€that€time,ÏGregory€told€Zimmerman€that€his€client€did€not€want€to€take€the€offer€and€that€the€matterÐ Ì84: Ðshould€be€set€for€trial.€€Trial€date€was€set€for€January€6,€1997.€€Because€Gregory€wasÏinjured€when€he€fell€at€his€office€building,€the€trial€was€postponed€until€February€11,€1997.ÌÌà ` àOn€the€morning€of€the€trial,€with€the€State€fully€prepared€to€go€forward,€GregoryÏadvised€€Zimmerman€that€petitioner€was€going€to€plead€guilty.€€Taylor,€who€was€present€atÏthe€trial€to€assist€Gregory,€apparently€prepared€the€petition€to€enter€a€plea€of€guilty,Ïalthough€he€testified€that€he€could€not€recall€whether€he€signed€this€petition.€€This€was€toÏbe€an€open€plea€with€no€agreements€between€the€State€and€petitioner€as€to€any€of€theÏcharges.€€Zimmerman€signed€this€petition.€€The€petition€prepared€by€Taylor€perpetuatedÏthe€error€he€had€made€earlier€in€his€memo€to€Gregory€and€listed€Count€II€as€a€Class€BÏfelony€rather€than€a€Class€A€felony€and€listed€Count€VI€as€a€Class€B€felony€rather€than€aÏClass€C€felony.€€These€errors€were€discovered€during€plea€colloquy.€The€fact€that€CountÏVI€should€have€been€a€Class€C€felony€was€discovered€first€and€corrected.€€The€error€as€toÏCount€II€was€discovered€during€the€courtððs€explanation€of€the€effect€that€petitionerððs€priorÏsentences€would€have€on€the€length€of€his€sentence€under€Count€II.€€When€petitioner€wasÏinformed€by€the€court€that€the€correct€sentence€range€for€a€Class€A€felony€as€a€Range€IIIÏoffender€was€forty€to€sixty€years€rather€than€twenty€to€thirty,€he€told€the€court€that€heÏwanted€to€change€his€plea.€The€court€told€petitioner,€ð Ðsince€he€started€attending€McKinneyððs€church€some€six€months€earlier,€testified€as€aÏcharacter€witness€for€the€defendant.€€Jerry€McCoo,€one€of€the€Sunday€School€teachers€atÏthe€church,€also€testified€for€the€defendant.€€Both€men€testified€as€to€petitionerððs€efforts€toÏturn€his€life€around.ÌÌà ` àThe€petitioner€was€represented€by€new€counsel,€Richard€McGee,€at€the€post„¼conviction€hearing.€€Donald€Gregory€had€died€some€seven€months€earlier.€€Both€Taylor€andÏLewis€Burnett,€an€attorney€whose€office€was€also€in€the€building€owned€by€Gregory,Ð àÔ€DX`·XXCX`·ÔFollowing€the€hearing€in€this€matter,€the€trial€court€entered€a€comprehensive€writtenÐ @ Ðopinion€on€July€14,€1998€in€which€the€court€made€a€number€of€findings.€The€court€notedÏthat€the€petitioner€had€ð ðnine€(9)€prior€felony€convictions€(all€by€way€of€guilty€pleas)ðð€and€thatÏhe€had€given€ð ðfull€confessions€to€Metro€law€enforcement€officers€as€well€as€ATF€officials.ððÏAdditionally,€the€court€found€that€there€was€ð ðno€proof€to€show€that,€but€for€Mr.€GregoryððsÏrepresentation,€there€would€have€been€any€more€favorable€outcome€for€the€petitioner.ðð€ÏThe€opinion€of€the€trial€court€also€includes€the€following:ÌÓÓà8 (#àI€had€discussed€with€Mr.€Gregory,€and,€again,€as€Your€HonorÏpointed€out,€I€donððt€know€what€„„€what€was€communicated€toÏthe€defendant.€€But,€I€discussed€with€him€in€October€„„€that€„„Ïuh€„„€just€the€punishment€alone€on€the€Cocaine€charges,€fortyÏto€sixty€years,€[be]cause€his€client€was€Range€Three.€€We€wentÏthrough€the€record€and€I€circled€the€convictions€showing€thatÏhe€was€a€Range€Three.€.€.€.€€We€had€an€open€file€discovery€inÏthis€case.€€I€had€attached€several€police€reports€to€theÏdiscovery€response.€€Uh€„„€basically,€I€felt€the€case€was€strongÏenough€that€my€attitude€towards€Mr.€Gregory€was€to€tell€him€asÏmuch€as€we€could€about€the€case,€and€that€would€affect€aÏsettlement.Ð
