CharlesA.Norris( petitioner)appealsfromanorderenteredintheCriminalCourtforHickmanCountydenyinghispetitionforawritofhabeascorpus.Onappeal,petitionerpresentsoneissueforreview:whetherthetrialcourterredindismissinghispetitionforwritofhabeascorpus.Wefindnoerrorandaffirm. OnMay21,1983,petitionerwasconvictedoffirstdegreemurderandarmedrobberyintheCriminalCourtforDavidsonCounty.Hewassentencedtoconcurrentsentencesoflifeandsixty(60)years,respectively.Petitionersconvictionwasaffirmedbythiscourtandthesupremecourtdeniedpermissiontoappeal.Statev.Norris,684S.W.2d650(Tenn.Crim.App.1984). Subsequently,petitionerfiledapetitionforpostconvictionreliefallegingineffectiveassistanceofcounsel.Thetrialcourtdismissedthepetition.Onappeal,thiscourtaffirmedthetrialcourtandthesupremecourtdeniedpermissiontoappeal.Norrisv.State,No.01C019002CR00029,1990WL160956(Tenn.Crim.App.Oct.25,1990). ThepetitioninthecaseunderconsiderationwasfiledonJanuary21,1995intheCriminalCourtofHickmanCounty.Thesolegroundforreliefsoughtdealtwiththejuryinstructioninhis1983trialwherein reasonabledoubtwasdefinedtoincludetheterm moralcertainty.Specifically,thejuryinstructioncomplainedofreadsasfollows:8 Reasonabledoubtisthatdoubtengenderedbyaninvestigationofalltheproofinthecaseandaninability,aftersuchinvestigation,toletthemindresteasilyastothecertaintyofguilt.Reasonabledoubtdoesnotmeanacaptious,possible,orimaginarydoubt.Absolutecertaintyofguiltisnotdemandedbythelawtoconvictofanycriminalcharge,butmoralcertaintyisrequiredastoeverypropositionofproofrequisitetoconstitutetheoffense.PetitionercontendsthatbasedupontheauthorityofCagev.Louisiana,498U.S.39,4041(1990),theuseoftheterm moralcertaintysuggestsahigherdegreeofdoubtisrequiredforacquittalthanthedegreeinthe beyondareasonabledoubtstandardassetoutinInreWinship,397U.S.358,361(1970).ԀPetitionerconcludesthattheerroneousjuryinstructionsetforthaboveviolateshisrighttodueprocessandrenderedhis1983convictionandsentencevoid. Indismissingthepetition,thetrialcourtfoundthattheinstructionsgiveninpetitionerscase,whileusingthewords moralcertainty,sufficientlydescribedthedegreeofdoubtnecessaryforacquittalanddidnotviolatetheconclusionreachedinCage.ThetrialcourtalsoheldthatpetitionersargumentbasedonCagehadbeenrejectedbyoursupremecourtintheconsiderationofavirtuallyidenticaljuryinstructioninStatev.Nichols,877S.W.2d722,734(Tenn.1994).Onceagainpetitionercontendsthattheallegedlyerroneousjuryinstructionrendershisconvictionvoid. Inthisstatetheremedyofhabeascorpusislimitedinitsnatureandscope.See,e.g.,Luttrellv.State,644S.W.2d408,409(Tenn.Crim.App.1982).ThiscourtinLuttrellheldthatthescopeofreviewbyhabeascorpusisnarrowerthanfederalhabeascorpusproceedings.TheavailabilityofhabeascorpusreliefwasspelledoutclearlyinArcherv.State,851S.W.2d157(Tenn.1993):8 HabeascorpusreliefisavailableinTennesseeonlywhenitappearsonthefaceofthejudgmentortherecordoftheproceedingsuponwhichthejudgmentisrenderedthataconvictingcourtwaswithoutjurisdictionorauthoritytosentenceadefendant,orthatadefendantssentenceofimprisonmentorotherresainthasexpired.Id.at164.Habeascorpusreliefisonlyavailableforvoidjudgments,notmerelyvoidableones.Pottsv.State,833S.W.2d60,62(Tenn.1992). Petitionercontendsthatthewritofhabeascorpusistheproperbasisforseekingreliefbecausethejuryinstructionhecomplainsofdefiningreasonabledoubtrenderedhisconvictionandsentencevoid.However,thecomplaintmadebythepetitionerisnotonethatwouldrenderthetrialcourtjudgmentvoid,but,rather,voidable.InThorntonv.Raney,No.02C019302CC00025,1994WL25827(Tenn.Crim.App.Jan.26,1994),thiscourtheldthaterroneousjuryinstructionsdonotmeetanyoftherequirementsforhabeascorpusrelief,id.at*1,andthatthepropermethodforcollaterallyattackingthejudgmentforconstitutionaldeprivationsisbyapetitionforpostconvictionrelief.Id. ` pX)0*X  Becausepetitionersoughtreliefinappropriatelyintheformofapetitionforawritofhabeascorpus,thetrialcourtatitsdiscretioncouldhavetreatedthepetitionasoneforpostconvictionrelief.T.C.A.4030108(1990). (   ׀Thetrialcouldnothave,however,exercisedthisdiscretioninasmuchasT.C.A.4030103(a)requiresthatapetitionforpostconvictionreliefbebroughtinthecountyofconviction,whichinthiscasewasDavidsonCounty,notHickmanCounty.Inaddition,asthepetitionforwritofhabeascorpusԀwasfiledwellbeyondthethreeyearstatuteoflimitationsasprovidedinT.C.A.4030102,thetrialcourtwasbarredfromconsideringitasapetitionforpostconvictionrelief.SeeVossv.Raney,No.02C01950100022,1995WL454034,at*2(Tenn.Crim.App.Aug.2,1995).
