àOn€November€2,€1987,€the€victim,€12€years€old,Ïreturned€home€from€school€with€her€younger€sister.€ÏBecause€their€mother€was€not€there,€they€went€to€aÏneighborððs€house.€€When€the€victim€realized€that€sheÏhad€mistakenly€picked€up€a€brotherððs€book€instead€ofÏher€own,€she€returned€to€her€residence€to€exchange€theÏbooks.€€On€the€way€out€of€the€house,€she€saw€theÏdefendant,€a€first€cousin,€sitting€on€the€couch€beside€theÏfront€door.€€He€was€not€there€when€she€came€in.Ð ¸ x¸ x ÐÌà8 ¸ àà  àBefore€the€victim€could€leave,€the€defendantÏgrabbed€her,€ripped€her€shirt€off,€removed€her€pants,Ïand€forcibly€raped€her.€€When€the€victim€struggled€theÏdefendant€struck€her€in€the€face,€knocked€off€herÏglasses,€and€then€stepped€on€them.€€He€threatened€toÏharm€the€victim€if€she€told€of€the€encounter.Ð ¸ x¸ x ÐÌà8 ¸ àà  àAfter€the€assault,€the€victim€burned€her€rippedÏshirt€and€placed€her€other€clothes€in€a€bag€her€motherÏintended€to€give€away.€€She€put€on€clean€clothes,€gotÏher€book,€and€returned€to€her€neighborððs€house,€crying.€ÏThe€victim€explained€that€she€was€sick,€lay€down,€andÏcontinued€to€cry.Ð ¸ x¸ x ÐÌà8 ¸ àà  àThe€incident€was€reported€to€the€sheriffððsÏdepartment€a€few€days€later€but,€because€of€a€shortageÏof€investigators,€was€not€investigated€until€January€ofÏ1988.€€When€confronted€by€officers,€the€defendantÏadmitted€visiting€the€victimððs€home€around€the€time€ofÏthe€rape,€but€denied€assaulting€the€victim.Њ8‚17¸ x¸ x Їà8 ¸ àà  àAt€trial,€the€defendant€denied€that€he€raped€theÏvictim€and€claimed€to€have€been€visiting€his€sister€inÏNorth€Carolina€for€about€two€months€during€that€periodÏof€time.€€He€could€not€remember,€however,€the€town€inÏwhich€his€sister€lived.€€The€defendant€suggested€that€heÏwas€being€prosecuted€because€the€victimððs€parents€didÏnot€like€him.Ð ¸ x¸ x ÐÌÓÓÓ  ÓòòState€v.€William€Necessary,€Jr.óó,€No.€266,€Washington€County,€slip€op.€at€1„2€(Tenn.Ð 80 ÐCrim.€App.€Mar.€4,€1991).ÌÌà ¸ àAt€the€evidentiary€hearing€on€the€petition€for€post„conviction€relief,€theÏpetitionerððs€trial€attorney€testified€that€he€had€practiced€criminal€law€for€eighteen€yearsÏand€was€retained€to€represent€the€petitioner.€€He€said€that€he€replaced€an€attorney€theÏpetitioner€already€had€and€that€he€talked€with€the€petitionerððs€first€attorney€severalÏtimes.€€He€said€the€first€attorney€had€filed€a€Motion€for€Discovery€pursuant€to€Rule€16,ÏTenn.€R.€Crim.€P.€€He€said€he€intended€to€proceed€with€the€motion,€but€the€state€and€itsÏwitnesses€were€very€cooperative,€and€he€did€not€think€it€was€necessary€to€pursue€theÏmotion.€€He€said€the€state€had€an€open€file€policy,€and€he€looked€through€everything€inÏthe€file,€including€the€victimððs€statement.ÌÌà ¸ àThe€attorney€stated€that€the€petitionerððs€sister€sometimes€accompaniedÏthe€petitioner€when€they€met.€€He€strongly€denied€the€petitionerððs€contention€that€theyÏmet€only€three€times.€€He€said€he€probably€kept€time€sheets€for€the€case,€but€he€did€notÏhave€them€because€he€periodically€deletes€files€that€are€not€critical€in€order€to€saveÏspace.€€He€agreed€that€it€was€important€to€preserve€files€in€the€event€of€a€post„¼conviction€petition.ÌÌà àThe€attorney€testified€that€he€spoke€with€Dr.€Donald€Hires,€who€heÏbelieved€performed€a€mental€evaluation€on€the€victim,€and€that€the€doctor€told€him€heÏbelieved€the€victimððs€allegation.€€The€attorney€admitted€that€before€trial,€he€heard€thatÏthe€victimððs€mother€claimed€the€victim€told€her€that€the€petitioner€did€not€rape€her.€€HeÐ Œ7„06 ÐÑ í:ÑÑÜÜÑÑÑÑ  ÑñŽ ñÑ í:ÑÑÜÜÑÑÑÑ  ÑñŽ ñsaid€he€followed€up€on€the€allegation,€but€the€victimððs€mother€denied€that€the€victim€hadÏrecanted.€€He€said€he€tried€to€talk€to€the€victim,€but€she€would€not€cooperate€and€herÏparents€would€not€allow€it.€€He€said€he€did€not€remember€speaking€with€the€victimððsÏsister,€Kristy€Necessary,€but€he€thought€her€parents€may€have€refused€to€allow€him€toÏtalk€to€her.€€He€said€he€never€heard€before€trial€that€Kristy€Necessary€said€that€theÏvictim€had€recanted.€€The€attorney€admitted€that€the€stateððs€only€evidence€was€theÏvictimððs€testimony€and€that€the€case€hinged€on€her€credibility,€but€he€said€that€he€did€notÏrequest€any€further€evaluation€of€the€victim€to€explore€whether€she€had€been€pressuredÏby€her€family€into€accusing€the€petitioner.ÌÌà ¸ àThe€attorney€testified€that€he€may€have€asked€the€judge€for€the€jury€list€onÏthe€day€of€trial,€but€he€testified€that€he€had€seen€the€list€a€few€days€earlier€and€had€goneÏover€it€with€the€petitioner.€€He€said€he€spoke€with€many€family€members€and€withÏDepartment€of€Human€Services€workers,€but€they€were€not€very€cooperative.€ñŽ ñœñŽ ññŽ ñ›ñŽ ññŽ ññŽ ñ€HeÏagreed€that€the€issue€of€the€admissibility€of€alleged€sexual€contact€between€the€victimÏand€her€father€may€not€have€been€raised€until€after€trial.€€He€admitted€that€he€did€notÏtalk€to€the€doctor€that€physically€examined€the€victim,€but€he€said€that€months€hadÏpassed€from€the€time€the€rape€occurred€until€the€examination.€€He€also€said€that€theÏpetitioner€told€him€that€the€victim€was€having€sex€with€her€father€and€brother,€and€theÏattorney€felt€that€a€physical€examination€would€not€have€revealed€anything€helpful.ÌÌà ¸ àThe€attorney€testified€that€he€talked€with€the€district€attorney€about€aÏpossible€plea€agreement,€but€he€did€not€remember€if€a€plea€agreement€had€beenÏoffered.€€He€said€he€definitely€asked€the€district€attorney€for€a€plea€agreement,€but€ifÏone€had€been€offered,€the€petitioner€would€have€rejected€it.€€He€said€he€did€not€knowÏwhy€he€did€not€seek€to€introduce€evidence€of€the€petitionerððs€lack€of€criminal€history.€€HeÏâ âsaid€he€did€not€call€character€witnesses€on€behalf€of€the€petitioner€because€no€one€theÐ À5¸.4 Ðpetitioner€knew€was€reputable,€and€everybody€in€his€family€had€problems€ñŽ ñœñŽ ñwithñŽ ñ›ñŽ ñÏincestuous€relationships.Ìâ âÌà ¸ àOn€cross„examination,€the€attorney€stated€that€the€petitioner€accompaniedÏhim€on€at€least€four€occasions€to€investigate€the€case.€€He€said€he€discussed€theÏpossibility€of€a€psychological€evaluation€with€the€petitioner,€but€the€petitioner€definitelyÏdid€not€want€one.€€He€said€the€petitioner€insisted€that€he€did€not€rape€the€victim,€and€theÏattorney€felt€that€the€only€possible€defense€was€that€the€victim€had€sex€with€other€familyÏmembers.€€ÌÌà ¸ àBetty€Hill,€the€petitionerððs€sister,€testified€that€she€accompanied€theÏpetitioner€to€all€of€the€meetings€with€his€attorney.€€She€said€the€petitioner€had€alwaysÏbeen€in€special€education€classes€and€could€not€read€or€write.€€She€said€sheÏaccompanied€him€to€his€attorneyððs€office€in€order€to€help€him€understand.€€She€said€sheÏand€the€petitioner€met€with€the€attorney€three€times€at€the€most.€€She€said€they€went€toÏthe€attorneyððs€office€for€appointments,€and€several€times€the€attorney€was€not€there.€ÏShe€said€the€attorney€never€requested€a€psychological€evaluation€for€the€petitioner.€ÏShe€said€the€attorney€told€the€petitioner€that€the€state€had€offered€a€plea€bargain€butÏthat€he€should€not€take€it.€€She€said€neither€she€nor€the€petitioner€received€a€list€of€theÏjury€before€trial.€€She€said€she€told€the€attorney€that€the€victim€had€sex€with€otherÏñŽ ñœñŽ ñpeople.ñŽ ñ›ñŽ ñ€€She€said€the€attorney€was€supposed€to€have€gotten€the€victimððs€juvenileÏrecords€and€gone€to€the€victimððs€school,€but€she€did€not€know€if€he€had.€€She€said€theÏattorney€told€the€petitioner€not€to€worry€and€that€if€the€petitioner€received€any€time€at€all,Ïit€would€not€be€much.ÌÌà ¸ àLori€Ellis€testified€that€she€is€the€petitionerððs€cousin€but€that€she€is€notÏrelated€to€the€victim.€€She€testified€that€she€thought€the€matter€was€between€the€victimÏand€the€petitioner€and€that€no€one€else€should€be€involved.€€She€testified€that€in€lateÐ Œ7„06 Ð1987€or€early€1988,€she€rode€with€the€victim€and€the€victimððs€family€to€Johnson€CityÏwhere€the€victim€was€to€be€evaluated€by€a€doctor€and€a€social€worker€regarding€theÏevents€of€this€case.€€She€said€that€when€they€stopped€for€gas€and€the€victimððs€father€leftÏthe€car,€the€victim€leaned€over€and€told€her€mother€that€the€petitioner€did€not€mess€withÏher€and€that€someone€else€did.€€She€testified€that€the€victim€said€she€was€afraid€andÏthought€she€should€blame€it€on€the€petitioner€because€he€was€at€her€house€more€thanÏanyone€else.€€Ms.€Ellis€testified€that€the€victimððs€mother€told€her€not€to€say€anything€elseÏand€that€the€victimððs€sister€said€the€victim€was€not€supposed€to€be€talking€about€that.€ÏMs.€Ellis€stated€that€after€the€victim€was€examined€in€Johnson€City,€a€ñŽ ñœñŽ ñdoctorñŽ ñ›ñŽ ññŽ ññŽ ñ€told€theÏvictimððs€mother€that€the€victim€said€no€one€had€messed€with€her.ÌÌà ¸ àOn€cross„examination,€Ms.€Ellis€stated€that€she€did€not€report€what€theÏvictim€said€to€anyone€because€it€was€none€of€her€business.€€She€then€stated€that€sheÏtold€the€petitionerððs€attorney€about€the€victimððs€statements€before€trial.ÌÌà ¸ àBobby€Walker€testified€that€he€was€the€victimððs€ex„husband.€€The€trialÏcourt€did€not€permit€Mr.€Walker€to€testify€regarding€statements€made€to€him€by€theÏvictim€on€the€ground€that€the€statements€were€hearsay.€€However,€Mr.€Walkerððs€affidavitÏwas€admitted€as€an€offer€of€ñŽ ñœñŽ ñproof.€€In€theñŽ ñ›ñŽ ññŽ ññŽ ñ€ñŽ ñœñŽ ñaffidavit,ñŽ ñ›ñŽ ññŽ ññŽ ñ€Mr.€Walker€stated€that€the€victim€toldÏñŽ ñœñŽ ñhim€onñŽ ñ›ñŽ ññŽ ññŽ ñ€more€than€ñŽ ñœñŽ ñone€occasionñŽ ñ›ñŽ ññŽ ññŽ ñ€that€her€father€had€sex€with€her€before€she€became€aÏteenager€and€ñŽ ñœñŽ ñthatñŽ ñ›ñŽ ññŽ ññŽ ñ€ñŽ ñœñŽ ñonce,ñŽ ñ›ñŽ ññŽ ññŽ ñ€he€forced€her€to€have€sex€at€knife€point.€€Mr.€Walker€alsoÏstated€in€the€affidavit€that€the€victim€said€that€she€was€going€to€sign€papers€to€get€theÏpetitioner€released€from€jail.€€ÌÌà ¸ àKristy€Necessary,€the€victimððs€sister,€testified€that€she€did€not€know€if€herÏfather€molested€the€victim.€€She€said€the€victim€went€back€and€forth€on€the€issue.€€HerÏaffidavit€was€admitted€into€evidence.€€In€the€affidavit,€Ms.€Necessary€said€that€theÏvictimððs€boyfriend,€Jody€Simpson,€told€her€that€the€victim€said€that€her€father€hadÐ àThe€petitioner€testified€that€he€had€no€prior€criminal€history€and€that€heÏhad€an€eighth€grade€education.€€He€said€he€only€spoke€with€his€attorney€once€withoutÏhis€sister.€€He€said€that€he€and€his€attorney€went€to€the€house€where€the€victim€and€herÏbrother€ð ðused€to€mess€around.ðð€€He€said€he€talked€with€his€attorney€about€eight€or€nineÏtimes.€€He€said€his€attorney€never€gave€him€a€jury€list€nor€told€him€about€a€plea€bargain,Ïalthough€he€said€the€attorney€might€have€told€someone€else€about€a€plea€bargain.ÌÌà àOn€cross„examination,€the€petitioner€stated€that€the€jury€never€got€to€hearÏthe€witnesses€his€attorney€was€trying€to€get€them€to€hear.€€He€said€he€made€two€tripsÏwith€his€attorney€to€investigate€the€case.ÌÌà ¸ àThe€victim€testified€that€her€family€harassed€and€threatened€her€becauseÏof€the€rape.€€She€said€she€never€told€anyone€that€the€petitioner€did€not€rape€her.ÌÌà ¸ àOn€cross„examination,€the€victim€testified€that€she€still€dated€BobbyÏWalker.€€She€denied€telling€Mr.€Walker€that€she€and€her€father€had€sex€when€she€was€aÏteenager.€€She€said€she€did€not€tell€Mr.€Walker€that€she€wanted€to€sign€papers€to€getÏthe€petitioner€out€of€jail,€and€she€said€she€did€not€know€why€he€would€lie€about€it.€€SheÏdenied€telling€her€mother,€in€front€of€Lori€Ellis,€that€the€petitioner€did€not€mess€with€her.€ÏShe€said€she€did€not€know€why€Ms.€Ellis€would€lie.€€She€also€testified€that€she€never€toldÏher€sister€that€her€father€had€sex€with€her,€although€she€said€she€did€tell€her€sister€thatÏthe€petitioner€raped€her.€€She€said€she€never€recanted.€€She€said€she€did€not€rememberÏif€she€told€Jody€Simpson€that€her€father€had€sex€with€her.ÌÐ Œ7„06 Ðà ¸ àThe€trial€court€denied€the€petition€for€post„conviction€relief.€€It€found€thatÏthe€petitionerððs€trial€attorney€properly€represented€the€petitioner€at€trial.€€The€court€alsoÏfound€that€the€petitioner€did€not€introduce€any€evidence€that€was€not€known€orÏintroduced€at€trial€that€would€have€changed€the€result€of€the€trial.€ÌÌÓ  Óò òI.€€INEFFECTIVE€ASSISTANCE€OF€COUNSELó óÐ ü  ÐÓ  Óà ¸ àThe€petitioner€raises€several€issues€with€respect€to€his€attorneyððsÏperformance,€all€of€which€relate€to€his€attorneyððs€preparedness€for€trial.€€Specifically,€theÏpetitioner€argues€that€his€attorney€(1)€did€not€proceed€ñŽ ñœñŽ ñwith€theñŽ ñ›ñŽ ññŽ ññŽ ñ€discovery€motion,€(2)€didÏnot€talk€to€the€victim€or€her€sister€before€trial,€(3)€did€not€remember€speaking€to€DHSÏworkers,€(4)€did€not€make€an€offer€of€proof€regarding€the€victimððs€alleged€sexual€conductÏwith€her€father,€(5)€did€not€talk€to€the€doctor€who€performed€the€physical€examination€ofÏthe€victim,€(6)€did€not€remember€whether€the€state€offered€a€plea€agreement,€and€(7)Ïdid€not€have€a€jury€list€on€the€day€of€trial.€€The€state€contends€that€the€trial€courtÏproperly€concluded€that€the€defendant€received€the€effective€assistance€of€counsel.€€WeÏagree.ÌÌà ¸ àUnder€the€Sixth€Amendment,€when€a€claim€of€ineffective€assistance€ofÏcounsel€is€made,€the€burden€is€upon€the€petitioner€to€show€(1)€that€counsel'sÏperformance€was€deficient€and€(2)€that€the€deficiency€was€prejudicial€in€terms€ofÏrendering€a€reasonable€probability€that€the€result€of€the€trial€was€unreliable€or€theÏproceedings€fundamentally€unfair.€€òòStrickland€v.€Washingtonóó,€466€U.S.€668,€687,€104€S.Ð âdecided€that€attorneys€should€be€held€to€the€general€standard€of€whether€the€servicesÏrendered€were€within€the€range€of€competence€demanded€of€attorneys€in€criminalÏcases.€€Further,€the€court€stated€that€the€range€of€competence€was€to€be€measured€byÏthe€duties€and€criteria€set€forth€in€òòBeasley€v.€United€Statesóó,€491€F.2d€687,€696€(6th€Cir.Ð Ðin€reviewing€counsel's€conduct,€a€"fair€assessment€of€attorney€performance€requiresÏthat€every€effort€be€made€to€eliminate€the€distorting€effects€of€hindsight,€to€reconstructÏthe€circumstances€of€counsel's€challenged€conduct,€and€to€evaluate€the€conduct€fromÏcounsel's€perspective€at€the€time."€€òòStrickland€v.€Washingtonóó,€466€U.S.€at€689,€104€S.Ð àAlso,€we€note€that€the€approach€to€the€issue€of€the€ineffective€assistanceÏof€counsel€does€not€have€to€start€with€an€analysis€of€an€attorney's€conduct.€€If€prejudiceÏis€not€shown,€we€need€not€seek€to€determine€the€validity€of€the€allegations€aboutÏdeficient€performance.€€òòStrickland€v.€Washingtonóó,€466€U.S.€at€697,€104€S.€Ct.€at€2069.€€Ð ø*ð#( ÐÌà ¸ àIn€light€of€the€foregoing,€we€hold€that€the€trial€court€properly€concluded€thatÏthe€petitioner€received€the€effective€assistance€of€counsel.€€With€respect€to€theÏpetitionerððs€contention€that€his€attorney€failed€to€pursue€the€discovery€motion,€theÏattorney€testified€that€it€was€not€necessary€because€the€state€provided€him€with€accessÏto€everything€in€its€files.€€The€petitioner€has€not€demonstrated€that€his€attorneyððsÏconduct€was€below€the€normal€range€of€competence€or€that€he€was€prejudiced.€Ð Œ7„06 ÐÑ ½R ÑÑ7€jEXXdð XXdæ7ÑÑ  ÑÖ€ÿÿÖà ¸ àWith€respect€to€the€petitionerððs€contentions€that€his€attorney€did€not€talk€toÐ  Ðthe€victim,€her€sister,€or€DHS€workers€before€trial,€the€attorney€testified€that€he€tried€toÏtalk€to€both€the€victim€and€her€sister€but€that€they€would€not€talk€to€him.€€Furthermore,Ïhe€testified€that€he€spoke€with€DHS€workers€but€that€they€were€uncooperative.€€TheÏattorney€testified€that€he€did€read€the€victimððs€statement€before€trial.€€The€petitioner€hasÏnot€shown€what€more€his€attorney€could€have€done,€nor€has€he€shown€that€hisÏattorneyððs€conduct€prejudiced€him€at€trial.€€ÌÌà ¸ àThe€petitioner€also€complains€that€his€attorney€failed€to€make€an€offer€ofÏproof€regarding€the€victimððs€alleged€sexual€conduct€with€her€father.€€On€the€contrary,€theÏtrial€transcript€reveals€that€the€attorney€made€a€detailed€offer€of€proof.€€He€called€fiveÏwitnesses€to€testify€about€the€victimððs€alleged€sexual€conduct€with€both€her€father€andÏbrother€and€stated€that€it€was€an€affront€to€the€judicial€system€of€this€country€to€allow€theÏcase€to€be€tried€without€allowing€that€evidence€to€be€heard€by€the€jury.€€The€trial€courtÏruled€that€the€evidence€was€inadmissible.€€The€petitionerððs€contention€that€his€trialÏattorney€failed€to€make€an€offer€of€proof€is€simply€not€supported€by€the€record.ÌÌà ¸ àThe€petitioner€complains€that€his€trial€attorney€did€not€speak€with€theÏdoctor€who€performed€the€physical€examination€of€the€victim.€€However,€the€attorneyÏtestified€that€the€examination€did€not€occur€until€several€months€after€the€rape.€€HeÏfurther€testified€that€the€petitioner€told€him€that€the€victim€had€sexual€relations€with€herÏfather€and€brother.€€Thus,€short€of€discovering€that€the€victim€was€a€virgin,€the€attorneyÏdid€not€think€that€speaking€to€the€doctor€would€uncover€useful€information.€€TheÏpetitioner€has€failed€to€demonstrate€what€information€his€attorney€could€have€learnedÏfrom€speaking€with€the€doctor€or€how€this€information€would€have€helped€his€case.ÌÌà ¸ àFinally,€the€petitioner€claims€that€his€attorney€could€not€remember€whetherÏthe€state€offered€a€plea€agreement€and€ñŽ ñœñŽ ñthat€his€attorney€didñŽ ñ›ñŽ ññŽ ññŽ ñ€not€have€ñŽ ñœñŽ ña€juryñŽ ñ›ñŽ ññŽ ññŽ ñ€ñŽ ñœñŽ ñlistñ… ñ€of›€the›€juryñ… ñ.ñŽ ñ›ñŽ ññŽ ññŽ ñ€€TheÐ Œ7„06 Ðrecord€indicates€otherwise.€€At€the€evidentiary€hearing,€the€attorney€testified€that€heÏdefinitely€discussed€the€possibility€of€a€plea€agreement€with€the€district€attorney.€€TheÏattorneyððs€failure€to€remember€the€results€of€that€discussion€at€the€evidentiary€hearingÏdoes€not€render€his€performance€at€trial€ineffective.€€In€addition,€although€the€attorneyÏmay€not€have€had€the€jury€list€with€him€on€the€morning€of€trial,€he€testified€that€he€hadÏobtained€a€copy€of€the€jury€list€and€had€discussed€the€list€with€the€petitioner€before€trial.€ÏThe€evidence€does€not€preponderate€against€the€trial€courtððs€finding€that€the€petitionerÏreceived€effective€representation.€€òòState€v.€Burfordóó,€666€S.W.2d€473,€475€(Tenn.€Crim.Ð
