CONCURRINGOPINION     Iconcurintheresultreachedinthiscase;Iwriteseparatelyonlytoaddresstheparoleeligibilityjuryinstruction.InStatev.King,____S.W.2d____(Tenn.1998),oursupremecourtruledthatthechargeonparoleeligibilityandearlyreleasewasacceptablefortheprimaryreasonthatthejurywasprovidedtheinstructiononan"informationonly"basis.Thechargeinthisinstanceisdistinguishablebecausethejurywasdirectedto"weighandconsiderthemeaningofasentenceofimprisonment"andthenadvisedofreleaseeligibilityforeachoffense.Inmyopinion,whenthedutyofthejuryistodetermineonlywhetherthedefendantisguiltybeyondareasonabledoubt,aninstructionrequiringconsiderationofreleaseeligibilityviolatesdueprocess.AsJudgeJoeG.RileywroteinStatev.JasonM.Weiskopf,No.02C019611CR00381,slipop.at9(Tenn.Crim.App.,atJackson,Feb.4,1998),app.filedbystate,May6,1998,it"allowsconsiderationofextraneousinformation,notadducedasproof[attrial],thatinnowayrelatesto[the]determinationofguiltorinnocence."  Here,thejurywasinstructedto"weighandconsider"thattheearliestreleaseeligibilityforseconddegreemurderwas2.95years;forvoluntarymanslaughter,0.59years;forrecklesshomicide,0.39years;andforcriminallynegligenthomicide,0.2years.Iftheproofofpremeditationhadnotbeenoverwhelming,theerrorcouldnothavebeenclassifiedasharmlessbeyondareasonabledoubt.Yet,severalwitnessestestifiedtopriorthreatsthedefendanthadmadetothevictim.Theautopsyreportindicatedatremendousamountofforcewouldberequiredtocausethetypesofinjuriesthevictimsustained.Forensicevidencesuggestedtwoofthekniveshadbeenwashedafterthestabbing.Underthosecircumstances,Iwouldconcludethattheinstructiondidnotaffecttheverdict.      __________________________________      GaryR.Wade,Judge
