âhistory€of€misdemeanor€convictions,€including€ññœññassaultññ›œññ.€€He€has€a€lengthyññ›ññ€juvenileÏrecord.€€At€the€sentencing€hearing,€he€ññœññclaimed€thatññ›ññ€he€ññœññwas€unaware€thatññ›ññ€the€victimÏwas€under€thirteen€years€of€age€when€he€met€her.€€He€maintained€that€he€wasÏwilling€to€undergo€treatment€if€granted€an€alternative€sentence€and€that€he€ññœññbelievedÏheññ›ññ€could€obtain€employment€ññœññwith€his€former€employer.€€Heññ›ññ€stated€that€eight€monthsÏof€incarceration€had€taught€him€to€"think€more"€before€he€acted.€€The€defendantÏadmitted€that€he€lost€his€job€ññœññatññ›ññ€Piccadilly€because€he€had€become€involved€in€anÏargument€ññœññin€the€shopping€mall.€€In€consequence,€he€was€barredññ›ññ€from€ññœññthe€ññpremesisññññpremisesññ.€ÏHeññ›ññ€ññœññtestified€œññtññhat›€he€drank€fiveññ›ññ€or€six€beers€per€day€and€ññœññon€occasion€usedññ›ññ€ññœññmarijuana.ññ›ññÏññœññAlthoughññ›ññ€he€participated€briefly€in€a€substance€abuse€treatment€program€as€aÏjuvenile,€ññœññthe€defendant€hasññ›ññ€not€done€so€since€reaching€adulthood.€€ññœññHe€has€severalññ›ññÏprior€alcohol„related€convictions€and€ññœññacknowledged€havingññ›ññ€"a€tiny€bit"€of€aÏsubstance€abuse€problem.€€ÌÌà Œ àà ä àHenry€Bobletts€testified€that€he€was€with€the€defendant€and€the€ññœññvictimÏonññ›ññ€the€evening€of€the€offense.€€He€stated€that,€ññœññwhile€theññ›ññ€victim€ññœññclaimed€to€beÏeighteen€yearsññ›ññ€old,€she€appeared€to€be€ññœññas€much€as€twenty.ññ›ññ€ÌÌà Œ àà ä àThe€trial€court€ordered€a€risk€assessment€to€evaluate€the€defendant'sÏpropensity€to€reoffend.€€During€the€interview€with€Counseling€and€ConsultationÏServices,€Inc.,€the€defendant€admitted€to€having€exposed€his€genitals€to€a€strangerÏin€the€past.€€The€reporter€concluded€that€the€defendant's€risk€to€reoffend€was€withinÏthe€low€to€moderate€range.€€The€defendant€ññœññreceived€aññ›ññ€low€score€in€his€ability€toÏrecognize€his€problem€and€in€his€ability€to€understand€in€what€manner€he€hadÏharmed€the€victim.€€The€reporter€recommended€as€follows:ÌÓÓà8 Œ àà8ä Œ (#Œ (#à1.€€[The€defendant]€is€considered€to€be€a€low„moderatedÏrisk€to€re„offend.€€Without€sufficient€interventions€whichÐ þ8ž/5 (#à2.€€[The€defendant]€presently€is€a€fair€candidate€forÏtreatment€at€this€time.€€His€primary€sexually€offensiveÏbehavior€is€child€molestation[,]€which€Specialized€SexÏOffender€Treatment€has€demonstrated€success.€€HisÏother€sexual€offending€behaviors,€exposing€[himself],€isÏmore€difficult€to€treat.€€Ð àAccording€to€the€pre„sentence€report,€the€defendant,€who€completedÏthe€ninth€grade,€began€using€alcohol€at€the€age€of€ññœññfourteen.€€He€was€considered€anÏalcohol€abuser€at€the€time€of€his€incarceration.ññ›ññññññ€€ññœññHeññ›ññññññ€also€admitted€to€past€use€ofÏspeed€and€marijuana.€€ññœññTheññ›ññññññ€defendant€has€worked€for€two€to€six€months€at€a€time€inÏthe€food€service€industry.€€He€has€a€lengthy€adult€criminal€record,€includingÏmisdemeanor€convictions€for€public€intoxication,€driving€on€a€revoked€license,€drivingÏon€a€suspended€license,€theft€up€to€$500,€possession€and€distribution€of€intoxicatingÏliquors€by€a€person€under€twenty„one,€assault,€disorderly€conduct,€and€a€number€ofÏtraffic€offenses.€€As€a€juvenile,€the€defendant€ññœññappeared€in€juvenile€court€for€truancy,Ïlarceny,€breaking€and€entering,€destruction€of€public€property,€contempt€of€court,Ïtrespassing,€and€assault.€€His€criminal€history€as€both€a€juvenile€and€an€adultÏsuggests€an€unwillingness€to€adhere€to€the€terms€of€probation.€€In€1992,€the€juvenileÐ P7ð-1 Ðcourt€placed€him€in€a€mental€health€and€substance€abuse€treatment€program.€€AfterÏtwo€months€of€disruptive€behavior,€including€inhaling€gasoline,€threatening€the€staffÏand€other€residents€with€violence,€and€five€reported€sexual€encounters€with€residentÏfemales,€the€defendant€was€discharged€from€the€program.ÌÌà Œ àà ä àAt€the€conclusion€of€the€sentencing€hearing,€the€trial€court€concludedÏthat€the€defendant€was€a€low€to€moderate€risk€to€reoffend.€€While€determining€thatÏthe€defendant,€although€youthful,€had€a€"long€history€of€petty€offenses,"€the€trialÏcourt€also€noted€the€defendant's€poor€academic€performance,€his€history€of€alcoholÏabuse,€and€his€use€of€illegal€drugs.€€His€social€history€was€characterized€as€"notÏgood"€and€his€work€history€as€"sporadic."€€The€trial€court€ruled€that€the€defendant'sÏjuvenile€record,€described€as€"extremely€negative,"€indicated€his€inability€to€"actÏproperly."€€While€observing€that€the€victim's€mother€did€not€oppose€an€alternativeÏsentence,€the€trial€court€denied€probation€and€refused€to€consider€communityÏcorrections,€characterizing€the€offense€as€"violent."ÌÔ‡ x7.2 Ðà Œ àà ä àWhile€an€eight„year€sentence€does€not€disqualify€the€defendant€fromÏprobation,€he€Ô#†X~;XX Xež 7#Ôis€not€presumed€to€be€a€favorable€candidate€for€alternative€sentencingÐ , Ì Ðis€often€an€important€first€step€towards€a€rehabilitation.€€The€mental€healthÏevaluation€indicated€that€the€defendant€had€neither€taken€full€responsibility€for€hisÏactions€nor€could€he€comprehend€how€his€actions€had€affected€the€victim.€€InÏaddition,€the€defendant,€who€admitted€to€only€"a€tiny€bit"€of€a€substance€abuseÏproblem,€has€not€yet€acknowledged€the€full€extent€of€his€alcohol€abuse.€€While€heÏmaintained€that€he€had€not€known€the€actual€age€of€the€victim,€he€stipulatedÏotherwise€at€the€plea€submission€hearingÔ#†X~;XX
