TheDefendantallegesthathewasprovidedineffectiveassistanceofcounselforseveralreasons.HepledguiltytoonecountoftheftofaCadillacandsomejewelry.HehadapriorcriminalhistoryandtheDistrictAttorneyintendedtoprosecutehimasaRangeIIIpersistentoffender.Fortheoffenseinquestion,theapplicablesentencingrangeisfifteentotwentyyearsasaRangeIIIoffender.TheDefendantassertsthatcounselrecommendedhistakingapleaagreementasaRangeIIoffenderwithasentenceoftenyears.Heclaimsthatcounselinaccuratelyinformedhimthatthesentenceforthisoffensewouldrunconcurrentlywithaprevioussentence,andthathewouldnothaveenteredtheguiltypleahadheknownthatthesentenceswouldrunconsecutively. TheDefendantalsoarguesthatcounselfailedtotakeappropriatestepstopreparehiscasefortrial.Namely,hecontendsthatcounseldidnotinterviewhimbeforehisappearanceincourt.Healsocontendsthatcounselfailedtoobtaindiscovery,interviewtheStateswitnesses,obtainanallegedvideotapeofthecrime,orinvestigatethefactthattheDefendantwasundergoingpsychologicalcounseling.  Indeterminingwhethercounselprovidedeffectiveassistanceattrial,thecourtmustdecidewhethercounselsperformancewaswithintherangeofcompetencedemandedofattorneysincriminalcases.Baxterv.Rose,523S.W.2d930,936(Tenn.1975).Tosucceedonaclaimthathiscounselwasineffectiveattrial,apetitionerbearstheburdenofshowingthathiscounselmadeerrorssoseriousthathewasnotfunctioningascounselasguaranteedundertheSixthAmendmentandthatthedeficientrepresentationprejudicedthepetitionerresultinginafailuretoproduceareliableresult.Stricklandv.Washington,466U.S.668,687,rehgdenied,467U.S.1267(1984);Cooperv.State,849S.W.2d744,747(Tenn.1993);Butlerv.State,789S.W.2d898,899(Tenn.1990).Tosatisfythesecondprongthepetitionermustshowareasonableprobabilitythat,butforcounselsunreasonableerror,thefactfinderwouldhavehadreasonabledoubtregardingpetitionersguilt.Strickland,466U.S.at695.Thisreasonableprobabilitymustbe sufficienttoundermineconfidenceintheoutcome.Harrisv.State,875S.W.2d662,665(Tenn.1994). Whenreviewingtrialcounselsactions,thiscourtshouldnotusethebenefitofhindsighttosecondguesstrialstrategyandcriticizecounselstactics.Hellardv.State,629S.W.2d4,9(Tenn.1982).Counselsallegederrorsshouldbejudgedatthetimetheyweremadeinlightofallfactsandcircumstances.Strickland,466U.S.at690;seeCooper849S.W.2dat746. Thistwopartstandardofmeasuringineffectiveassistanceofcounselalsoappliestoclaimsarisingoutofthepleaprocess.Hillv.Lockhart,474U.S.52(1985).Theprejudicerequirementismodifiedsothatthepetitioner mustshowthatthereisareasonableprobabilitythat,butforcounselserrorshewouldnothavepleadedguiltyandwouldhaveinsistedongoingtotrial.Id.at59. TheDefendantfirstcontendsthatcounseldidnotinterviewhimbeforehiscourtappearance.CounseltestifiedatthepostconvictionhearingthathemetwiththeDefendantatleastonceandspokewithhimonthetelephoneseveraltimes.CounselnotedthatheinterviewedtheDefendantregardingthefactsofthecaseandpotentialdefenses,andhadrepresentedhimatthepreliminaryhearingandfoundthat [r]eally,therewasnodefenseinthiscase.Counseltestifiedthatwheninterviewed,theDefendantgavenosubstantialalternateversionofwhatoccurred,nordidheprovidewitnessesoradefense.CounselstestimonyiscorroboratedbythefactthatthetwoCodefendantsinthecasehadcooperatedwiththepoliceandhadagreedtotestifyagainsttheDefendant. TheDefendantalsoclaimsthatcounselfailedtointerviewtheStateswitnesses,obtainavideotapeofthecrime,orobtaindiscovery.CounseltestifiedthathedidinterviewoneCodefendantandanotherwitness.Defensecounselalsomadeaformaldiscoveryrequest.TheDefendantstatesthatcounseldidnotobtainavideotapeofthecrime,yetitsexistenceorcontentwasnotconfirmed. TheDefendantcontendsthatcounselfailedtoinvestigateamentalhealthevaluationthatdiagnosedhimasdepressedandthathehadborderlineintellectualfunctioning.CounseltestifiedthatthepsychologicalissuerelatedtotheDefendantswifeandpresentednothingthatwasrelevanttohiscaseintermsofadefense.Also,thereisnoevidenceintherecordthattheDefendantwasimpairedsuchthathewasunabletoknowinglyandvoluntarilyenteraplea. Finally,theDefendantassertsthathewaspressuredbycounseltoacceptthepleaagreementofferedbytheState.HearguesthatcounselfailedtoinvestigatewhetherhewasproperlyclassifiedasaRangeIIIoffender.However,counselhadrepresentedtheDefendantonothercriminalmattersandwasawareofhishistory.DefensecounselwasawarethattheStateintendedtoseekafifteentotwentyyearsentenceandhesuccessfullynegotiatedtheDefendantssentencetotenyears.TheDefendantclaimsthathewasnotawarethathissentencemightrunconsecutivelytohissentencetobeservedasaresultofhisprobationviolation.However,thepleaagreementformthattheDefendantsignedstatesspecificallythatthesentencewouldrunconcurrently unlessmandatorytorunconsecutively.TheDefendantwasonnoticethathewassubjecttoconsecutivesentences. ItisapparentthatcounselassessedtheDefendantscaseanddeterminedthattheproofagainsthimwassostrongthataguiltypleawasinhisbestinterest.Wenotethatwehavenotbeenprovidedwiththecompleterecordinthiscaseand,therefore,wearewithoutacompletepictureofthefacts.Weareunabletoconcludethatcounselfailed,onthefactspresentedinthisappeal,toprovidecompetentrepresentation.      TheburdenrestsontheDefendanttoprovehisallegationsbyapreponderanceoftheevidence.Longv.State,510S.W.2d83,86(Tenn.1982).TheDefendanthasnotshownthatcounselmadeerrorssoseriousthathewasnotfunctioningascounselasguaranteedbytheSixthAmendment.WeconcludethattheDefendanthasfailedtocarryhisburdenofshowingthateitherprongoftheStricklandtesthasbeenmet.Becausethetrialcourt'sfindingsoffactareaffordedtheweightofajuryverdict,thiscourtisboundbythosefindingsunlesstheevidencecontainedintherecordpreponderatesagainstthem.Blackv.State,794S.W.2d752,755(Tenn.Crim.App.1990).Here,theydonot.Thisissuehasnomerit.       ____________________________________     DAVIDH.WELLES,JUDGECONCUR:___________________________________̜GARYR.WADE,JUDGE___________________________________̜JERRYL.SMITH,JUDGE
