Afterareviewoftherecord,weremandtothetrialcourtforconsiderationofAppellantsfirstclaiminamannerconsistentwiththisopinion.   I.FACTUALBACKGROUND    Therecordrevealsthat,onJanuary22,1985,aMadisonCountyCircuitCourtjuryconvictedAppellantofthefirstdegreemurderandaggravatedrapeofSheilaCupples.Thetrialcourtimposedrespectivesentencesofdeathandlifeimprisonment.Ondirectappeal,theTennesseeSupremeCourtaffirmedboththeconvictionsandthesentences.SeeStatev.OGuinn,709S.W.2d561(Tenn.),cert.denied,479U.S.871(1986). Followingthedismissaloftwopostconvictionpetitions,AppellantfiledahabeascorpuspetitionintheUnitedStatesDistrictCourtfortheMiddleDistrictofTennessee. Heallegedthefollowinggroundsforrelief:   ` `  ` (1)admissionofhisconfessionviolatedhisFifthAmendmentrightagainstselfincrimination;(2)histrialcounselprovidedineffectiveassistance;(3)theevidencesupportinghisfirstdegreemurderconvictionwasinsufficient;(4)theStateelicitedperjuredtestimonyfromDiannaKing;(5)theStateemployedsurprisetestimonyregardingthevictimsvaginalwounds;(6)theStatewithheldexculpatoryevidence;and(7)theTennesseedeathpenaltyisunconstitutional.   `    Thedistrictcourtfoundonlythefirsttwogroundsmeritoriousandgrantedawrit.SeeOGuinnv.Dutton,870F.Supp.779(M.D.Tenn.1993).Onappeal,athreejudgepaneloftheSixthCircuitCourtofAppealsreversedthejudgmentofthedistrictcourtanddismissedthewrit.Onrehearing,theSixthCircuit,sittingenbanc,affirmedthedismissalofthewrit,therebyvacatingthejudgmentofthedistrictcourt.SeeOGuinnv.Dutton,88F.3d1409(6thCir.1996),cert.denied,117S.Ct.742(1997). OnApril18,1995,Appellantfiledathirdpostconvictionpetition.Thispetitionassertedtwoclaims.First,AppellantarguedthattheStatewithheldthefollowingexculpatoryevidence:(a)evidencethatJoanieCupples,thevictimscousin,wasinvolvedinthemurder;(b)evidencethatJoanieCupplesassociatesandmotherwereinvolvedinthemurder;(c)evidencethatformerJacksonPoliceOfficerRichardHarperwasinvolvedinthemurder;(d)evidencethatthevictimwaskilledbecausesheprovidedinformationtothepoliceregardingdrugtrafficking;and(e)evidencethatAppellantsbrotherwasfirstindictedforthemurderbaseduponeyewitnesstestimony.Second,Appellantarguedthattheevidencepresentedattrialwaslegallyinsufficienttosupportaconvictionforfirstdegreemurder.Thetrialcourtdismissedthepetitionwithoutahearing,findingthatthefirstclaimwaspreviouslydeterminedandthatthesecondclaimwaswaived.Appellantappealsfromthisdismissal.   II.POSTCONVICTIONRELIEF    Inchallengingthedismissalofhispetition,Appellantallegesthatthetrialcourterredbothinfindingthathisexculpatoryevidenceclaimwaspreviouslydeterminedandthathissufficiencyclaimwaswaived. Inpostconvictionproceedings,thedefendanthastheburdenofprovingtheclaimsraisedinthepetitionbyapreponderanceoftheevidence.Tidwellv.State,922S.W.2d497,500(Tenn.1996);Wadev.State,914S.W.2d97,101(Tenn.Crim.App.1995).Findingsoffactmadebythetrialcourtareconclusiveonappealunlesstheevidencepreponderatesagainstthejudgment.Cooperv.State,849S.W.2d744,746(Tenn.1993);Butlerv.State,789S.W.2d898,899(Tenn.1990).Thus,weareboundtoaffirmthejudgmentunlesstheevidenceintherecordpreponderatesagainstthetrialcourt'sfindings.Blackv.State,794S.W.2d752,755(Tenn.Crim.App.1990). AccordingthePostConvictionProcedureAct,thescopeofapostconvictionhearingextendstoallgroundsofthepetitioner,exceptforthosegroundswhichhavebeenpreviouslydeterminedorwaived.Tenn.CodeAnn.4030111.Agroundforreliefispreviouslydetermined ifacourtofcompetentjurisdictionhasruledonthemeritsafterafullandfairhearing.Id.4030112(a).Agroundforreliefiswaived ifthepetitionerknowinglyandunderstandinglyfailedtopresentitfordeterminationinanyproceedingbeforeacourtofcompetentjurisdictioninwhichthegroundcouldhavebeenpresented.Id.4030112(b)(1). Furthermore,apetitionermustseekreliefwithinthreeyearsofthedateofthefinalactionofthehigheststateappellatecourttowhichanappealhasbeentaken.Id.4030102.However,inBurfordv.State,845S.W.2d204(Tenn.1992),andSandsv.State,903S.W.2d297(Tenn.1995),theTennesseeSupremeCourtcreatedanexceptiontothisstatuteoflimitations,commentingasfollows:   ` `  ` [I]ncertaincircumstances,dueprocessprohibitsthestrictapplicationofthepostconvictionstatuteoflimitationstobarapetitionersclaimwhenthegroundsforrelief,whetherlegalorfactual,ariseafterthe finalactionofthehigheststateappellatecourttowhichappealistakenor,inotherwords,whenthegroundsariseafterthepointatwhichthelimitationsperiodwouldnormallyhavebeguntorun.   `    Sands,903S.W.2dat301.TheSupremeCourtthenestablishedthefollowingthreestepinquiryforanalyzingspecificfactualsituations.   ` `  ` (1)thecourtshoulddeterminewhenthelimitationsperiodwouldnormallyhavebeguntorun;(2)thecourtshoulddeterminewhetherthegroundforreliefaroseafterthelimitationsperiodwouldnormallyhavecommenced;and(3)ifthegroundforreliefislaterarising,thecourtshoulddeterminewhetherastrictapplicationofthelimitationsperiodwouldeffectivelydenythepetitionerareasonableopportunitytopresenthisclaimbyweighingthepetitionerslibertyinterestincollaterallyattackingaconstitutionalviolationagainsttheStatesinterestinpreventingthelitigationofstaleandfraudulentclaims.   `    Id.   A.EXCULPATORYEVIDENCE    Appellantfirstallegesthatthetrialcourterredinfindingthathisexculpatoryevidenceclaimwaspreviouslydetermined.Inmakingthisfinding,thetrialcourtrelieduponadistrictcourtjudgmentthatfoundtheclaimwithoutmerit.SeeOGuinnv.Dutton,870F.Supp.779(M.D.Tenn.1993).Onappeal,however,thedistrictcourtdecisionwasreversedandvacatedbytheSixthCircuit.SeeOGuinnv.Dutton,88F.3d1409(6thCir.1996),cert.denied,117S.Ct.742(1997).ByvirtueofthefactthattheSixthCircuitvacatedthedistrictcourtsdecisionandtheUnitedStatesSupremeCourtdeniedcertiorari,thetrialcourtsfindingthatAppellantsclaimwaspreviouslydeterminediserroneous.Therefore,astheStateconcedes,wemustremandtothetrialcourtforconsiderationofthisclaimonthemerits.   B.SUFFICIENCYOFTHEEVIDENCE    Appellantnextallegesthatthetrialcourterredinfindingthathissufficiencyclaimwaswaived.AppellantarguesthathecouldnothavewaivedthisclaimbecauseoftheholdinginStatev.Brown,836S.W.2d530(Tenn.1992);involvingthesufficiencyofevidencewithrespectto deliberation,anelementoffirstdegreemurder.BrownwasdecidedafterAppellantsdirectappeal.However,thisCourthaspreviouslyheldthatBrowndidnotcreateanewconstitutionalrulerelativetothesufficiencyoftheevidenceinafirstdegreemurdercase.SeeMillerv.State,No.03C019409CR00336,1995WL395842,at*3(Tenn.Crim.App.July6,1995).Therefore,Appellantcouldhavebroughtthissufficiencyclaiminhisfirstpostconvictionpetition.Becausehefailedtodoso,thisclaimiswaived. 2    Accordingly,thiscaseisreversedandremandedtothetrialcourtforconsiderationofAppellantsfirstclaiminamannerconsistentwiththisopinion.     ____________________________________     JERRYL.SMITH,JUDGECONCUR:___________________________________JOEB.JONES,PRESIDINGJUDGE___________________________________JOSEPHM.TIPTON,JUDGE
