Inthisappeal,theappellantattacksthetrialjudgesdenialofalternativesentencingclaimingthat:(1)thetrialcourtimproperlydeniedhimthepresumptionofentitlementtoalternativesentencing;(2)thetrialcourtimproperlydeniedhimprobationbecausehehadbeengrantedaconcessioninthepleaagreement;and(3)theevidenceastodeterrencewasinsufficienttojustifythedenialofalternativesentencing.Inaddition,heclaimsthatthetrialjudgeimproperlydeniedhimjudicialdiversion. TherecordrevealsthattheappellantwasapassengerinavehicledrivenbyTristanGarrett.AconfidentialinformanthadnotifiedAgentMikeLongoftheDrugTaskForcethatGarrettwasseenwithcocaineinhispossession.AgentLongandanotherofficerfollowedGarrettsvehicleuntilitwasstoppedatarailroadcrossing.TheofficersaskedbothGarrettandtheappellanttoexitthevehicle.Followingapatdownsearch,theofficersrecoveredablackfilmcanistercontaining3.3gramsofcocainefromtheappellantspants'pocket. Attheprobationdeterminationhearing,theappellantrequestedprobationandmorespecificallyjudicialdiversion.Theappellanttestifiedinhisownbehalfstatingthathispossessionofcocainewasanisolatedincident.AlthoughhewasfromNewYork,theappellantwasattendingtheMorristowncampusofKnoxvilleCollege.HeindicatedthathefeltremorseandhadenrolledincollegeinNewYorksincereturninghome.Theappellantintroducedseverallettersfromcommunityleadersattestingtohischaracter.Healsoindicatedthathehadbeenperformingcommunityserviceworksincehisarrest. Oncrossexamination,however,theappellantadmittedthathehadsoldcocaineon severaloccasionspriortohisarrest.Thesesaleshadoccurredoveraperiodofapproximatelyfourtosixweeks.Hesaidhedidnotusecocainebecauseheunderstoodtheharmitcouldcausehisbody. Theappellantsfathertestifiedthathisowndrugaddictionwaslikelythecatalystwhichtriggeredhissonsbehavior.Theappellantsmothersaidthat,duetoafamilycrisis,shehadbeenunabletomaintainherextendedtelephonicrelationshipwithherson. ThisCourthasbeeninformedbytheHamblenCountyCircuitClerksofficethattheappellantisnolongerincarcerated.AJanuary6,1996orderofthetrialcourtplacedtheappellantonprobationforathreeyearperiod.Therefore,theappellantsissueschallenginghisdenialofprobationaremoot. TheremainingviableissueiswhetherthetrialcourtshouldhavegrantedjudicialdiversionwitheventualexpungementofappellantsrecordsasprovidedinTenn.CodeAnn.4035313(a)(1)(1990).Thegrantingofjudicialdiversioniswithinthesounddiscretionofthetrialcourt.Statev.Anderson,857S.W.2d571,572(Tenn.Crim.App.1992).Wewillfindnoabuseofdiscretionifanysubstantialevidenceexiststosupporttherefusalofdiversion.Id. Thetrialcourtdeterminedthattheappellantwaslessthancandidinhisresponses.Theappellanttoldthecourtthatthispossessionwasanisolatedincident.However,oncrossexamination,headmittedtoseveralprevioussales    overasixweekperiod.Further,whenaskedbythecourtwhosuppliedthecocaineandforwhatpriceitsold,theappellantsaidhecouldnotremember. InAndersonthiscourtupheldthedenialofjudicialdiversionwheretheappellantdidnotsincerelyacceptresponsibilityandwheretheoffensewasnotimpulsivelycommitted.Id.at574. Sincethetrialcourtwasinthebestpositiontodeterminehis[defendants]attitudeanddemeanor,wearenotinapositiontoviewthedefendantdifferentlyupontherecordbeforeus.Id.SimilarlyinStatev.Dowdy,894S.W.2d301,305(Tenn.Crim.App.1994)thisCourtdeferredtothetrialcourtsobservationoftheappellantsstatements,attitudeanddemeanorandgavethetrialcourtthebenefitofdiscretion.Wefollowthatreasoning.
