InSeptember1982hepledguiltytofourcountsofsimplepossessionofacontrolledsubstance,onecountofpossessionofacontrolledsubstancewithintenttosell,threecountsoffirstdegreeburglary,onecountofseconddegreeburglary,onecountofpossessionofburglarytools,andnumerouscountsofreceivingstolenproperty.Hereceivedaneffectivesentenceoftenyearsincarceration.InMay1996theappellantfiledapetitionforwritoferrorcoramnobisattackingtheseconvictions.Thetrialcourtdismissedthepetitiononthegroundthatitwasbarredbythestatuteoflimitations.Theappellantthenfiledamotionforreconsiderationandmotiontoconstruehispreviouspleadingasapetitionforpostconvictionrelief. Theappellant'smostrecentconvictionsbecamefinalin1982.Atthattimethelawallowedoneyearfromafinaljudgmenttofileapetitionforwritoferrorcoramnobis.Tenn.CodeAnn.277103(1980).Theappellant'stimeperiodforfilinghispetitionexpiredin1983.Therefore,hispetitionforwritoferrorcoramnobisistimebarred. Theappellantalsomovedthathispetitionbeconstruedasoneforpostconvictionrelief.However,atthetimeofhisoffenses,thelawallowedthreeyearstofileapetitionforpostconvictionrelief.Tenn.CodeAnn.4030102(1980).Thetimeperiodforfilingthispetitionexpiredin1985.Therefore,regardlessofhowtheappellantsmotionisconstrued,itistimebarred.
