Afterareviewoftherecord,weaffirmthejudgmentofthetrialcourt. AsentencinghearingwasheldonDecember6,1994,todeterminethemannerinwhichthesentenceshouldbeserved.TestimonyatthesentencinghearingrevealedthattheappellantwastwentysixyearsofageandlivedwithhisparentsinBlountCounty.Atthetimeofthehearing,hewasemployedwithalocalpaintingcontractor.Theappellanttestifiedthathehadrecentlybeenreleasedfromthecountyjail,wherehehadserved120daysofa180daysentenceforDUI,thirdoffense. Theproofestablishedthattheinstantoffense,resultinginthefacilitationconviction,occurredpriortothecommissionoftheDUIoffense.AfterservinghissentencefortheDUIoffense,theappellantpledguiltytofacilitationandwasreleasedpendingasentencinghearing.Forpurposesofcompletingthepresentencereport,thepresentenceofficerinterviewedtheappellantconcerninganyexistingdrugoralcoholproblems.Atthesentencinghearing,theappellantacknowledgedthatheliedtothepresentenceofficerwhenhedenieduseofmarijuanasincehisreleasefromthecountyjail.Onlywhenadvisedbytheinterviewingofficerthathewouldberequiredtosubmittoadrugscreendidtheappellantadmittotherecentuseofmarijuana.Theappellantfurtheracknowledgedthathehadusedmarijuanasincetheageof12.Finally,theappellant'spresentencereportreflectstwelvepriormisdemeanorconvictions,primarilyinvolvingtheuseofalcohol. Indenyingtotalprobation,thetrialcourtfound:8 YoursentenceintheDUIcasewas180daysandyoudidn'thavetoservebut120.Yougotoutimmediatelyandstartedsmokingmarijuana.Andthenyouwenttoyourprobationofficerandliedaboutthatuntilyoufoundoutthatyouweregoingtogetcaughtanyway,andthenyoutoldherthatyouhad.Andthat'syouknow,afterapersonhasbeeninjailfourmonthsandtheycomeoutandbreakthelawjustimmediately,thattellsmethatthereissomethinggoingonthatneedstobecorrected.Attheconclusionofthesentencinghearing,thetrialcourtimposedasentenceofsplitconfinement.Additionally,thetrialcourtgrantedtheappellantanopportunitytoattendaninpatienttreatmentprogramandorderedthatanyprogramtimecompletedbecreditedagainstthe90dayperiodofincarceration. Theappellanthastheburdenofestablishingthatthesentenceimposedbythetrialcourtwaserroneous.Statev.Ashby,823S.W.2d166,169(Tenn.1991);Statev.Fletcher,805S.W.2d785,786(Tenn.Crim.App.1991).Appellatereviewofasentenceisdenovo,withapresumptionthatthedeterminationsmadebythetrialcourtarecorrect.Tenn.CodeAnn.4035401(d)(1990).Thepresumptionofcorrectnessis"conditionedupontheaffirmativeshowingintherecordthatthetrialcourtconsideredthesentencingprinciplesandallrelevantfactsandcircumstances."Ashby,823S.W.2dat169.Specifically,withrespecttomisdemeanoroffenders,thetrialcourtmustconsidertheprinciples,purposes,andgoalsoftheSentencingAct.Statev.Palmer,902S.W.2d391,393(Tenn.1995);seealsoTenn.CodeAnn.4035302(1994Supp.).Moreover,"thecourtcangrantprobationimmediatelyorafteraperiodofsplitorcontinuousconfinement."Id. Theappellanthastheburdenofestablishinghissuitabilityfortotalprobation.SeeTenn.CodeAnn.4035303(b)(1990).Tomeetthisburden,theappellantmustdemonstratethatprobationwill"'subservetheendsofjusticeandthebestinterestofboththepublicandthedefendant.'"Statev.Dykes,803S.W.2d250,259(Tenn.Crim.App.),perm.toappealdenied,(Tenn.1990)(citationomitted).Whenconsideringwhethertotalprobationistheappropriatesentencingalternative,thefollowingstatutoryprovisionsarerelevant:8 (1)Sentencesinvolvingconfinementshouldbebasedonthefollowingconsiderations: 8 (A)Confinementisnecessarytoprotectsocietybyrestrainingadefendantwhohasalonghistoryofcriminalconduct; 8 (B)Confinementisnecessarytoavoiddepreciatingtheseriousnessoftheoffenseorconfinementisparticularlysuitedtoprovideaneffectivedeterrencetootherslikelytocommitsimilaroffenses;or 8 (C)Measureslessrestrictivethanconfinementhavefrequentlyorrecentlybeenappliedunsuccessfullytothedefendant.8 (5)Thepotentialorlackofpotentialfortherehabilitationortreatmentofthedefendantshouldbeconsideredindeterminingthesentencingalternativeorlengthofatermtobeimposed....Tenn.CodeAnn.4035103(1)and(5)(1990). Thetrialcourt'sstatementsatthesentencinghearingindicatethatthecourtdidconsiderprinciples,purposes,andgoalsoftheAct;theappellant'spriorcriminalhistory;andtheappellant'srehabilitativepotential.SeeTenn.CodeAnn.4035103(1)(A),103(1)(C),and103(5)(1990).Ourreviewis,therefore,denovowithapresumptionofcorrectness.Thepresentencereportrevealsanextensivehistoryofcriminalconduct.Asnotedearlier,theappellanthasbeenconvictedoftwelveoffensessincetheageofeighteen.Therecordalsoreflectsthattheappellanthaspreviouslyreceivedsuspendedsentences,whichhaveobviouslyfailedtodetertheappellantfromfurthermisconduct.Weagreewiththetrialcourtthatillegalactivity,i.e.theappellant'sdruguse,immediatelyfollowinghismostrecentreleasefromthecountyjaildoesnotcommenditselftotheentitlementofprobationinthiscase.Finally,theproofatthesentencinghearingestablishedthattheappellantwaslessthancandidconcerninghisuseofmarijuana."Ithasbeenwidelyheldthatthedefendant'struthfulness...onhisownbehalfisprobativeofhisattitudetowardsocietyandprospectsforrehabilitationandisthusarelevantfactorinthesentencingprocess."Statev.Dowdy,894S.W.2d301,306(Tenn.Crim.App.1994)(citingU.S.v.Grayson,438U.S.41,98S.Ct.2610(1978)).Inotherwords,adefendant'suntruthfulnessisafactorwhichmaybeconsideredindeterminingtheappropriatenessofprobation.Statev.Neeley,678S.W.48,49(Tenn.1984).SeealsoStatev.Leone,02C019206CR00148(Tenn.Crim.App.atJackson,September29,1993).We,therefore,concludethattheappellanthasnotdemonstratedhisentitlementtototalprobation.
