Therecordinthiscasereflectsclearlythatoneofthejurorshadanimproperconversationwiththebaliffregardingthejurysoptions.However,therecordalsoreflectsthatthesubstanceofthebaliffsstatement,i.e.,thatthejurycouldconvictononecountoftheindictmentandacquitontheother,wasnottheinformationimpartedtotheotherjurors.Indeed,thisinformationisacorrectstatementofthelaw.Ratherthanreportthisinformationtotheotherjurors,thejurorwhospokewiththebalifftoldtheothermembersofthepanelthatifnoverdictwasreachedthejudgewouldsendthembackintothejuryroomuntilverdictswereobtained.Hadthejurormadethisstatementwithoutspeakingtoanyoneoutsidethejuryconcerningthejurysdeliberationstherewouldbenoquestionthestatementcouldnotbeusedtoquestiontheresultreachedbythepanel.See,Tenn.R.Evid.606(b). Thus,itisunfortunatethatalonejurorsawfittoaskthebaliffforassistanceinitsdeliberationsratherthantheentirejurymakinginquiryofthetrialjudge,aswouldhavebeentheproperprocedure.Itisevenmoreunfortunatethatthebaliffsawfittoanswerthequestionsaskedofhim.Becausethebaliffsstatementneverreachedtheotherjurors,andbecauseitiscorrectinitsassessmentofthejurysoptions,itishighlyunlikelythestatementeffectedtheverdicteventhoughonelonejurorhadheardit.Nevertheless,theintegrityofthejurysystemdemandsthatimpropercommunicationbetweenjurorsandnonjurorsbeavoided.Ithereforeamoftheopinionthatthemisconductofthejurorandbaliffinthiscaseresultedinprejudicetothejudicialprocessandrequiresanewtrialeventhoughthemisconductinallprobabilitydidnotaltertheresultsofthetrial.See,Tenn.R.App.P.36(b);Statev.Perry,740S.W.2d723(Tenn.Crim.App.1987).
