DistrictAttorneyGeneral      ThirdFloor,JudicialBuilding      Murfreesboro,TN37130OPINIONFILED________________________REVERSEDANDREMANDEDDAVIDH.WELLES,JUDGE   %OPINION %  ӛ TheDefendant,BetsyJanePendergrast,appealsthetrialcourtsdismissalofherpetitionforpostconvictionrelief.Thesingleissuepresentedforourreviewiswhetherthetrialcourterredinitsdeterminationthatthepetitionwasbarredbythestatuteoflimitations.Onappeal,theStateconcedesthatconsiderationofthepetitionwasnotbarredbythestatuteoflimitationsandthustheStateagreeswiththeDefendantthatthiscaseshouldberemandedtothetrialcourtsothatthepetitionmaybeconsideredonitsmerits.Weagreethatthejudgmentofthetrialcourtmustbereversedandthiscasemustberemanded. TheDefendantwasconvictedofseconddegreemurderandwassentencedtotwentyfiveyearsintheDepartmentofCorrectioninOctoberof1990.ThisCourtaffirmedherconvictionandsentence,andoursupremecourtdeniedherapplicationtoappealonJanuary25,1993. ,   כThepostconvictionreliefpetitionunderconsiderationherein,apparentlytheDefendantsfirstpetition,wasfiledonFebruary1,1996.TheStatemovedtodismissthepetitionbasedonthestatuteoflimitations.ThetrialcourtgrantedtheStatesmotiontodismiss.ItisfromtheorderofthetrialcourtdismissingherpetitionthattheDefendantappeals. AtthetimetheDefendantsconvictionbecamefinal,thestatuteofϜlimitationsapplicabletopostconvictionproceedingswasthreeyears.Tenn.CodeAnn.4030102(repealed1995).Itisclearthatthepetitioninthecasesubjudicewasfiledseveraldaysaftertheexpirationofthethreeyearstatuteoflimitations. ThenewPostConvictionProcedureActisapplicabletothispetitionandallpetitionsfiledafterMay10,1995. .   כThisActrepealedthethreeyearstatuteoflimitationsandenactedinitsplaceaoneyearstatuteoflimitations.OntheeffectivedateofthisAct,samebeingMay10,1995,therepealedthreeyearstatuteoflimitationshadnotyetrunonthepetitionersrighttofileapetitionforpostconvictionrelief.The1995Actprovided,inpertinentpart,that notwithstandinganyotherprovisionofthisacttothecontrary,anypersonhavingagroundforreliefrecognizedunderthisactshallhaveatleastone(1)yearfromtheeffectivedateofthisacttofileapetitionoramotiontoreopenapetitionunderthisact.𛀀1995Tenn.Pub.Actsch.2073. BecauseitisclearthatthethreeyearstatuteoflimitationshadnotrunonthisDefendantatthetimethelegislaturerepealedthatstatuteandreplaceditwithaoneyearstatute,webelievethattheprovisionquotedaboveprovidedthisDefendantoneyearfromtheeffectivedateoftheAct,oruntilMay10,1996,tofileherpetitionforpostconvictionrelief.Therefore,astheStateconcedes,thepetitionhereinwastimelyfiledonFebruary1,1996andshouldhavebeenconsideredbythetrialcourtonthemerits.
