Thepetitionerwasconvictedoffirstdegreemurderandaggravatedassaultforwhichhereceivedaneffectivesentenceoflifeinprisonandtheconvictionswereaffirmedonappeal.Statev.EricCordellPendletonandWillieLeeWilliams,No.87189III,DavidsonCo.(Tenn.Crim.App.Sept.28,1988),app.denied(Tenn.Dec.27,1988).Asubsequentpostconvictionpetitionassertingtheineffectiveassistanceoftrialcounselwasdeniedafteranevidentiaryhearingandthedenialwasaffirmedonappeal.EricPendletonv.State,No.01C019001CR00008,DavidsonCo.(Tenn.Crim.App.Aug.3,1990),app.denied(Tenn.Nov.13,1990). Thepetitioner,prose,filedasecondpetitionforpostconvictionreliefonSeptember24,1991,athirdpetitiononOctober4,1991,anda"petitiontorehear"onOctober9,1991.Bythesepleadings,theappellantsoughttoraisegroundsforreliefdealingwiththeineffectiveassistanceoftrialcounselandappellatecounselintheconvictingcase.Regardingappellatecounsel,thepetitionerassertedthatcounselwasineffectiveforfailingtoraiseseveralissuesonappeal .   ׀andfailingtopursuetheissueofthesufficiencyoftheevidencetothesupremecourt,eventhoughcounselhadraisedthatissuebeforethiscourt. Asforwhyhehadnotpreviouslyraisedtheseissues,thepetitionerallegedthatheknowsnothingaboutthelaw,didnotpreviouslyknowwhatcouldberaisedandthathispreviousattorneysdidnotadvisehimabouttheexistenceofsuchgrounds.Also,heallegedthathisappellatecounseldidnotproperlyadvisehimthatissueswerebeingabandonedonappealnoroftheconsequencesofsuchabandonmentandthathispreviouspostconvictionattorneyfailedtoadvisehimofeithertheabandonmentoritsgivingrisetoagroundforreliefwhichcouldberaisedinthefirstpetitionforpostconvictionrelief.Thepetitionerassertedthathefirstbecameawareoftheproblemwhenhispetitionforthefederalwritofhabeascorpuswasdismissedforlackofexhaustionofstateremedies.Heassertedthathedidnot"voluntarily,intelligently,orknowinglywaiveanyoftheseissues"andthatanevidentiaryhearingshouldbeheldinorderthathispreviousattorneyscouldtestifyaboutwhatheknewordidnotknow. Thestatefiledaresponseinthetrialcourtwhichessentiallycontendedthatallgroundsraisedhadbeenwaivedbecausetheycouldhavebeenandshouldhavebeenpresentedinthefirstpostconvictioncase.Withouthearinganytestimony,thetrialcourtdismissedthepetition,statingthatthepetitioner'sgroundswerewaivedbecausetheycouldhavebeenandshouldhavebeenraisedbyhiminthefirstpostconvictioncase. Inourfirstopinion,weheldthatthepetitioner'sallegationsoffactinhispetitionwould,iftrue,rebutthepresumptionofwaiver.However,inHousev.State,oursupremecourtheldasfollows:  8 Weconcludethata"fullandfairhearing"sufficienttosupportafindingofpreviousdeterminationoccursifapetitionerisgiventheopportunitytopresentproofandargumentonthepetitionforpostconvictionrelief.Wefurtherconcludethattherebuttablepresumptionofwaiverisnotovercomebyanallegationthatthepetitionerdidnotpersonallyandtherefore,"knowinglyandunderstandingly,"waiveagroundforrelief.Instead,waiveristo[be]determinedbyanobjectivestandardunderwhichapetitionerisboundbytheactionorinactionofhisattorney.Finally,weconcludethatthereisnorighttoeffectiveassistanceofcounselinpostconvictionproceedings,andtherefore,anallegationofineffectiveassistanceofpriorpostconvictioncounseldoesnotprecludeapplicationofthedefensesofwaiverandpreviousdetermination.  911S.W.2dat714.Essentially,thecourtdeterminedthatapetitionerisboundbytheactionorinactionofcounsel,orhisownignorance,unlesstheconstitutionalrightatissueisafundamentalonethatmayonlybewaivedpersonallyandknowinglybyadefendantpetitioner.Id. UnderHouse,thepetitioner'sallegationsaboutpreviousignoranceoftheissuesandcounselineffectivenessarefornaughtinthattheydonotprovidejustificationforhisfailuretopresenttheseissuesinhispreviouspostconvictioncase.Hedoesnotallegetheviolationofanyrightforwhichapersonalwaiverisrequired.Inotherwords,eveniftakenastrue,theallegationsinhispetitionregardingpersonalignoranceandcounselactionorinactiondonotrebutthepresumptionofwaiverprovidedbyT.C.A.4030112(b).
