Nashville,TN372011649 OPINIONFILED :򀀀 AFFIRMED JOEG.RILEYJUDGE 7XXdXXd7@ OPINION  Thepetitioner,EricC.Pendleton,appealstheorderoftheCriminalCourtofDavidsonCountydismissinghispetitionforawritofhabeascorpus.HewassentencedinJuly1987toservealifesentenceplussix(6)yearsforfirstdegreemurderandaggravatedassault.BecausethetrialcourtfoundthatthepetitionerwasinthelawfulcustodyoftheTennesseeDepartmentofCorrection,thecourtdismissedthewritwithoutahearing.Thetrialcourtalsotreatedthepetitionasoneforpostconvictionreliefandfounditwastimebarredbythethreeyearstatuteoflimitations.Weaffirm.@ I. Thepetitioner'sargumentisthatthestatutoryschemeofsentencingviolatestheseparationofpowersclauseoftheStateConstitution.SeeT.C.A.4035211and4035501.Heclaimsthatthejudicialbranchbydeterminingtherangeofpunishmentwhichestablishestheminimumtimetobeservedbeforeparoleeligibilityimpermissiblyinfringesupontheexecutivebranchsdutytocalculatereleaseeligibility,goodtimeandothercredits.Healsocontendstheparoleboardunlawfullyexercisesajudicialfunctionbygrantingordenyingparole.Theseargumentsarewithoutmerit.Furthermore,habeascorpusreliefincriminalcasesislimitedtothoseinstanceswherethepetitioner'sconvictionisvoidorheisbeingheldbeyondtheexpirationofhissentence.Archerv.State,851S.W.2d157(Tenn.1993). Regardless,petitionersclaimthatcertainstatutesareunconstitutionaldoesnotrenderthejudgmentvoid,butmerelyraisesthepossibilityofavoidablejudgment.Apetitionerisonlyentitledtohabeascorpusreliefwhen"'itappearsuponthefaceofthejudgmentortherecordoftheproceedingsuponwhichthejudgmentisrendered'thataconvictingcourtwaswithoutjurisdictionorauthoritytosentenceadefendant,..."orthattheprisoner'ssentencehasexpired.Archerv.State,851S.W.2dat164.Thereisnothingonthefaceoftherecordsorthepleadingstoindicatethatthecriminalcourtlackedjurisdictionorauthoritytosentencethepetitioner.Noristhereanyindicationthatthesentencehasexpired. Althoughthepetitionerraisesconstitutionalissues,hecannotestablishthatthejudgmentsconvictinghimarevoidorthathissentencetermshaveexpired.Therefore,wefindthatthepetitionforawritofhabeascorpuswasproperlydismissed.@ II. Thetrialjudgepointedoutthatthepetitionshouldhavebeenoneforpostconvictionrelief.However,thepetitionwasdismissedonthesegroundsbecauseofthethreeyearstatuteoflimitationsforpostconvictionreliefunderT.C.A.4030102(repealedby1995Tenn.Pub.Act207,1).PetitionersconvictionswereaffirmedonSeptember28,1988,andtheTennesseeSupremeCourtdeniedpermissiontoappealonDecember27,1988.ThepetitionforawritofhabeascorpuswasfiledonAugust3,1995. ThenewPostConvictionProcedureAct,T.C.A.4030201et.seq.(Supp.1996),reducedthestatuteoflimitationsforpostconvictionrelieftoone(1)year.TheActalsoprovidesforaone(1)yeargraceperiodfromMay10,1995,tofileapetitionorreopenapetitionforpostconvictionrelief.Thegraceperioddoesnotapplyinthisinstancebecausepostconvictionreliefwasalreadybarredbythestatuteoflimitationswhenthelegislationwasenacted.ThenewPostConvictionProcedureActwasnotmeanttorevivepreviouslybarredclaims.SeeJohnnyL.Butlerv.State,C.C.A.No.02C019509CR00289(Tenn.Crim.App.filedDecember2,1996,atJackson);butseeArnoldCarterv.State,C.C.A.No.03C019509CC00270,MonroeCounty(Tenn.Crim.App.filedJuly11,1996,atKnoxville).Asaresult,anypostconvictionreliefistimebarredandweagreethatthepetitionshouldhavebeendismissedonthisbasis.@ III.
