ThedoublejeopardyclausesoftheUnitedStatesandTennesseeconstitutionsprotectagainstbothmultipleprosecutionsforandmultiplepunishmentsforthesameoffense.SeeNorthCarolinav.Pearce,395U.S.711,717,89S.Ct.2072,2076(1969);UnitedStatesv.Johnson,584F.2d148,153(6thCir.1978),cert.denied,400U.S.918(1979);Statev.Lowery,667S.W.2d52(Tenn.1984).Inthisrespect,thedefendantseekstodefendthetrialcourt'sconclusionthathewaspunishedbythedetentionwithoutaprioradjudicationofguiltandthat,therefore,thestatewasviolatinghisrightagainstmultiplepunishmentsbypursuingtheDUIprosecution.HereliesuponUnitedStatesv.Halper,490U.S.435,44849,109S.Ct.1892,1902(1989)inwhichtheSupremeCourtheld"thatundertheDoubleJeopardyClauseadefendantwhoalreadyhasbeenpunishedinacriminalprosecutionmaynotbesubjectedtoanadditionalcivilsanctiontotheextentthatthesecondsanctionmaynotfairlybecharacterizedasremedial,butonlyasadeterrentorretribution." However,fordoublejeopardypurposesthedefendant'sposition,andthatofthemajorityopinionbyimplication,dependsuponcertainassumptionsthatIamunwillingtomakeontherecordbeforeus.Thedefendantassumesthatthetwelvehourdetentionwaspunishmentforthesameconductthat,ifproven,willresultinhispunishmentintheDUIprosecution.Iviewthedetentionasstemmingfromthedefendantrefusingtotakethebreathtest,notfromhimbeingfoundtobedrivingundertheinfluence.Therefore,Icannotsaythatthedetentionconstitutespunishmentforthe"sameoffense,"i.e.,DUI.SeeBlockburgerv.UnitedStates,284U.S.299,30452S.Ct.180,182(1932);Statev.Black,524S.W.2d913,919(Tenn.1975). Also,InotethatunderT.C.A.5510406(a)(3),refusingtosubmittoabloodalcoholtestafterbeingarrestedresultsinsuspensionofadriver'slicenseforsixmonths.Thedeterminationofwhetherthisstatutehasbeenviolatedistobemadebythetrialjudgeduringtheprosecutionoftheoffenseforwhichthedriverwasarrested.T.C.A.5510406(a)(3).Itissignificantthatthesanctionavailableforrefusingtotakeabloodalcoholtestisnotcontingentuponadefendantbeingconvictedoftheoffenseforwhichthepersonischarged.Thisreflectsthatthelegislatureintendedthatthetwoissues,baseduponseparateconduct,betreatedseparately,albeitinthesameproceeding. Obviously,thesanctionofdetentionisnotauthorizedforrefusingatest.However,thisdoesnotbringintoplaytheDoubleJeopardyClause.Infact,itisalsosignificantthatthedefendantwillbeentitled,ifconvicted,tocredituponanysentenceimposedforthetimehespentinconfinementrelativetothiscase.SeeT.C.A.4023101(b).Inthisrespect,Icannotsaythateithermultipleprosecutionsormultiplepunishmentswillbeincurredinthiscase,regardlessofwhethertheconductinissueisviewedtoinvolvethe"sameoffense."     _______________________________     JosephM.Tipton,Judge     @
