OnNovember21,1994,thetrialcourtdismissedthepetitionforpostconvictionreliefbecausetheywerefiledbeyondthetimeinwhichthestatuteoflimitationshadrun.Tenn.CodeAnn.4030102. Weaffirmthejudgments. Thepetitionersclaimtheydidnottimelyfiletheirpetitionforpostconvictionreliefbecausetheircounselgavethemerroneousadvicewhichledtotheirfailuretotimelyfileapetitionforpostconvictionrelief. ThisCourt,inanopinionbythemostableJudgeTipton,heldinStatev.Phillips,904S.W.2d23(Tenn.Crim.App.1995)thatincompetencyofcounselgivesnoexcuseforarelieffromafailuretotimelyfileapetitionforpostconvictionrelief. &    ThepetitionerscontendthisCourtshouldadoptaruleappliedtomedicalmalpracticecaseswhichtriggerstherunningofthestatuteoflimitationsfromthetimetheinjuredpartydiscoveredtheinjury,ratherthanstatingthetimethestatutecommencestorunfromthedateofthemedicalsurgery.ThisCourthasconsistentlyrejectedtheapplicationofthisruletopostconvictionproceedings.SeeJackiePaynev.State,(AndersonCounty,C.C.A.No.03C019310CR00349,filedatKnoxville,January11,1995).WeseenoreasontodepartfromtheruleinPayne. ThepetitionersfurtherarguethatthestatuteoflimitationsshouldnothavebeguntorununtilApril19,1988,thedateofthelastactiononpetitionsforwritsofcoramnobisfiledbythemtoattacktheconvictions.Evenifthiswouldtolltherunningofthestatute,whichitdidnotdo,thetimeperiodfromApril19,1988untilDecember30,1993ismorethanthethreeyearstatuteoflimitationsapplicableinthiscase.
