OnNovember14,1994,theAppellantwasarrestedafterattemptingtomakeamarijuanapurchasefromundercoverpoliceofficers.Afterthearrest,thepoliceofficersobtainedasearchwarrantfortheAppellantshotelroomandfoundanotherquantityofmarijuanaandrollingpapers.OnMay22,1995,theAppellantpledguiltytoallcharges.Afterasentencinghearing,thetrialjudgesentencedhimtotwoyearsconfinementforpossessionofmarijuanawithintenttosell,elevenmonthsandtwentyninedaysforbothsimplepossessionofmarijuanaandpossessionofdrugparaphernalia,allsentencestobeservedconcurrently. WhenanAppellantcomplainsofhisorhersentence,wemustconductadenovoreviewwithapresumptionofcorrectness.Tenn.CodeAnn.4035401(d)(1990).Theburdenofshowingthatthesentenceisimproperisupontheappealingparty.Id.SentencingCommissionComments.Thispresumption,however,isconditioneduponanaffirmativeshowingintherecordthatthetrialcourtconsideredthesentencingprinciplesandallrelevantfactsandcircumstances.Statev.Ashby,823S.W.2d166,169(Tenn.1991). TheAppellantfirstcontendsthatthetrialjudgeshouldhaveorderedalternativesentencingbyplacinghimincommunitycorrections.Thisissueiswithoutmerit. TheAppellantarguesthatheshouldhavereceivedalternativesentencingbecauseasaClassEfelonheispresumedafavorablecandidateforalternativesentencing.SeeTenn.CodeAnn.4035103(b)(1990).Hefurthercontendsthatalternativesentencingisappropriatebecausehehastestifiedinfrontofafederalgrandjurytryingtocrackdownonadrugringandbecauseheisthesoleproviderforhischildren. Thetrialjudge,however,opinedthatplacingtheAppellantincommunitycorrectionswoulddepreciatetheseriousnessofhisoffenses.SeeTenn.CodeAnn.Ϝ4035103(1)(B)(1990).Regardingthegrandjurytestimony,thetrialjudgefoundthattheAppellantfailedtoshowthatanyindictmentshadbeenhandeddownoranyarrestsmadeasaresultofhistestimony.However,thetrialjudgestatedthatiftheAppellantcouldshowthatthetestimonyresultedinanyindictmentsorconvictions,thetrialjudgewouldconsidersuspendingtheAppellantssentences.Moreover,thetrialjudgefoundthatanorderofalternativesentencingwouldnotbeinthebestinterestofjustice,thepublic,ortheAppellanthimselfandthattheAppellantshouldhavethoughtabouthischildrenbeforedealingindrugs.Accordingly,thetrialjudgedeclinedtofindtheAppellantagoodcandidateforcommunitycorrectionsoranyothertypealternativesentencing.Weagree. TheAppellantssecondcontentionisthatthetrialjudgeerredwhenhedidnotgivetheAppellanttheminimumsentenceforpossessionofmarijuanawithintenttosell.Thisissueisalsowithoutmerit. Whendeterminingthelengthofasentence,thetrialjudgeshallstartattheminimumsentence,increaseitconsideringappropriateenhancementfactors,anddecreaseitconsideringappropriatemitigatingfactors.Tenn.CodeAnn.4035210(Supp.1995). Atthesentencinghearing,thetrialjudgefoundthattheAppellanthasasubstantialprevioushistoryofbothcriminalconvictionsandcriminalbehavior.SeeTenn.CodeAnn.4035114(1)(Supp.1995).Therecordsupportsthetrialjudgesfindingsinthatregard. TheAppellantthenofferedtwomitigatingfactors.First,thathis conductneithercausednorthreatenedseriousbodilyinjuryandsecond,thathehasbeenassistingthepoliceinuncoveringothercriminalactivity.Tenn.CodeAnn.4035113(1),(9)(1990).Thetrialjudgedidnotgiveeithermitigatingfactormuchweight.SeeStatev.Mann,No.02C019504CC00101(Tenn.Crim.App.,Jackson,Oct.18,1995),permissiontoappealdenied(April1,1996)(statingthattheseriousbodilyinjurymitigatingfactorhaslittleweightwhenthesaleofdrugstothepublicisinvolved);Statev.Keel,882S.W.2d410(Tenn.Crim.App.1994)(suggestingthatwhenanappellanttriestoassistthepoliceinuncoveringcriminalactivityandtheassistancebearsnofruit,therequirementsofmitigatingfactornumberninearenotfulfilled).Consideringbothenhancingandmitigatingfactors,thetrialjudgeruledthattheenhancementfactorfaroutweighedthemitigatingfactorsandenhancedtheAppellantssentencefromoneyeartotwoyears.
