OnDecember17,1990,theDefendantenteredpleasofguiltytothreecountsofpossessionofacontrolledsubstancewithintenttosellordeliver.Inexchangeforhisguiltypleas,heagreedtoacceptandwassentencedtothreeconcurrentfiveyearsentences.AftertheDefendantservedaboutsixmonths,thetrialcourtsuspendedthebalanceofhissentenceandplacedhimonprobationforfiveyears.Aboutsixmonthsthereafter,aprobationviolationwarrantwasfiled,andsubsequently,onJuly9,1993,thetrialcourtfoundtheDefendanthadviolatedthetermsofhisprobationandrevokedhissuspendedsentence.OnOctober22,1993,thetrialcourtagainsuspendedtheremainderoftheDefendant'ssentenceandplacedhimonprobationforfiveyears. OnJuly27,1994,aprobationviolationwarrantwasagainissuedagainsttheDefendant.Thewarrantallegednumerousviolationsoftheconditionsofhisprobation.ThetrialcourtconductedanevidentiaryhearingontheprobationviolationchargesonNovember3,1994.Attheconclusionofthehearing,thecourtfoundtheDefendanttobeinviolationofthetermsofhisprobationandrevokedhissuspendedsentence.ItisfromthisorderofthetrialcourtrevokingtheDefendant'ssuspendedsentencethattheDefendantappeals. "Indeterminingwhethertorevokeprobation,thetrialjudgeneednotfindaviolationofthetermsoftheprobationhasoccurredbeyondareasonabledoubt.Theevidenceneedonlyshowthetrialjudgehasexercisedconscientiousjudgmentinmakingthedecisionratherthanactingarbitrarily."Stampsv.State,614S.W.2d71,73(Tenn.Crim.App.1980),perm.toappealdenied,id.(Tenn.1981)."Inreviewingthefindingsofthetrialjudge,thejudgmentofthetrialcourtisgiventheweightofajuryverdict."Id. Boththegrantingandrevocationofasuspendedsentencerestinthesounddiscretionofthetrialjudge.Statev.Mitchell,810S.W.2d733,735(Tenn.Crim.App.1991).Thetrialjudgehasadutyatprobationrevocationhearingstoadducesufficientevidencetoallowhimtomakeanintelligentdecision.Id.ThefactthattheDefendantwasnotconvictedofanyoftheoffenseswithwhichhewaschargeddoesnotmandatedismissaloftheprobationviolationwarrant.Statev.Delp,614S.W.2d395,39697(Tenn.Crim.App.1980),perm.toappealdenied,id.(Tenn.1981). Thejudgmentofthetrialcourtwillnotbedisturbedonappealunlessitappearsthattherehasbeenanabuseofdiscretion.Foranappellatecourttobewarrantedinfindinganabuseofdiscretioninaprobationrevocationcase,itmustbeestablishedthattherecordcontainsnosubstantialevidencetosupporttheconclusionofthetrialjudgethataviolationoftheconditionsofprobationhasoccurred.Statev.Harkins,811S.W.2d79,82(Tenn.1991). Whenatrialjudgegrantsasuspendedsentence,thatjudgedemonstratesacertainamountofconfidencethattheDefendantwillleadalawfullife.WhentheDefendant'ssubsequentactionsviolatethatconfidence,certainlythetrialjudgeagainexercisesdiscretioninwhetherornotthesuspendedsentenceshouldberevoked.Davenportv.State,214Tenn.468,474,381S.W.2d276,279(1964);Thompsonv.State,198Tenn.267,269,279S.W.2d261,262(1955).TheDefendant'ssubsequentactionsmayindicatethattheinitialdecisiontosuspendthesentencewasamistake.Allprobationersaredeemedtobeonnoticethattheyarenottoengageinunlawfulactivityorotherwiseconductthemselvesinconsistentlywithgoodcitizenshipiftheyaregrantedprobationinsteadofincarceration.Robertsv.State,546S.W.2d264,265(Tenn.Crim.App.1976). Attheprobationviolationhearing,theDefendant'sprobationofficertestifiedthattheDefendanthadviolatedthetermsofhisprobationinthefollowingparticulars:Hetestedpositiveforcocaineonadrugscreen;heattendedhisdrugcounselingmeetingsonlysporadically;hesubsequentlyrefusedtotakefurtherdrugscreensandadmittedtotheprobationofficerthathewasusingcocaine;hethenturneddownanyfurtherdrugtreatmentprograms;hechangedhisresidencewithoutnotifyinghisprobationofficer;hemadenopaymentsorarrangementstomakepaymentsonhiscourtcosts;andhefailedtoreporttohisprobationofficerasdirected.TheDefendantadmittedthathehadnotpaidhiscourtcostsbecausehewasunabletodosobutdeniedviolatinganyotherconditionsofhisprobation. Fromourreviewofthisentirerecord,wecannotconcludethatthetrialjudgeactedarbitrarilyinrevokingtheDefendant'sprobation.Tothecontrary,thisrecordclearlycontainssubstantialevidencetosupporttheconclusionofthetrialjudgethataviolationoftheconditionsofprobationhadoccurred.ThisDefendantblatantlyviolatedtheconfidenceplacedinhimbythetrialjudge.
