àDefendant,€Shannon€W.€Potter,€was€convicted€by€a€Shelby€County€jury€ofÏtwo€(2)€counts€of€aggravated€assault€and€sentenced€to€concurrent€terms€of€threeÏ(3)€years.€€The€sole€issue€for€our€review€is€whether€the€trial€court€erred€in€denyingÏprobation.€€We€affirm€the€denial€of€probation.ÌÌà@ àò òòòTRIAL€TESTIMONYóóó óÌÌà àOn€March€4,€1994,€the€defendant€and€co„defendant€were€driving€aroundÏand€passed€three€(3)€young€œmales›€who€were€walking.€Each€œyoung€male€was›Ïwearing€a€yarmulke.€€œAlex›€Katz€and€Jonathan€Wogan,€two€(2)€of€the€young€males,Íwere€in€the€seventh€and€eighth€grades,€respectively.€€The€defendant€and€co„defendant€stopped€and€exited€their€vehicle€and€approached€the€juveniles.€ÏDefendant€had€in€his€possession€a€wooden€sword€which€is€used€in€the€martialÏarts.€€Defendant€referred€to€Katz€as€a€ð ðf_€_€_€ing€Jew€boy.ðð€€Without€provocation,Ïthe€defendant€struck€Katz€with€the€sword€knocking€him€to€the€ground.€€DefendantÏordered€Katz€to€get€up€and€then€struck€him€again€with€the€sword.€€œDefendant,Ïagain€without€provocation,›€then€struck€Wogan€in€the€kidney€area.€€œDefendant›€andÏthe€co„defendant€returned€to€the€vehicle€and€fled.€€Ìà àBoth€victims€were€taken€to€the€hospital.€€Wogan€suffered€a€lacerated€kidneyÏand€was€hospitalized.€€Katz€received€treatment€for€his€arm€injury€and€wore€his€armÏin€a€sling€for€a€short€period€of€time.€€Thereafter,€Katz€continued€to€experienceÏsevere€pain€and€swelling€and€had€various€problems€with€his€arm€up€until€the€timeÏof€trial.€€Ìà àThe€defendant€and€co„defendant€were€not€immediately€apprehended.€ÏBased€upon€the€description€of€the€suspects€and€their€vehicle,€they€were€arrestedÏapproximately€one€(1)€week€after€the€incident.€€Ìà à̛̜à@ àò òòòSENTENCING€HEARING€TESTIMONYó óóóÌÌà àDefendant€was€seventeen€(17)€years€of€age€at€the€time€of€the€assault€andÏwas€€transferred€from€juvenile€court€to€criminal€court€for€these€offenses.€€He€hadÏrun€away€from€home€on€four€(4)€prior€occasions€and,€on€one€of€those€occasions,Íhad€remained€away€for€approximately€one€(1)€year.€€He€had€been€diagnosed€asÏhaving€Attention€Deficit€Hyperactivity€Disorder€and€had€received€professional€helpÏon€prior€occasions.€€à àDefendant€testified€that€at€the€time€of€the€assault€he€wasÏvery€angry€as€a€result€€of€breaking€up€with€his€girlfriend.€€He€testified€that€he€did€notÏattack€the€victims€out€of€anti„Semitism.€€Ìà àDefendant€also€had€a€prior€criminal€history€as€a€juvenile.€€Two€(2)€burglaryÏcharges€were€adjusted€non„judicially€as€was€a€reckless€endangermentÏadjudication.€€à àAt€the€conclusion€of€the€hearing,€the€trial€court€sentenced€theÏdefendant€as€a€standard€offender€to€the€minimum€term€of€three€(3)€years€on€eachÏof€the€offenses€to€run€concurrently;€however,€the€trial€court€denied€probation.€€ÌÌà0 àà àà@ àòòò òPROBATION€ELIGIBILITYóóó óÌÌà àThe€trial€court€made€extensive€findings€in€denying€probation.€€The€trial€courtÏnoted€that€the€testimony€from€the€licensed€psychologist€at€the€sentencing€hearingÏdid€not€provide€justification€for€defendantððs€violent€conduct€on€this€occasion.€€TheÏcourt€noted€defendantððs€prior€criminal€history€as€a€juvenile€œand›€that€he€did€notÏseem€to€have€benefited€from€the€non„restrictive€measures€imposed€in€thoseÏmatters.€€The€trial€court,€further€noting€the€unjustified€and€violent€nature€of€theseÏoffenses€which€led€to€substantial€injuries€to€these€two€(2)€young€males,€concludedÏthat€incarceration€was€necessary€so€as€not€to€depreciate€the€seriousness€of€theseÏoffenses.€€€Finally,€the€trial€court€concluded€that€the€œinterests›€of€society€would€beÏbetter€served€by€the€incarceration€of€the€defendant.€These€findings€andÏconclusions€are€adequately€supported€by€the€record.€Accordingly,€we€find€no€errorÏin€the€denial€of€probation.€€ÌœÌ›à
