Therewasnoagreementregardingalternativesentencing.Asentencinghearingwasconducted.Thetrialcourtrefusedtoimposeanalternativesentence.Thus,thedefendantraisesthefollowingissuesforreview:   X    I.Thetrialjudgeerredinnotconsideringsentencingprinciplesandallrelevantfactsandcircumstancesindeterminingthemannerofserviceofdefendant'ssentence[s].II.Whetherthemannerofserviceofthesentence[s]imposedbythetrialcourt[are]appropriate.      X Afterathoroughreviewoftherecord,thebriefssubmittedbytheparties,andthelawgoverningtheissuespresentedforreview,itistheopinionofthisCourtthejudgmentofthetrialcourtshouldbeaffirmed. Thedefendantwas28yearsofagewhenhewassentenced.Heleftschoolintheninthgrade.HemadeanefforttoobtainaGED,buthefailedthetest.Hewaslivingwithhisparents.Hewasemployedbyafarmequipmentcompanyinthepartsdepartment.Hehasapriorconvictionfordrivingwithoutalicense. OntheeveningofSeptember24,1993,thedefendantvisitedhisgirlfriendinatrailerparkinMillington.Whenanargumentensuedbetweenthedefendantandhisgirlfriend,thedefendantleftthetraileratahighrateofspeed.Witnessesestimatedthedefendantreachedaspeedofsixtymilesperhourinathirtymileperhourspeedzone.Thedefendantstruckthevictim,achildthreeandonehalfyearsofage.Theimpactknockedthechildapproximately168feet.Thedefendantdidnotstopafterstrikingthechild. ThedefendantwenttotheMillingtonPoliceDepartmentapproximatelytwohoursafterstrikingthechild.Theofficersobservedthatthedefendanthadbeendrinking.Thedefendantrefusedtosubmittoachemicalbreathtestorfieldsobrietytests.Twoofficersexpressedtheviewthedefendant'sabilitytooperateamotorvehiclewasnotimpaired. Thetrialcourtrefusedtoimposeanalternativesentence.Thecourtfoundthedefendantwaslessthancandidwhenhetestifiedatthesentencinghearing,andconfinementwasnecessarytoavoiddepreciatingtheseriousnessoftheoffenses.Thecourtalsonotedthedefendantwasnotseriousregardingtheremorseheexpressed.Thedefendanttestifiedhowtheincidenthadaffectedhim.Thedefendantdidnotoffertomakerestitution. ThisCourthasconductedadenovoreviewoftherecordwithapresumptionthatthedeterminationsmadebythetrialcourtarecorrect.Tenn.CodeAnn.4035401(d).Beforeanaccusedisentitledtorelief,theaccusedhastheburdenofovercomingthepresumptionofcorrectness.Inthiscase,thedefendanthasfailedtoovercomethefindingsofthetrialcourt.
