óOn€May€5,€1994,€Ron€Eaker€of€the€Henry€County€Sheriff's€DepartmentÏinvestigated€a€burglary€at€Grandma's€Grocery€in€the€Mansfield€community€inÍHenry€County.€€Eaker's€initial€investigation€revealed€that€"the€front€door€was€toreÏ[sic]€off.€€Also,€[he€noticed]€several€different€empty€boxes€of€weapons.€€[He]€alsoÏfound€some€more€[boxes]€out€in€the€parking€lot."€€With€the€assistance€ofÏCatherine€Carter,€the€co„owner€of€the€store,€Eaker€compiled€a€list€of€the€stolenÏitems.€€Carter€and€Eaker€determined€that€the€perpetrators€had€taken€tenÏweapons.€€Eaker€documented€the€serial€numbers€of€the€missing€weapons.€ÏLarry€Clayton,€an€investigator€with€the€Henry€County€Sheriff's€Department,Ïtestified€that€the€serial€numbers€of€the€missing€weapons€were€entered€in€theÏNCIC€computer€on€May€5.€ò ƒ5 ××  ×›€€Both€weapons€wereÏidentified€as€two€of€those€stolen€from€Grandma's€Grocery€the€previous€day.× ƒ6 ××  ×€ÏSimmons€notified€the€Henry€County€Sheriff's€Department€that€he€had€recoveredÍtwo€of€the€weapons€stolen€from€Grandmaððs€Grocery.× ƒ7 ××  ×€€When€questioned€by€theÏofficers,€the€appellant€denied€any€knowledge€of€the€guns€or€the€burglary€ofÏGrandma's€Grocery.€€However,€the€appellant€stated€that,€on€May€6,€the€dayÏfollowing€the€burglary,€he€had€picked€up€Huspon,€Russell,€Rodney€Sorrell,€andÏKendrick€Johnson€in€Paris,€Tennessee,€and€had€brought€them€to€Humboldt€forÏthe€Strawberry€Festival.€€He€gave€as€his€address€a€residence€in€the€WesthavenÏTrailer€Park€in€Humboldt.ÌÌà àThe€appellant's€father,€Willie€Price,€testified€at€trial.€€He€testified€that€heÏand€Sheila€Huspon,€who€is€the€mother€of€co„defendant€Andre€Huspon,€livedÏtogether€in€a€mobile€home€in€the€Westhaven€Trailer€Park.€€He€also€verified€thatÏthe€appellant€lived€with€him€"off€and€on,"€as€did€Andre€Huspon,€during€MayÏ1994.€Ì€Willie€Price€stated€that€he€recovered€a€weapon€from€a€"side€ditch€across€town,€"Ïand€that,€on€May€7,€he€turned€the€handgun€over€to€the€Humboldt€police.€€ThisÏweapon€was€identified€as€one€of€the€stolen€guns€from€Grandma's€Grocery.€ÏSheila€Huspon€testified€that€she€had€discovered€two€guns€under€the€steps€ofÏtheir€trailer.€€She€showed€them€to€her€brother,€Harold€Huspon,€and€"then€theÏguns€disappeared."ò òÌÌà àó óThe€only€evidence€introduced€at€trial€which€places€the€appellant€atÏGrandma's€Grocery€is€the€testimony€of€the€co„defendants€Kendrick€Johnson€andÏSteven€Russell.€€Both€Johnson€and€Russell€pled€guilty€to€the€crime€on€an€earlierÏdate.€€Their€testimony€revealed€that,€on€the€evening€of€May€4,€1994,€theÏappellant,€driving€his€gray€Omni,€picked€up€Johnson,€Russell,€Sorrell,€andÏHuspon€at€the€Calidonia€Projects€in€Paris.€€In€his€statement,€which€was€enteredÏinto€evidence,€Johnson€recounted€that€"Michelle€Pledge,€Charles€Allen€andÏLadon€McCutchen€saw€us€get€in€[Price's€car]€and€go."× ƒ8 ××  ×€€Russell's€and€Johnson'sÏtestimony€revealed€that,€sometime€around€midnight,€the€appellant€drove€toÏMansfield€and€dropped€the€group€off€at€Grandma's€Grocery.€€The€appellant€thenÏleft€in€his€vehicle,€telling€the€others€that€he€would€return.€€The€others€broke€intoÏthe€store€and€removed€approximately€ten€guns.€€When€the€appellant€returned,Ïthe€four€youths,€carrying€the€stolen€weapons,€got€back€into€the€appellant'sÏvehicle.€The€appellant€subsequently€"dropped€[Johnson]€and€Steven€[Russell]Ïon€Depot€Street."€€Johnson€testified€that,€on€the€next€day,€May€5,€the€appellantÏtraveled€back€to€Paris€to€transport€Russell,€Sorrell€and€Johnson€to€theÏStrawberry€Festival.€€€ÌœÌ›ÌÌà àRex€Carter,€owner€of€Grandma's€Grocery,€testified€that,€due€to€federalÏregulations€requiring€him€to€record€the€serial€numbers€of€all€weapons€in€hisÏstore,€he€was€able€to€determine€exactly€which€guns€were€missing€following€theÏtheft.€€He€further€testified€that€the€perpetrators€had€removed€ten€guns,€worthÏ$900.00,€from€the€store.€€Carter€then€œidentified€weapons›€recovered€by€theÏHumboldt€Police€Department€as€those€stolen€from€his€store€on€May€4„5.€€ÌÌÌà@ àOn€numerous€occasions,€the€courts€of€this€state€have€addressed€"theÏquestion€of€the€character€and€quality€and€quantum€of€evidence€necessary€toÏconstitute€legally€sufficient€corroboration€of€an€accomplice."€€òòHenley€v.€Stateóó,Ï489€S.W.2d€53,€55€(Tenn.€Crim.€App.€1972).€€To€corroborate€the€testimony€of€anÏaccomplice,€"there€should€be€some€fact€testified€to,€entirely€independent€of€theÏaccomplice's€evidence,€which,€taken€by€itself,€leads€to€the€inference,€not€onlyÏthat€a€crime€has€been€committed,€but€also€that€the€defendant€is€implicated€in€it."€ÏòòState€v.€Billingsleyóó,€No.€01C01„9506„CC„00166€(Tenn.€Crim.€App.€at€Nashville,ÏMay€16,€1996)€(citing€òòClapp€v.€Stateóó,€30€S.W.€214,€216€(Tenn.€1895)).€€"ThisÏcorroboration€must€consist€of€some€fact€or€circumstance€which€affects€theÍidentity€of€the€defendant."€€òòIdóó.× àIn€the€present€case,€we€conclude€that€the€record€is€void€of€any€evidence,Ïother€than€the€accomplicesðð€testimony,€implicating€the€appellant€in€the€crime.€ÏAbsent€the€accomplices'€testimony,€there€is€no€proof€placing€the€appellant€at€theÍscene€of€the€crime,€placing€the€appellant€in€possession€of€any€of€the€stolenÏweapons,€or,€generally,€implicating€the€appellant€in€the€commission€of€a€crime.€ÏThe€record€does€establish€that€the€appellant€was€an€acquaintance€of€the€co„defendants,€that€he€transported€them€from€Paris€to€Humboldt€on€the€dayÏfollowing€the€crime,€and€that€he€was€present€during€the€shooting€incident€at€theÏtrailer€park.€€The€mere€association€between€the€defendant€and€his€accomplicesÏis€legally€insufficient€to€corroborate€the€testimony€of€his€accomplices.€€òòGable€v.ÏStateóó,€519€S.W.2d€83,€85€(Tenn.€Crim.€App.€1974);€òòsee€alsoóó€€òòBoulton€v.€Stateóó,Ï377€S.W.2d€936,€938€(Tenn.€1964)€(citing€2nd€òòWharton's€Criminal€EvidenceÏóó(12th€Ed.),€ðð€468,€pp.€257„258,€"the€corroboration€of€an€accomplice€.€.€.€is€notÏsufficient€if€it€merely€shows€the€commission€of€the€offense,€or€the€circumstancesÏthereof,€or€that€the€accomplice€and€the€defendant€are€acquainted€orÏconnected.");€òòState€v.€Adkissonóó,€899€S.W.2d€626,€644€(Tenn.€Crim.€App.€1994).€ÏòòCfóó.€€òòState€v.€Barnardóó,€899€S.W.2d€617,€626€(Tenn.€Crim.€App.€1994)€€Ï(Independent€testimony€establishing€the€presence€of€the€defendant€in€theÏcompany€of€the€co„defendants€at€or€near€the€place€of€the€crime€is€sufficientÏcorroborative€evidence.).€€The€State,€both€at€trial€and€on€appeal,€contends€thatÏthere€is€sufficient€corroboration€to€implicate€the€appellant€in€the€crimes.€ÏSpecifically,€the€State€argues€that€two€weapons€were€found€at€the€appellant'sÍresidence€under€the€œsteps.× ƒ< ××  ×›€€œInitially,€we€note€that€connecting›€the€handguns€toÏthe€various€defendants€in€this€case€was€made€difficult€by€the€failure€of€theÏprosecution€and€the€witnesses€to€identify€the€weapons€for€the€record.€€Moreover,Ïnone€of€the€weapons€were€introduced€as€trial€exhibits.€€At€trial,€the€StateÏdisplayed€six€handguns.€€Only€four€of€those€guns€displayed€were€identified€byÏDeputy€Clayton€as€stolen.€€The€victim€did€identify€six€guns€as€stolen,€however,Ïwe€are€unable€to€determine€from€the€record€where€they€were€œrecovered.›ÏAdditionally,€we€note€that€the€co„defendant,€Andre€Huspon,€who€admittedÏparticipation€in€the€theft,€also€lived€at€the€same€residence.ÌÌÌà@ àò òCONCLUSIONó óÌ€€Ìà àAfter€a€careful€review€of€the€evidence€presented€at€trial,€we€conclude€thatÏthere€is€not€sufficient€corroboration€of€the€evidence€of€the€two€accomplices€toÏsupport€a€conviction.€€A€reversal€due€to€insufficient€evidence€corroborating€anÏaccompliceððs€testimony€is€not€a€trial€error,€but€relates€to€the€sufficiency€of€theÏevidence€and€is€a€defect€involving€the€guilt€or€innocence€of€the€defendant.€ÏòòState€v.€Willifordóó,€553€S.W.2d€553,€554€(Tenn.€Crim.€App.€1991).€€After€viewingÏthe€evidence€in€a€light€most€favorable€to€the€State,€we€are€of€the€opinion€that€aÏrational€trier€of€fact€could€not€have€found€the€appellant€guilty€beyond€aÏreasonable€doubt€of€the€offenses€for€which€he€was€convicted.€€Accordingly,€theÏappellantððs€convictions€for€theft€of€property€over€$500€and€burglary€are€reversedÏand€dismissed.̛̜̜ÌÌà
