ThedefendantsconvictionstemsfromeventsoccurringatTeddySmithshome.ThedefendantwenttoMr.Smithshomeinsearchofhisgirlfriend,JanieDouglas,inordertoretrievekeystohistrailerfromMs.Douglas.WhenMr.Smithaskedthedefendanttoleave,analtercationensued.ThedefendantclaimedthatMr.Smithstartedthealtercation,howeverwitnessesforthestatetestifiedthatthedefendantstartedthealtercation.Inanyevent,afightensued,andthedefendantwasarrested.Attrial,fourwitnessestestifiedthatthedefendanthitMr.Smith.   @ I.ADMISSIONOFIRRELEVANTAND -&+ PREJUDICIALTESTIMONY   Thedefendantfirstcontendsthatthetrialcourterredbyallowinginto z0r). evidencetestimonyfromstateswitnessesregardingthereactionofseveralsmallchildrenwhowitnessedthealtercation.Hecontendsthattheevidenceisirrelevantand prejudicial.SeeTenn.R.Evid.99401,99403.Thestatearguesthatthedefendantdidnot 5.4 properlyobjecttothetestimonyattrialand99that99theadmissionoftheevidenceisharmlessinlightoftheotherproofagainstthedefendant.  AccordingtoRule401,Tenn.R.Evid.,evidenceisrelevantifithas anytendencytomaketheexistenceofanyfactthatisofconsequencetothedeterminationoftheactionmoreprobableorlessprobablethanitwouldbewithouttheevidence.Relevantevidencemaystillbeexcluded ifitsprobativevalueissubstantiallyoutweighedbythedangerofunfairprejudice,confusionoftheissues,ormisleadingthejury....Tenn.R.Evid.403.Thetrialcourthasdiscretionindeterminingwhetherevidencemeetsthetestforrelevancy.Statev.Forbes,918S.W.2d431,449(Tenn.   Crim.App.1995).99Assessing9999theprobativevalueanddangerofunfairprejudiceregardingthe99evidencealsofallswithinthe0/trs/00trialcourts01discretion1.9999Statev.Burlison,868 h` S.W.2d713,72021(Tenn.Crim.App.1993).Thiscourtwillonlyreverseatrialcourtsdecisionifthetrialcourtabuseditsdiscretion.Statev.Williamson,919S.W.2d69,78  (Tenn.Crim.App.1995). Theevidencethedefendantcontestsrelatestothetestimonyofstateswitnessesregardingthereactionofseveralsmallchildrenwhowitnessedthefight.Thestateaskedthreewitnessestodescribethereactionofthechildren,andthewitnessesstatedthatthechildrenwerescreamingandcryingandwerescared.Therecordreflectsthatthedefendantsattorneyobjectedtothetestimonyonthebasisofrelevance,butthetrialcourtoverruledtheobjection. Weagreewiththedefendantthattheevidenceisirrelevant.Infact,thetrialcourtacknowledgedasmuchduringthemotionforanewtrial.However,theerrorisharmlessinlightoftheotherevidencepresentedagainstthedefendant,whichincludedfourwitnessestestifyingthatthedefendantattackedthevictim.T.R.A.P.36(b);Tenn.R.Crim.P.52(a).  99  5.4  :  II.9999SENTENCING    Thedefendantcontendsthatthetrialcourtdidnotcomplywithstatutory  sentencingproceduresandthatthetrialcourterredbydenyingsentencingalternatives.Specifically,hearguesthatthetrialcourtdidnotstateontherecorditsconsiderationofrelevantsentencingprinciples,includingenhancementandmitigatingfactors.Healsoarguesthatasentenceorderinghimtopayafineorrestitution,asuspendedsentence,asplitsentenceorworkreleasewouldbemoreappropriate.Thestatecontendsthatthedefendantwasproperlysentenced. Appellatereviewofmisdemeanorsentencingisdenovoontherecord @8 withapresumptionthatthetrialcourtsdeterminationsarecorrect.T.C.A.994035401(d)2,23and399402(d).AstheSentencingCommissionCommentstoT.C.A.4035401(d)note,theburdenisnowontheappealingpartytoshowthatthesentenceisimproper.Wenotethat99the4lawprovides45reis59999nopresumptive99minimum6sentenceprovidedbylaw69999formisdemeanorsentencing.See,e.g.,Statev.Creasy,885S.W.2d829,832(Tenn.Crim.App.1994).However,in < 4 misdemeanorsentencing,thetrialcourtmustconsiderthepurposesandprinciplesoftheCriminalSentencingReformActof1989.T.C.A.4035302(d). Atthesentencinghearing,thedefendanttestifiedthathewasemployedbyStraightLineMasonryCompanyandGoodmansAirConditioning.Hetestifiedthathehadnothadanytroublewiththevictimsincetheoffense.Heassuredthetrialcourtthatifhereceivedprobation,hewouldmeetwithhisprobationofficerandcomplywithanyrequestsmadeofhim. Apresentencereportwasintroducedintoevidence.Itreflectsthatthedefendanthasninepriormisdemeanorconvictionsforsuchoffensesaspublicintoxication,disorderlyconduct,marijuanapossession,drivingonasuspendedlicense,anddrivingonarevokedlicense.Attheconclusionofthesentencinghearing,thetrial 706 courtsentencedthedefendanttoelevenmonthsandtwentyninedaysconfinement.Atthemotionfornewtrialhearing,however,thetrialcourtmodifiedthedefendantssentencetosixmonthsconfinementwiththeremaindersuspended. Uponareviewoftherecord,webelievethatthetrialcourtcompliedwiththesentencingstatutes.SeeStatev.Troutman,979S.W.2d271,27499(7Tenn.71998)9999   ( whilethebetterpracticeistomakefindingsontherecordwhenfixingapercentageofadefendantssentencetobeservedinincarceration,atrialcourtneedonlyconsidertheprinciplesofsentencingandenhancementandmitigatingfactorsinordertocomplywiththelegislativemandatesofthemisdemeanorsentencingstatute).Therecordshowsthatthetrialcourtconsideredthedefendantslengthycriminalhistory,whichincludedninemisdemeanorconvictions.Thiscriminalhistorymorethanjustifiesthedefendantssentenceandthemannerinwhichitistobeserved.Webelievethatthedefendanthasfailedtodemonstrate99that9999thetrialcourtssentenceis99erroneous.9999 Inconsiderationoftheforegoingandtherecordasawhole,thejudgmentofconvictionisaffirmed.    h      p   __________________________    h      p   JosephM.Tipton,JudgeCONCUR:_________________________GaryR.Wade,PresidingJudge9988_________________________9999DavidH.Welles,Judge
