Oe   ` Adefendantwho isanespeciallymitigatedorstandardoffenderconvictedofa Oe   Oe   Oe   Oe   Oe   Oe   Oe   Oe   Oe   Oe   Oe   Oe   Oe   Oe   Oe   Oe   Oe   Oe   Oe   Oe   Oe   Oe   Oe   Oe   Oe   Oe   Oe   Oe   Oe   Oe   Oe   Oe   Oe   Oe   Oe   Oe   Oe   Oe   0948  Oe  ClassC,DorEfelonyispresumedtobeafavorablecandidateforalternativesentencing Oe   Oe  optionsintheabsenceofevidencetothecontrary.Tenn.CodeAnn.4035102(6).Our Oe  sentencinglawalsoprovidesthat convictedfelonscommittingthemostsevereoffenses,possessingcriminalhistoriesevincingacleardisregardforthelawsandmoralsofsociety,andevincingfailureofpasteffortsatrehabilitationshallbegivenfirstpriorityregardingsentencinginvolvingincarceration.Tenn.CodeAnn.4035102(5).Thus,adefendantsentencedtoeightyearsorlesswhoisnotanoffenderforwhomincarcerationisapriorityispresumedeligibleforalternativesentencing,unlesssufficientevidencerebutsthepresumption.However,theactdoesnotprovidethatalloffenderswhomeetthecriteriaareentitledtosuchrelief;rather,itrequiresthatsentencingissuesbedeterminedbythefactsandcircumstancespresentedineachcase.SeeStatev.Taylor,744S.W.2d919, % 922(Tenn.Crim.App.1987). ` Additionally,theprinciplesofsentencingreflectthatthesentenceshouldbenogreaterthanthatdeservedfortheoffensecommittedandshouldbetheleastseveremeasurenecessarytoachievethepurposesforwhichthesentenceisimposed.Tenn.CodeAnn.4035103(4).Thecourtshouldalsoconsiderthepotentialforrehabilitationortreatmentofthedefendantindeterminingthesentencealternative.Tenn.CodeAnn.4035103(5). ` Inthisappeal,thedefendantasksthisCourttoreversethejudgmentofthetrialcourtandremandthiscaseforanalternativesentenceofcommunitycorrections.Thestate,citingthedefendantscriminalhistory,insiststhedefendantisnotentitledtocommunitycorrectionsandtodosowouldonlyservetofurtherdepreciatetheseriousnessofthedefendantscrime. ` SincethedefendantisaClassCoffender,heispresumedtobeafavorablecandidateforanalternativesentence,subjecttorebuttalbycasefactsandcircumstances. 726 SeeStatev.Hartley,818S.W.2d370,373(Tenn.Crim.App.),per.app.denied(Tenn. 848 1991).Criteriaastowhatwillconstitute evidencetothecontraryunderTenn.CodeAnn. 848 4035102(6)isfoundinTenn.CodeAnn.4035103(1).Whenthestateseekstotalconfinement,thetrialcourt,inconsideringconfinement,mustbaseitsconsiderationson:(1)confinementisnecessarytoprotectsocietybyrestrainingadefendantwhohasalonghistoryofcriminalconduct;(2)confinementisnecessarytoavoiddepreciatingtheseriousnessoftheoffenseorconfinementisparticularlysuitedtoprovideaneffectivedeterrencetootherslikelytocommitsimilaroffenses;and(3)measureslessrestrictivethanconfinementhavefrequentlyorrecentlybeenappliedunsuccessfullytothedefendant.Tenn.CodeAnn.4035103(1)(A)(C). ` Fromourreviewoftherecord,thetrialcourtdidnotfullycomplywiththesentencingprinciplesasrequired.SeeAshby,823S.W.2dat169.Ourreviewiswithouta  presumptionofcorrectness,thuswemustconsidertherequirementsofTenn.CodeAnn.4035102,103,210. ` Offendersmaybeconsideredforplacementinthecommunitycorrectionsprogramasanalternativesentencewhoare:'XXz hXX'8 ` 8 ` (#` (#(1)8z Personswho,withoutthisoption,wouldbe E$" incarceratedinacorrectionalinstitution;8 z z 8@ 5% #   8 ` 8 ` (#` (#(2)8z Personswhoareconvictedofpropertyrelated,or '"% drug/alcoholrelatedfelonyoffensesorotherfelonyoffensesnotinvolvingcrimesagainstthepersonasprovidedintitle39,Chapter13,parts15; z z  8 ` 8 ` (#` (#(5)8z Personswhodonotdemonstrateapresentorpast U2-1 patternofbehaviorindicatingviolence; z z  8 ` 8 ` (#` (#(6)8z Personswhodonotdemonstrateapatternof %504 committingviolentoffenses. z z  8 ` 8 ` (#` (#   Tenn.CodeAnn.4036106(a). 9p59 Ї ` Onthesurface,thedefendantappearstobeapropercandidateforconsiderationofplacementinacommunitycorrectionsprogram.Sincethedefendantelectednottotestify,itismostdifficulttodeterminethedefendantspotentialforrehabilitationortreatment.Therefore,wemustrelyonthefactsofthecaseandtheinformationcontainedinthepresentencereport.Thedefendant,atage25,isahighschooldropout,whohasneverbeenemployed.Heisadailyuserofcrackcocaineandmarijuana,andhasbeenunsuccessfulwithdrugcounselingatWesternMentalHealthInstitute.Thedefendantscriminalhistoryconsistsofmisdemeanorconvictions,withprobationinthreecasesbetween1992and1994.Thedefendanthasonepriormisdemeanorcocaineconviction. ` TennesseeCodeAnnotated4036106(c)givessomeguidanceastochronicdrugoffenders:8 ` 8 ` (#` (#Felonyoffendersnototherwiseeligibleundersubsection(a),andwhowouldbeusuallyconsideredunfitforprobationduetohistoriesofchronicalcohol,drugabuse,ormentalhealthproblems,butwhosespecialneedsaretreatableandcouldbeservedbestinthecommunityratherthaninacorrectionalinstitution,maybeconsideredeligibleforpunishmentinthecommunityundertheprovisionsofthischapter.   : ` Onremand,weinstructthetrialcourttoplacethedefendantinacommunitycorrectionsprogram.Wesuggest,forthedefendantsrehabilitativeneeds,thatheshouldbeconfinedforaminimumoftenmonthsintheHardemanCountyJailasanappropriateconditionofplacementinthecommunitycorrectionsprogram,astrictrehabilitationprogramwithmandatorydrugscreens,amandatoryemploymentprogramorjobtraining,andsuchotherconditionsthetrialcourtfindsreasonable. ` Thetrialcourtsjudgmentisreversedandremandedforanewsentencinghearing.
