àAt€the€guilty€plea€hearing,€Petitioner€stated€that€he€had€read€andÏunderstood€the€request€to€plead€guilty€form.€€When€the€trial€court€asked€PetitionerÏwhether€he€had€discussed€the€charges€against€him€with€his€counsel,€PetitionerÏstated€that€he€had.€€When€the€trial€court€asked€Petitioner€whether€he€understoodÏthat€the€total€sentence€could€be€anywhere€between€eight€and€thirty€years,ÏPetitioner€stated€that€he€did.€€The€trial€court€then€advised€Petitioner€that€he€hadÏthe€right€to€plead€not€guilty€and€insist€on€a€jury€trial,€that€he€had€the€right€to€beÏrepresented€at€trial,€that€he€had€the€right€to€confront€the€witnesses€against€him,Ð \8ü.0 Ðthat€he€had€the€right€to€subpoena€witnesses€on€his€behalf,€that€he€had€a€privilegeÏagainst€self„incrimination,€that€he€had€the€right€to€appeal€if€he€was€convicted€atÏtrial,€that€he€had€the€right€to€counsel€on€appeal,€and€that€his€convictions€in€thisÏcase€could€be€used€to€enhance€punishment€in€subsequent€cases.€€AfterÏexplaining€each€right,€the€trial€court€asked€Petitioner€whether€he€understood€theÏœright,›€and€Petitioner€stated€that€he€did.€ÌÌà àAfter€the€trial€court€explained€Petitionerððs€rights,€the€court€asked€PetitionerÏwhether€he€had€been€taking€any€medication€or€drugs€that€would€affect€hisÏdecision€making.€€Petitioner€stated€that€he€had€not.€€The€trial€court€then€askedÏPetitioner€whether€he€had€been€forced,€coerced,€or€threatened€into€pleadingÏguilty€and€Petitioner€stated€that€he€had€not.€€The€trial€court€then€asked€PetitionerÏwhether€the€decision€to€plead€guilty€was€his€œown,›€and€Petitioner€stated€that€it€was.€ÏIn€addition,€the€trial€court€asked€Petitioner€whether€he€had€discussed€the€matterÏwith€his€counsel€and€whether€he€was€satisfied€with€the€work€of€his€counsel.€ÏPetitioner€indicated€that€he€had€discussed€the€matter€with€his€counsel€and€thatÏhe€was€satisfied€with€his€counselððs€performance.€ÌÌà àRichard€Mabee,€Petitionerððs€trial€counsel,€testified€at€the€post„convictionÏhearing€that€he€had€told€Petitioner€that€he€had€the€right€to€insist€on€a€trial€and€ifÏhe€did€so,€he€would€be€represented€by€counsel.€€Mabee€testified€that€although€heÏdid€not€specifically€remember€what€he€had€done€in€this€case,€he€always€told€everyÏclient€everything€he€knew€about€the€Stateððs€case,€what€the€proof€might€be,€andÏwhat€the€possible€defenses€were€œand›€then€gave€the€client€the€option€of€whetherÏto€insist€on€a€trial.€ÌÐ àMabee€testified€that€he€had€advised€Petitioner€that€if€he€went€to€trial,€heÏfaced€the€possibility€of€being€convicted,€of€being€sentenced€in€a€higher€œrange,€›andÏof€receiving€a€higher€sentence€than€the€State€had€offered€in€the€plea€agreement.€ÏMabee€also€testified€that€he€had€explained€the€plea€agreement€to€Petitioner€andÏœbelieved›€that€Petitioner€had€understood€the€explanation.€ÌÌà ` àMabee€denied€telling€Petitioner€that€if€he€insisted€on€trial,€he€had€no€chanceÏof€winning.€€Mabee€also€denied€telling€Petitioner€that€if€he€went€to€trial,€he€wouldÏlikely€receive€a€sixty€year€sentence.€€In€addition,€Mabee€denied€that€he€refusedÏto€show€Petitioner€certain€discovery€materials€when€Petitioner€asked€to€see€them.€ÌÌà ` àPetitioner€testified€that€before€he€pled€guilty,€he€had€asked€Mabee€to€showÏhim€various€materials€obtained€during€discovery€and€Mabee€had€stated€that€heÏdid€not€need€to€see€them.€€Petitioner€testified€that€even€though€he€knew€that€heÏhad€the€right€to€insist€on€a€trial,€he€had€decided€to€plead€guilty€because€MabeeÏhad€told€him€that€he€had€no€possibility€of€winning€and€that€he€would€receive€aÏsentence€of€sixty€years.€€Petitioner€also€testified€that€to€the€best€of€his€knowledge,ÏMabee€had€never€investigated€his€case.€ÌÌà ` àPetitioner€testified€that€when€he€entered€his€guilty€plea,€he€understoodÏeverything€that€happened€and€he€understood€the€judgeððs€questions.€€PetitionerÏtestified€that€he€lied€to€the€judge€when€he€answered€the€questions€because€he€feltÏthat€Mabee€was€providing€inadequate€representation€œandñMñ€MabeeñMñ›€would€continue€toÏprovide€inadequate€representation€if€the€case€went€to€trial.€Ìâ âÐ à7€.0 Ðà ` àOn€cross„examination,€Petitioner€admitted€that€he€had€pled€guilty€to€otherÏâ âoffenses€in€the€past.€€Petitioner€also€admitted€that€before€he€pled€guilty,€he€hadÏrefused€a€previous€plea€offer€and€insisted€that€the€case€be€set€for€trial€and€MabeeÏhad€complied€with€his€request.ÌÌà ` àWhen€the€post„conviction€court€questioned€Petitioner€about€why€he€hadÏpled€guilty,€Petitioner€œstatedñNñ:ñNñ›ÌÓÓà0 ` àI€just€wanted€to€cop€out€for€the€eight€and€just€say€forget€it€because€I€wasÏtired€of€going€back€and€forwards€and€staying€at€the€county€jail,€so€I€justÏwanted€to€get€me€some€air.€€I€just€went€and€pled€guilty€for€it.€€NobodyÏpressured€me€into€it.€€I€just€pleaded€guilty€just€to€get€out€[of]€the€county€jail.€Ð ` T$` T$ ÐÌÓ1#ÓWhen€the€post„conviction€court€asked€Petitioner€whether€he€had€ð ðtold€[the€trialÏcourt]€just€a€bunch€of€lies€so€you€could€get€out€of€the€county€jail,ðð€Petitioner€statedÏœthat€that›€was€what€he€had€done.€ÌÌà ` àAt€the€conclusion€of€the€hearing,€the€post„conviction€court€found€that€thereÏwas€absolutely€no€evidence€to€substantiate€Petitionerððs€claim€that€he€receivedÏineffective€assistance€of€counsel.€€In€addition,€the€court€found€that€PetitionerððsÏguilty€pleas€were€entered€voluntarily,€knowingly,€and€intelligently.€€Finally,€theÏcourt€found€that€Petitionerððs€testimony€as€to€Mabeeððs€performance€was€simply€notÏcredible.ÌÌà@„„!®àò àWhen€a€petitioner€seeks€post-conviction€relief€on€the€basis€of€ineffectiveÏassistance€of€counsel,€the€petitioner€bears€the€burden€of€showing€that€(a)€theÏservices€rendered€by€trial€counsel€were€deficient€and€(b)€the€deficientÏperformance€was€prejudicial.€€òòPowers€v.€Stateóó,€942€œS.W.2d›€551,€558€(Tenn.€œCrim›.Ð 0Ð МApp›.€1996).€€In€order€to€demonstrate€deficient€performance,€the€petitioner€mustÏshow€that€the€services€rendered€or€the€œadviñOñsñOññPñcñPñe›€given€was€below€ð Ðweight€and€value€to€be€given€their€testimony€are€for€resolution€by€theÏpost-conviction€court.ðð€€€òòBates€v.€Stateóó,€973€œS.W.2d›€615,€631€(Tenn.€œCrim›.€œApp›.Ð 2°(* Ð1997).ÌÌà ` àPetitioner€contends€that€he€received€ineffective€assistance€of€counselÏbecause€Mabee€failed€to€investigate€this€case€by€interviewing€witnesses€andÐ Ð9p02 Ðbecause€Mabee€failed€to€show€the€discovery€materials€to€Petitioner€when€heÏasked€to€see€them.€€The€post„conviction€court€found€that€Petitioner€had€failed€toÏproduce€any€evidence€that€supported€these€claims.€€The€record€supports€theÏpost„conviction€courtððs€findings.€€Indeed,€Mabee€testified€that€he€had€filedÏdiscovery€requests€in€this€case€and€he€had€also€talked€to€the€prosecutor€toÏdetermine€what€the€proof€would€be€and€who€would€testify€at€trial.€€Mabee€testifiedÏthat€although€he€could€not€specifically€recall€whether€he€or€his€investigators€hadÏinterviewed€witnesses€in€this€case,€his€standard€procedure€in€cases€where€aÏwitness€was€equivocal€about€an€identification€of€the€defendant€would€involve€anÏattempt€to€locate€and€interview€the€witness.€€Further,€Mabee€expressly€deniedÏthat€he€had€ever€refused€to€honor€Petitionerððs€request€to€see€items€obtainedÏduring€discovery.€€Finally,€when€the€trial€court€asked€Petitioner€during€the€guiltyÏplea€hearing€whether€he€was€satisfied€with€Mabeeððs€performance,€PetitionerÏstated€that€he€was.€ÌÌà ` àThe€Petitioner€has€failed€to€support€his€allegations€that€he€receivedÏineffective€assistance€of€counsel€with€any€evidence€other€than€his€own€self„¼serving€testimony€œñQñthatñQññRñwhichñRñ›€the€post„conviction€court€found€was€simply€not€credible.€ÏœñSñÔ‡ àWe€have€reviewed€the€transcript€of€Petitionerððs€post„conviction€hearing,Ïand€the€transcript€fails€to€reflect€that€these€events€ever€happened.€€Quite€simply,Ïthere€is€no€indication€in€the€record€that€the€post„conviction€judge€had€anyÏsubjective€or€objective€bias€or€prejudice€against€Petitioner.€€On€the€contrary,€theÏrecord€indicates€that€rather€than€dismissing€the€petition€for€post„conviction€reliefÏbecause€he€was€biased€against€Petitioner,€the€post„conviction€judge€dismissedÏthe€petition€because€it€had€no€merit€whatsoever.€€This€issue€has€no€merit.ÌÌà
