Thepartiesstipulatedtothefollowingfactsduringtheguiltypleahearing.Thepetitionerssisterbecamepregnantbythevictim,andthecoupleintendedtomarry.OnMarch1,1993,thepetitionerssisterandthevictimvisitedherparentsresidence,asmallmobilehome.Thepetitioner,whohadbeendrinkingbeerthroughouttheday,arrivedattheresidenceafterdinnerandaskedtospeakwiththevictim.Theybeganarguing,promptingthepetitionersmothertotellthepetitionertoleavethevictimalone.Thepetitionerdidnot,confrontingthevictim.Thepetitionersmotherattemptedtokeepthepetitionerawayfromthevictimwhilethepetitionerssisterstoodnearthevictim.Theconfrontationescalated,culminatinginthepetitionerpullingoutasemiautomaticpistolandfiringfivebullets.Twoofthebulletshitthevictim,oneinhisheadandoneinhisupperrightarm.Thepetitionerwasarrestedashortwhilelater,atwhichtimeherepeatedlyadmittedheshotthevictim.InFebruary1994,thepetitionerpledguiltytoseconddegreemurder. XضXXX  InreviewingthepetitionersSixthAmendmentclaimofineffective 6&-0 assistanceofcounsel,thisCourtmustdeterminewhethertheadvicegivenorservices 6&-2 renderedbytheattorneyarewithintherangeofcompetencedemandedofattorneysincriminalcases.Baxterv.Rose,523S.W.2d930,936(Tenn.1975).Toprevailona ,  claimofineffectivecounsel,apetitioner mustshowthatcounselsrepresentationfellbelowanobjectivestandardofreasonablenessandthatthisperformanceprejudicedthedefense.Theremustbeareasonableprobabilitythatbutforcounselserrortheresultoftheproceedingwouldhavebeendifferent.Stricklandv.Washington,466U.S.668, \  68788,692,694(1984);Bestv.State,708S.W.2d421,422(Tenn.Crim.App.1985). (  Becausethepetitionerherepledguilty,inordertosatisfytherequirementofprejudice,#X_XX X_x# X_XXX_   hemustdemonstrateareasonableprobabilitythatbutforcounselserrors,hewouldnothavepledguiltyandwouldhaveinsistedonatrial.SeeHillv.Lockart,474U.S.52,59 , (1985);Bankstonv.State,815S.W.2d213,215(Tenn.Crim.App.1991).#X_XX X_# X   Inarguingthathistrialattorneywasineffective,thepetitionercomplainshisattorneyfailedtointerviewhistwonephewswhowitnessedthecrimeandfailedtointerviewhismother,anotherwitnesstothecrime,morethanonce,eventhough,heclaims,shehadthebestviewoftheshooting.Therecordshowsthatthetrialattorneyinterviewedthethreeadulteyewitnessestotheshootingthepetitioner,hismother,andhissisterandthatbecausethey gaveprettymuchanidenticalsetoffactsastowhathappened,   X_XXX_  1      ׀theattorneybelieveditwasunnecessarytointerviewthepetitionerstwelve )X $ andthirteenyearoldnephews.Thepetitionerpresentednoevidenceofthenephewspotentialtestimonyorofwhatinformationanadditionalinterviewwithhismotherwouldhavegleanedvbeenreveakedealed.Becauseofthis,hehasnotshownprejudiceandthusisnotentitledtopostconvictionreliefonthesegrounds.Blackv.State,794S.W.2d752,75758(Tenn. 0', Crim.App.1990). 4 +0   Thepetitioneralsocomplainsthathistrialattorneywasineffectivebecausehenevervisitedthesceneofthecrime,butheadmits, ItisdifficulttospeculatewhatcouldhavebeengainedfromvisitingthePurkeyhome....Thepetitionersadmissionmakesclearhehasfailedtoshowprejudice.Likewise,thepetitionersapparentcomplaintthathistrialattorneyonlytalkedwithhimontwooccasionswillnotaffordhimreliefbecauseevenassumingitistrue,hemakesnoshowingofhowthisprejudicedhim.  Moreover,thepetitionercomplainsthathisattorneyfailedtoexplorethepossibilitythattheshootingmayhavebeenanaccidentbaseduponhismotherstestimonythatwhenhebeganfiringthegun,herhandwasonhisarmandhewasnotpointingtheguninthevictimsdirection.Thepetitionersmotheralsotestified,however,thatanargumentbetweenthepetitionerandthevictimledtotheshooting,thatthepetitionerfiredthegunfivetimesatacloserangeinasmallenclosedspace,andthatatleasttwobulletshitthevictim.Thetrialattorneytestifiedthatgiventhesecircumstances,theonlypossibledefensewouldhavebeenincompetencyorstateofmindatthetimeoftheshooting.Therecordsupportsthisstrategicdecisionbycounsel.Becausecounselsstrategicchoicenottoclaimaccidentalshootingasapossibledefensewasinformedandnotduetoinadequatepreparation,thepetitionersargumentwillnotaffordhimrelief.SeeHellardv.State,629S.W.2d4,9(Tenn.1982). )X $   Further,thepetitionerattemptstofaulthistrialattorneyforfailingtopursuetheissueofincompetenceatthetimeoftheoffenseandforfailingtoadequatelypursuetheissueofhiscompetenceatthetimehepledguilty.Thepetitionerclaimshisattorneysactions hadanadverseeffectonhisdefense,yettherecordcontainsnoevidencehewasincompetentatthetimeoftheoffenseorwhenhepledguilty.Infact,therecordrevealsonlythatfollowingapsychiatricevaluationinJuly1993,thepetitioner L6,2 wasfoundtohavebeencompetentatthetimeoftheoffenseandthatanotherpsychiatricevaluationconductedbythedefenseretainedpsychologistthedaypriortotheguiltypleahearingresultedintheconclusionthatthepetitionerwascompetenttoassistinhisdefense,participateinpleanegotiations,andstandtrial.Becauseofthis,thepostconvictioncourtspecificallyfoundthatthepetitionerwascompetentatthetimehecommittedtheoffenseandatthetimehepledguilty.Thereisnoevidenceintherecordtosuggestotherwise.Becausetherecorddoesnotcontainevidenceofincompetencyeitheratthetimeoftheoffenseoratthetimethepetitionerpledguilty,thepetitionerhasnotshownprejudiceandthereforeisnotentitledtopostconvictionrelief.  Inhissecondissue,thepetitionerclaimsthatthepostconvictioncourterredinfailingtofindthathewasincompetentbothatthetimeoftheoffenseandatthetimehepledguilty.Withregardtocompetencyatthetimehepledguilty,itappearsthepetitionerisarguingthatthetrialcourterredinacceptinghisguiltyplea,i.e.,thathisguiltypleawasnotknowinglyandvoluntarilygivenduetohissupposedincompetency.Again,wefindnoevidenceintherecordtosupportthepetitionersclaimhewasincompetentatthetimehepledguilty,andinfact,allevidenceindicateshewascompetent.Becausethepetitionerhasnotshownthathisguiltypleawasunknowinglyandinvoluntarilygiven,hisargumentmustfail.񀛀  Withregardtocompetencyatthetimeoftheoffense,weagainnotethatthereisnoevidenceintherecordtosupportthepetitionersclaimhewasincompetentwhenhekilledthevictim,butonlyevidencetothecontrary,i.e.,thathewascompetentatthetimeoftheoffense.Evenso,becausetherecordshowsthepetitionerknowinglyandvoluntarilypledguilty,hewaivedallnonjurisdictionaldefenses,includinginsanity.See,e.g.,Rayv.State,480S.W.2d919,920(Tenn.Crim.App.1972).Accordingly,the L6,2 petitionersargumentsmustfail.
