OnSeptember25,1986,thepetitionerwasconvictedofgrandlarcenyinCockeCountyandreceivedatenyearsentence.Becausehewasfoundtobeahabitualcriminal,hissentencewasenhancedtoatermoflifeinprison.Defensecounselfiledamotionforanewtrialbutthemotionwasdismissedbecausethepetitionerescapedfromcustodyafterhisconviction.Noappealwastaken.Ralph X DeanPurkeyv.State,No.03C019607CC00257,slipop.at2(Tenn.Crim.App., $ atKnoxville,Oct.8,1997).Thepetitionerwaseventuallyapprehended  and,afterward,    filednumerouspetitionsforpostconvictionrelief,allofwhichweredismissedastimebarred.Seeid.(rulingthatthethirdpetitionwasbarredbythe "( statuteoflimitations).  OnMay29,1998,thepetitionerfiledthispetitionforwritofhabeascorpusallegingthathisconvictionswereobtainedasaresultofviolationsoftheTennesseeandUnitedStatesConstitutions.Hecontendedthathisconvictionforgrandlarcenyover$200.00isvoidbecauseitisbasedoninsufficientevidence.Thepetitionerarguedthatthevictimtestifiedattrialtoalossincashandfoodstampstotalingonly$150.00,lessthanthe$200.00minimumrequiredatthattimetosupportagrandlarcenyconviction.Thepetitionerpointsoutthatthepresentencereport,whichincludesthevictim'sstatement,documentsalossofonly"$150.00incashandfoodstampsasaresultofthisoffense." 8.4   Thetrialcourtobservedthatthepetitionwouldhavebeenbarredbythestatuteoflimitationshadthepetitionersoughtpostconvictionreliefandruledthathabeascorpusreliefwasnotwarrantedbecausethepetitionerwasunabletoestablishthathistermofimprisonmenthadexpiredorthatthejudgmentwasfaciallyinvalid.Inthisappeal,thepetitionercomplainsthattherewasinsufficientevidencetosupportaconvictionofgrandlarcenyinanamountover$200.00andtheenhancementofthesentencetoatermoflifeduetohabitualcriminalitywas,therefore,improper.  Inthisstate,awritofhabeascorpusmaybegrantedonlywhenapetitionerhasestablishedlackofjurisdictionfortheorderofconfinementorthatheisotherwiseentitledtoimmediatereleasebecauseoftheexpirationofhissentence.SeeUsseryv.Avery,432S.W.2d656(Tenn.1968);Stateexrel.Wadev.Norvell,  443S.W.2d839(Tenn.Crim.App.1969).A"personimprisonedorrestrainedofhisliberty,underanypretensewhatsoever,...mayprosecuteawritofhabeascorpus,toinquireintothecauseofsuchimprisonment...."Tenn.CodeAnn.2921101.Thewritofhabeascorpus,however,isavailableonlywhenitappearsonthefaceofthejudgmentortherecordthatthetrialcourtwaswithoutjurisdictiontoconvictorsentencethedefendantorthatthesentenceofimprisonmenthasotherwiseexpired.Archerv.State,851S.W.2d157,164(Tenn.1993);Pottsv.State,833S.W.2d60, +$"& 62(Tenn.1992).  InJohnWayneSlatev.State,No.03C019201CR00014(Tenn. 0', Crim.App.,atKnoxville,Apr.2,1994),  a    panelofthiscourtgrantedpostconvictionreliefbaseduponinsufficientevidenceof  deliberation,an      essentialelement    offirstdegreemurder.Becausetheinsufficiencyqualifiedasaviolationofdueprocess,theconvictionwasdeclared  constitutionally"void"    andwasmodifiedtosecond 8.4 degreemurder.OnOctober21,1994,oursupremecourtdeniedapplicationforpermissiontoappeal,  yetconcurred    inresults  only.TherulinginSlatewasbased ,  uponthedecisionoftheUnitedStatesSupremeCourtinJackson    v.Virginia,443   U.S.307,99S.Ct.2781  (1979).InJackson,a      federalhabeas    corpuscase,the d SupremeCourtruledthatdueprocessoflawisviolatedwhenaconvictionresultsfromevidencewhichisinsufficientunderthereasonabledoubtstandard.443U.S.at31718,99S.Ct.at2788.Thehighcourtheldthatfederalhabeascorpusreliefisavailable"ifitisfoundthatupontherecordevidenceadducedatthetrialnorationaltrieroffactcouldhavefoundproofofguiltbeyondareasonabledoubt."443U.S.at324,99S.Ct.at279192.    .  Atthetimeofthisoffense,petit  larceny,thendefinedasatheftoflessthan$200.00,was    notamongthoselistedoffenseswhichwouldtriggeralifesentencebaseduponhabitualcriminality.SeeTenn.CodeAnn.391801(1982).  \ Basically,thepetitionercontendsthattheevidenceathistrialwasinsufficienttosupportaconvictionofgrandlarceny.Certainly,thepresentencereportandaportionofthetranscriptprovidedbythepetitionerandincludedinthisrecordsuggeststhattherestitutionorderedwaslessthan  $200.00,anindicationatleastthatthevalueofthestolenitemswaslessthanthe$200.00threshold.        An    exhibitpresentedfromthesentencinghearingestablishesthatcounselforthedefenseobjectedwhenawitnesstestifiedthattheamountofmoneyandfoodstampsapproximated$150.00.Atthatpoint,thetrial  judge    observedasfollows:8 8 (# (#Sheisestimatingunder$200.00[.]Idon'tknowwhyyouwouldobject.Lettherecordshowyouobject,andIoverrule.     Ourinferencefromthisisthatthetrialcourtobservedthatthepetitioner'scounsel 8.4 couldhardlycomplainsincetherequestforrestitutionwasforanamountlessthanthatestablishedattrial.Thestatement,of    course,  wasmade    afterthejuryhadreturnedaverdictofguiltunderthe  petitlarcenyindictment.        A    transcriptionofthetrialisnotincludedinthislimitedrecord.Theburdenisalwaysontheappellanttosupplyanadequaterecordonappealforadeterminationoftheissuespresented.  Withoutthetrialrecord,itwouldbeimpossibletodeterminewhethertheevidencewassufficient.Inconsequence,this    courtmustpresumethatthetrialcourtcorrectlyruled.Smithv.State,589S.W.2d ` 811(Tenn.Crim.App.1979);Vermilyev.State,584S.W.2d226(Tenn.Crim.App. , 1979).   Habeas    corpusreliefundertheTennesseestatuteislimited.  Inseveralcases,it    hasbeenheldthataclaimofinsufficientevidencedoesnotfallwithinthedefinitionoffacialvalidity.
