Memphis,TN38103                   OPINIONFILED:____________________ AFFIRMED JOHNH.PEAY, Judgeǜ `   @ OPINION     Thepetitionerwasconvictedbyajuryofseconddegreemurderandattemptedfirstdegreemurder,fromwhichnoappealwasperfected.Hehasfiledthispetitionforpostconvictionreliefallegingthathereceivedineffectiveassistanceofcounselbecausehislawyerfailedtofileanappealonhisbehalf.Afterahearing,thecourtbelowdeniedrelief.Afterreviewingtherecord,weaffirmthejudgmentbelow.  ThepetitionerwassentencedonNovember10,1994.HismotionfornewtrialwasheardandoverruledonDecember2,1994.Itisundisputedthat,onoraboutDecember17,1994,thepetitionertoldhislawyer,inperson,thathedidnotwanttoappealhisconviction.Thepetitionertestifiedatthehearingthattwoorthreedayslaterhecalledhismother,whointurnconferencedinthepetitionerslawyeronathreewaycall,andhetheninformedhislawyerthathedidwanttoappealhiscase.Thepetitionersmotheralsotestifiedtothesameeffect,althoughshewasuncertainastowhetherthethreewaycalloccurredbeforeorafterChristmas.  Thepetitionerslawyertestifiedthat,aftertheDecember17visitwithhisclient,hehadnofurthercontactwiththepetitioneraboutanappealuntilMay1995.OnMay12,1995,hetestified,thepetitionersmothercalledhimandtoldhimthathersonwantedtoappealhisconviction.Hespecificallystated, Nobodyindicatedthattheywantedtoappealatatimewhentheappealwouldha[ve]beentimelyasfarasmyrecordsandasfarasmyrecollectionis.Headmittedthathehadnothadthepetitionersignawaiverwithrespecttohisrighttoappeal.Thecourtbelow,inlookingatthefile jacket,statedontherecordthatitcontainedthenotationthat,onJanuary3,1995, AttorneyBallcalled,saiddefendantwasntgoingtoappealcase.  Thecourtbelowweighedthedifferingtestimonyandconcludedthat, basedontheproofhere...[thepetitioner]didwaivehisrighttoappealandnowcomeslateranddecidestochangehismind,butitisway,wayto[o]lateforthat.AndtheCourtwilldenythedelayedappeal.  Wefirstnotethat Counselforalldefendants...whohavearighttoappealfromajudgmentofconviction,shalleithertimelyfilesuchnoticeofappealorfilewiththeclerkduringthetimewithinwhichthenoticeofappealcouldhavebeenfiled,awrittenwaiverofappealsignedbythedefendant.Tenn.R.CrimP.37(d).Failuretoconformtothisruledoesnot,however,violateaconstitutionalright.AllenWilsonv.State,No.03C019307CR00204,KnoxCounty(Tenn.Crim.App.filedNov.9,1994,atKnoxville).Accordingly,thepetitionerslawyersfailuretofileawrittenwaiverofappealdoesnot,inandofitself,presentagroundforreliefwhichiscognizableinthispostconvictionproceeding.Id.  Hadthepetitionerslawyerfailedtoproperlyperfectanappealafterhavingbeeninstructedtodoso,thepetitionerwouldbeentitledtoreliefonthegroundsofineffectiveassistanceofcounsel.See,e.g.,RickyAllenBowlingv.State,No.1091,KnoxCounty(Tenn.Crim.App.filedFeb.3,1987,atKnoxville);Stateexrel.Greenv.Henderson,421S.W.2d86,87(Tenn.1967).However,thecourtbelowmadeaspecificfactualfinding,afterhavingconductedanevidentiaryhearing,thattrialcounselhadbeentoldthathisclientdidnotdesireanappeal,andthatnocontradictoryinstructionswerereceiveduntillongafterthedateforfilinganappealhadpassed.Thisfactualfindingisconclusiveonappealunlesstheevidencepreponderatesagainstthejudgment.Statev.Buford,666S.W.2d473,475(Tenn.Crim.App.1983).Here,theevidencedoesnotdoso.Accordingly,weaffirmthejudgmentbelow.       ______________________________       JOHNH.PEAY,Judge̛̜̜CONCUR: ̜______________________________JOEB.JONES,Judge̜______________________________JOEG.%  RILEY,Judge
