InStatev.Winsett,882S.W.2d806(Tenn.Crim.App.1993),nowJusticeA.A.Birchdiscussedappropriateproceduresforpretrialdiversion.Theopinionindicatesthatallofthematerialsconsideredbytheprosecutoraretobefiledwiththetrialcourtbyadefendantwiththedefendantspetitionforwritofcertiorari.Id.at810.Inthisrespect,Winsettindicatesthatthetrialcourtmaydecidethecauseuponreceiptofthepetitionandtheattachedrecord,ifanevidentiaryhearingisunnecessary.IbelievetheWinsettprocedure 0   ׀wasbasicallyfollowedinthiscase. TheappellantspetitionismarkedfiledonApril17,1995,andstatesthathis petitiontoenterintoamemorandumofunderstandingwithaccompanyingmaterialsinsupportthereofhavebeenfiledwiththecourtandareincorporatedhereinbyreference,andthattheprosecutorsdenialletterwasincorporatedbyreferenceandattachedtothepetition.Thetrialcourtclerkcertifiedthattherecordonappealcontainedallthepapersfiledinthetrialcourtinthiscase.Thetranscriptoftheargumentsofcounselandcommentsbythetrialcourtreflectthatthetrialcourtwasconsideringthetrialcourtrecordbeforeit.
