Whenaprobationrevocationischallenged,theappellatecourtshavealimitedscopeofreview.Ifthetrialjudgefindsbyapreponderanceoftheevidence"thatthedefendanthasviolatedtheconditionsofhisprobation,"probationmayberevoked.Tenn.CodeAnn.4035311(d).Thisdecisiontorevokeasuspendedsentencerestsinthesounddiscretionofthetrialcourt.TheSentencingCommissionCommentstoSection4035310providethat"[u]ponrevocation,theoriginalsentenceimposedcanbeplacedintoeffect."Thedeterminationbythetrialcourt,ifconscientiouslymade,isentitledtoanaffirmance;therecordmustmerelydemonstratethatthereissubstantialevidencetosupportitsconclusions.Statev.Delp,614S.W.2d395,398(Tenn.Crim.App.1980);seealsoStatev.Williamson,619S.W.2d145,147(Tenn.Crim.App.1981).Onappeal,thefindingsofthetrialcourtareentitledtotheweightofajuryverdict,andtheappellanthastheburdentodemonstratethattherecordcontainsnosubstantialevidencetosupportthefindingofthetrialcourtthataviolationoftheconditionsofprobationhasoccurred.Statev.Wall,909S.W.2d8,910(Tenn.Crim.App.1994);Statev.Harkins,811S.W.2d79,82(Tenn.1991).Uponaviolationofthetermsofprobation,"thetrialjudgeshallhavetherightbyorderdulyenteredupontheminutesof[the]court,torevoketheprobationandsuspensionofsentenceandcausethedefendanttocommencetheexecutionofthejudgmentasoriginallyentered,orotherwiseinaccordancewith4035310...."Tenn.CodeAnn.4035311(d).  Inourview,thetrialcourtdidnotabuseitsdiscretionwhenitrevokedtheappellant'sprobationandorderedhisincarceration.Therecordsupportsthetrialcourt'sfindingsthatthedefendanthadnotcompliedwiththetermsofhisprobationby(1)failingtopayfeeswhenemployed;(2)failingtopaycourtcostswhenemployed;(3)failingtoattendrequiredAAmeetings;and(4)failingtoperformhisrequiredcommunityservice.Thetrialcourtdidnotconsiderthedefendant'spendingchargesasabasisfortherevocation.  %  Accordingly,thejudgmentofthetrialcourtisaffirmedpursuanttoRule20oftheTennesseeCourtofCriminalAppeals.
