Thepetitionerallegesthatthetrialcourtsentencedhimunderthe1989SentencingReformAct,whichexposedhimtoarangeofeighttotwelveyears,butfailedtodetermineanappropriatesentenceunderthelawexistingatthetimeoftheoffense,whichexposedhimtoarangeoffivetotwentyyears.SeeStatev.Pearson,858S.W.2d879(Tenn.1993).Indismissingthepetition,thetrialcourtstatedthatthetenyearsentenceactuallyimposedwaswithintherangeofexposureforbothactsandwas,therefore,notillegal.Itstatedthatthewritofhabeascorpusmaynotbeusedasasubstituteforanappeal. Whenapetitionerisbeingheldpursuanttoajudgmentofconviction,habeascorpusreliefisavailableonlywhenitcanbeshownthatthejudgmentisvoidorthesentenceofimprisonmenthasexpired.SeeArcherv.State,851S.W.2d157,164(Tenn.1993).Inthisrespect,beforeajudgmentcanbedeclaredtobevoid, thejudgmentitselfortherecordoftheproceedings,standingalone,mustshowawantofjurisdiction....Passarellav.State,891S.W.2d619,628n.49(Tenn.Crim.App.),app.denied(Tenn.1994).
