Weagreewiththetrialcourtsconclusionthatthepetitionfailstostategroundsforreliefthathavenotbeenpreviouslydetermined.Duringthehearingthatwasheldonhisfirstpostconvictionpetition,thepetitionerhadtheopportunitytobeheardonhisclaimsthathereceivedineffectiveassistanceofcounselandenteredaninvoluntaryplea.Attheconclusionofthathearing,thetrialcourtconcludedthatthepetitionerreceivedtheeffectiveassistanceofcounselandthathefreelyenteredavoluntaryplea.Thus,theclaimedgroundshavebeenpreviouslydetermined.SeeT.C.A.4030206(g). Insofarasthepetitionchallengestheactionsofthepetitionersattorneyandthetrialcourtduringthefirstpostconvictionproceeding,itdoesnotallegegroundsforpostconvictionrelief.PostconvictionreliefisavailableinTennesseewhenapetitionersconvictionorsentenceisvoidorvoidableduetotheabridgmentofaconstitutionalright.T.C.A.4030203.Thereisnoconstitutionalrighttotheeffectiveassistanceofpostconvictioncounsel.Pennsylvaniav.Finley,481U.S.551,55455,107S.Ct.1990,1993(1987);Housev.State,911S.W.2d705,712(Tenn.1995).Moreover,thepetitionercouldhavechallengedthetrialcourtsfindingsandconclusionsregardinghisfirstpetitionbyappealingtheinitialdenialofpostconvictionrelief. PursuanttoT.C.A.4030206,thetrialcourtwasobligatedtoreviewthepetitionanddismissitwithouthearingorappointmentofcounseliftheallegationsinthepetitionfailedtoshowthatanyclaimsforreliefhavenotbeenpreviouslywaivedordetermined.Aspreviouslynoted,theexactsameclaimsforreliefinthepresentpetitionwereraisedandlitigatedthroughanevidentiaryhearinginthedefendantsfirstpostconvictioncase.Underthesecircumstances,thetrialcourtwasobligatedtodismissthepetitionwithoutfurtheraction.
