àThe€appellant,€Susan€Reneau,€appeals€the€sentence€imposed€by€theÏBlount€County€Circuit€Court€upon€her€plea€of€guilty€to€the€offense€of€facilitation€ofÏrape,€a€class€C€felony.€€Pursuant€to€a€negotiated€plea,€the€appellant€received€aÏsentence€of€three€years€as€a€range€I€offender.€€The€manner€of€service€of€theÏsentence€was€submitted€to€the€trial€court€for€determination.€€Following€a€sentencingÏhearing,€the€trial€court€denied€any€form€of€alternative€sentence€and€imposed€aÏsentence€of€incarceration€in€the€Department€of€Correction.€€The€appellant€nowÏappeals€this€decision.ÌÌà àAfter€a€review€of€the€record,€we€reverse€the€judgment€of€the€trial€court.€€TheÏappellantððs€sentence€is€modified€to€reflect€a€sentence€of€probation.ÌÌÌà@ àò òI.€€BackgroundÌà àÌà àó óThe€facts€of€this€case€stem€from€the€conduct€of€the€appellant€in€permitting€herÏmentally€retarded€œthirteen„›€œyear€old›€daughter€to€cohabit,€over€a€three€œmonth›€period,Ïwith€a€twenty„nine€year€old€man.€€The€appellant,€during€this€period,€was€thirty„fiveÏyears€of€age€and€the€single€parent€of€four€teenage€children.€€The€victim€possessedÏthe€mental€capabilities€of€a€œseven„year›€old.€€The€appellant€received€various€socialÍsecurity€disability€and€AFDC€benefits€which€served€as€her€sole€source€of€income.€ÏThese€benefits€totaled€approximately€$900.00€per€month,€including€$382.00Ïreceived€on€behalf€of€the€victim.ÌÌà àThe€proof€at€the€sentencing€hearing€established€that,€between€March€andÏMay€of€1995,€the€appellant's€neighbor€introduced€the€victim€to€ChristopherÏBernstein,€who€was€twenty„nine€years€of€age.€€The€victim€and€Bernstein€beganÏdating,€secretly€meeting€at€this€neighbor's€residence,€until€the€appellant's€olderÏdaughter€informed€her€of€the€victim's€relationship.€€The€appellant€instructed€theÏvictim€to€end€her€involvement€with€Bernstein,€but€the€victim€continued€to€meet€withÏhim.€€At€this€point,€although€not€confirmed,€the€appellant€suspected€that€the€victimÏwas€having€sexual€relations€with€Bernstein.ÌÌà àSubsequently,€the€victim€informed€the€appellant€that€she€intended€to€moveÏinto€a€house€with€Bernstein€and€his€parents.€€The€appellant€"knew€[this€relationship]Ïwas€wrong€and€had€tried€to€talk€[the€victim]€out€of€doing€it,€but€[the€victim]€wentÏahead€and€did€it€anyway."€€The€appellant€explained€that,€because€she€was€afraid€ofÏlosing€custody€of€her€daughter,€she€did€not€seek€help€from€the€court€or€theÏDepartment€of€Human€Services€to€deal€with€her€daughter's€unruliness.€€Eventually,Ïthe€appellant€agreed€that€the€victim€could€live€with€Bernstein€and€his€parents€"untilÏschool€started€in€the€fall."€€Soon€thereafter,€the€victim€told€the€appellant€that€she€andÍBernstein€were€sharing€the€same€bed€and€that€she€was€pregnant.× ƒ& ××  ×€€On€two€moreÏoccasions,€the€appellant€attempted€to€persuade€her€daughter€to€return€home,€butÏthe€victim€refused.€€The€appellant€explained€that€"she€did€not€know€[her€actions]Ïwere€a€crime€or€illegal,€but€she€knew€it€wasn't€right."€€€€€€€ÌÌà àThe€appellant€has€no€prior€criminal€history€or€convictions.€€She€has€noÏrecord€of€drug€or€alcohol€abuse.× ƒ' ××  ×€€She€cooperated€with€the€Department€of€HumanÏServices€after€the€facts€of€this€case€were€developed.€€The€appellant€completed€theÏeighth€grade,€prematurely€terminating€her€education€to€care€for€her€two€youngerÏsiblings€while€her€mother€worked,€and€gave€birth€to€her€first€child€when€she€wasÏseventeen€years€old.€€œAt€the€time€of€the›€sentencing€hearing,€the€appellant€hadÏremarried.€Her€current€husband€œis›€employed€as€a€shoe€repairman.ÌÌà àThe€appellant€testified€that€three€of€her€children,€her€husband's€son,€and€twoÏgrandchildren€currently€reside€with€her€and€her€husband.€€She€has€no€behavioralÏproblems€with€these€children.€€After€the€victim's€relationship€with€Bernstein€wasÍrevealed€to€authorities,€the€victim€was€placed€in€a€foster€home,€where€she€remainsÏwith€her€baby.€€Expressing€remorse€over€her€actions,€the€appellant€avers€that€sheÏnever€intended€to€hurt€her€daughter.€€She€states€that,€despite€this€incident,€sheÏmaintains€a€healthy€and€happy€relationship€with€the€victim,€visiting€her€twice€aÏmonth€at€her€foster€home.€€The€appellant€also€has€completed€a€three€monthÏprogram€involving€counseling€and€parenting€classes€and€she€is€not€beingÏmonitored€by€the€Department€of€Human€Services€or€any€other€governmentalÏagency€regarding€the€care€of€her€children.€€Moreover,€she€stated€that€she€wouldÏabide€by€any€and€all€conditions€imposed€in€connection€with€an€alternativeÏsentence.ÌÌà àIn€denying€an€alternative€sentence,€the€trial€court€found€that€a€sentence€ofÏ"[c]onfinement€is€necessary€to€avoid€depreciating€the€seriousness€of€the€offense."€ÏHe€stated€thatÌÓÓà8 àI€just€can't€think€that€the€legislature€intended€for€a€mother€to€do€this€toÏtheir€child€and€not€be€punished€by€incarceration.€€There's€no€otherÏpunishment.€€I€mean,€her€child€has€been€removed,€but€having€aÏconviction€and€being€on€probation€is€no€punishment€to€this€lady.€€SheÏdoesn't€work.ÌÌÌÓÓAdditionally,€the€court€found€that€ÌÓÓà8 àher€potential€or€lack€of€potential€for€rehabilitation€or€treatment€isÏquestionable.€€What€needs€to€be€rehabilitated€is€questionable.€€AndÏhow€it€could€be€done€is€questionable.€€ÌÓÓÌò ờ̜œÌ›à@ àII.€€Analysisó óÌÌà àà àWhen€a€defendant€challenges€the€manner€of€service€of€her€sentence,Ïthis€court€must€conduct€a€òòde€novoóó€review€with€the€presumption€that€theÏdetermination€made€by€the€trial€court€is€correct.€€Tenn.€Code€Ann.€ðð€40„35„401(d)(1990).€€This€presumption€only€applies,€however,€if€the€record€shows€that€theÏtrial€court€properly€considered€relevant€sentencing€principles.€€òòState€v.€Ashbyóó,€823ÏS.W.2d€166,€169€(Tenn.€1991).€ÌÌà àIn€determining€the€appellant's€suitability€for€an€alternative€sentence,€we€firstÏdecide€whether€the€appellant€is€entitled€to€the€statutory€presumption€that€she€is€aÏfavorable€candidate€for€alternative€sentencing.€€òòState€v.€Binghamóó,€910€S.W.2d€448,Ï453€(Tenn.€Crim.€App.),€òòperm.€to€app.€denied€to€appeal€deniedóó,€(Tenn.€1995)€(citingÏòòState€v.€Bonestelóó,€871€S.W.2d€163,€167€(Tenn.€Crim.€App.€1993)).€€To€be€eligible€forÏthe€statutory€presumption,€a€defendant€must€meet€three€requirements.€€TheÏdefendant€must€be€convicted€of€a€class€C,€D,€or€E€felony.€€Tenn.€Code€Ann.€ðð€40„35„102(6)€(1994€Supp.).€€She€must€be€sentenced€as€a€mitigated€or€standardÏoffender.€€òòIdóó.€€And,€the€defendant€cannot€have€a€criminal€history€evincing€either€aÏ"clear€disregard€for€the€laws€and€morals€of€society"€or€"failure€of€past€efforts€atÍrehabilitation."€€Tenn.€Code€Ann.€ðð€40„35„102(5).€€The€appellant€satisfies€theseÏcriteria.€€Accordingly,€she€is€entitled€to€the€presumption€favoring€alternativeÏsentencing.€€ÌÌà à€This€presumption€may€be€rebutted€by€"evidence€to€the€contrary."€€€€ÏGuidance€as€to€what€constitutes€"evidence€to€the€contrary"€may€be€found€in€theÏsentencing€considerations€codified€at€Tenn.€Code€Ann.€ðð€40„35„103€(1990).€SuchÏevidence€may€be€found€in€the€presentence€report,€the€evidence€presented€by€theÏState,€the€testimony€of€the€accused,€or€any€other€source€provided€that€it€is€part€of€œÌÌthe›€record.€€òòBonestelóó,€871€S.W.2d€at€167;€òòsee€alsoóó€€Tenn.€Code€Ann.€ðð€40„35„102(6).ÌÌà àIn€the€present€case,€the€trial€court€denied€alternative€sentencing€based€uponÏthe€seriousness€of€the€offense.€€A€trial€court's€denial€of€an€alternative€sentence€onÏthis€ground€can€only€be€upheld€if€there€is€evidence€in€the€record€that€indicates€thatÏthe€circumstances€of€the€offense,€as€committed,€were€especially€violent,€horrifying,Ïshocking,€reprehensible,€offensive,€or€otherwise€of€an€excessive€or€exaggeratedÏdegree,€and€the€nature€of€the€offense€outweighs€all€factors€favoring€a€sentenceÏother€than€confinement.€€òòBinghamóó,€910€S.W.2d€at€454€(citations€omitted).€€AlthoughÏwe€do€not€condone€the€appellant's€behavior,€we€find€the€record€absent€of€any€proofÏto€support€the€conclusion€that€the€appellant's€actions€were€"especially€violent,Íhorrifying,€shocking,€reprehensible,€offensive,€or€otherwise€of€an€excessive€orÏexaggerated€degree."€€òòSee,€e.g.óó,€€òòState€v.€Mitchellóó,€No.€03C01„9411„CR„00418Ï(Tenn.€Crim.€App.€at€Knoxville,€July€24,€1995).€€ÌÌà àWe€are€unable€to€conclude€that€the€appellant€falls€within€that€class€ofÏð ðconvicted€felons€committing€the€most€severe€offenses,€possessing€criminalÏhistories€evincing€a€clear€disregard€for€the€laws€and€morals€of€society€and€evincingÏfailure€of€past€efforts€at€rehabilitation€.€.€.€ð ð€Tenn.€Code€Ann.€ðð€40„35„102(5).€ÏIndeed,€the€appellant€has€no€criminal€history€and€has€never€been€placed€in€aÏrehabilitative€program.€€Accordingly,€we€conclude€that€the€State€has€failed€toÏpresent€sufficient€proof€to€overcome€the€presumption€that€"a€sentence€other€thanÏconfinement€would€result€in€successful€rehabilitation."€òòMitchellóó,€No.€03C01„9411„CR„00418€(citations€omitted).€€Under€the€facts€of€this€record,€the€appellant€andÏsociety€would€best€be€served€by€granting€a€sentence€other€than€total€confinement.€€ÏòòSeeóó€€òòMitchellóó,€No.€03C01„9411„CR„00418.€€The€trial€court's€order€imposing€aÏsentence€of€incarceration€in€the€Department€of€Correction€is€reversed.€€€TheÏappellantððs€sentence€is€suspended€and€she€is€placed€on€intensive€probation€forÏthree€years.€€The€appellantððs€household€is€to€be€monitored€for€review€of€appropriateÏparenting€skills€and€for€imposition€of€any€other€conditions€reasonably€related€to€theÏpurpose€of€this€sentence€including€community€service.€€This€case€is€remanded€forÏentry€of€judgment€consistent€with€this€opinion.ÌÌÌÌÓÓà
