JacksonCountySheriffWayneMahaneytestifiedthatinearlyAugustof1988,hewasnotifiedthatTerryWaynePryorhadbeenmissing.Afewdayslater,SheriffMahaneydiscoveredthevictimsbodyfloatinginabackwaterareaoftheCumberlandRiver.Thesheriff,whocalledintheTennesseeBureauofInvestigationforassistance,determinedthatthevictimwaslastseenwiththedefendantandMarcelYoung. )   ׀Thedefendantturnedhimselfanda.38caliberpistolovertotheauthorities.  DonnClarkoftheTBItapedastatementbythedefendant.Thecontentofthetapeestablishedthataround10:00p.m.onAugust3,YoungaskedthedefendantifhewoulddrivehimtoLivingston,Tennessee,topurchasecocaine.OnthewaytoLivingston,thetwostoppedatabarandjoinedthevictim.ThethreeϜmenthenleftthefirstbarandwenttoanotherbarwhereYoungpurchasedsomecocaine.WhenYoungreturnedtothecar,allthreesharedthecocaine.Theyleftthebarforatimebutreturnedtwomoretimesthatnight.  Ataround1:00or2:00a.m.,thethreebegantheirreturntriptoGainesboro,stoppingalongthewayatYoungsresidencetopickuptwo.22caliberriflesanda.38caliberpistol.Atsomepoint,oneofthegunsdischarged,injuringthevictimintheleftleg.Youngandthedefendantpromisedthevictimtheywouldtakehimtobetreated.Whentheyarrivedatthehospital,however,Youngmadeaphonecalltotrytosecureanotherpurchaseofcocaineinsteadofseekinghelpforthevictim.Afterthecall,Youngandthedefendantleftwiththevictimtogopurchasemorecocaine.  Alongtheway,Young,accordingtotheaccountprovidedbythedefendant,pushedthevictimoverthebridgeintothewater.ThedefendantclaimedthatheheardseveralshotsfiredandthensawYoungslingagunintothewater.Afterward,Youngandthedefendantcleanedthecarout.  Thenextday,thedefendantwenttotheresidenceofMikeLynch.Thedefendant,admittingthatheandYounghadkilledsomeone,toldLynchthathewasverydepressedandwantedagunsohecouldkillhimself.Onthatsameday,HarryStaffordoverheardYoungandthedefendantsay, Wekilledaguy.ThedefendanttoldStaffordthat"they"shotthevictimfourorfivetimes.  TommyHeflin,whoworksfortheTBIinthefirearmsidentificationsection,testifiedthatthebulletsthatkilledthevictimwerefiredfromthe.22gaugeriflethatpolicewereabletorecover.Dr.GretaHarlan,whoperformedtheautopsy,testifiedthatfiveseparategunshotwoundshadcausedthedeath;thatthevictimsbloodalcohollevelwas0.26;andthattracesofcocaineandValiumwerefoundinhisurine.  Thedefendanttestifiedinhisownbehalf.Whilehistestimonywaslargelyconsistentwithhispretrialstatement,heclaimedthatafterYoungshotthevictim,heorderedthedefendanttofire.Thedefendantacknowledgedthathedidfirethe.38caliberweapontowardthewateronetimebutrefusedtoshootagain.HeinsistedhefiredtheweaponduetohisfearofYoung.  Onappeal,thestateisentitledtothestrongestlegitimateviewoftheevidenceandallreasonableinferenceswhichmightbedrawntherefrom.Statev.Cabbage,571S.W.2d832,835(Tenn.1978).Thecredibilityofthewitnesses,theweighttobegiventheirtestimony,andthereconciliationofconflictsintheproofaremattersentrustedtothejuryastriersoffact.Byrgev.State,575S.W.2d292,295(Tenn.Crim.App.1978).Whenthesufficiencyoftheevidenceischallenged,therelevantquestioniswhether,afterreviewingtheevidenceinthelightmostfavorabletothestate,anyrationaltrieroffactcouldhavefoundtheessentialelementsofthecrimebeyondareasonabledoubt.Statev.Williams,657S.W.2d405,410(Tenn.1983),cert.denied,465U.S.1073(1984);Tenn.R.App.P.13(e).  Atthetimetheoffensewascommitted,manslaughterwasdefinedasfollows:8 8 Manslaughteristheunlawfulkillingofanotherwithoutmalice,eitherexpressorimplied,whichmaybeeithervoluntaryuponasuddenheat,orinvoluntary,butinthecommissionofsomeunlawfulact.Tenn.CodeAnn.392221(repealed1989).Involuntarymanslaughterhasbeendefinedincaselawasanunintendeddeathcausedby someactnotstrictlyunlawfulinitselfbutdoneinanunlawfulmannerandwithoutduecaution,[such]thatdeathwasthenaturalorprobableresultofsuchact.Statev.Ricker,611S.W.2d835,841(Tenn.Crim.App.1980).Basedonthefactsdevelopedattrial,thejurycouldhavefoundtheactoffiringshotsatthevictimwasdone withoutduecautionand deathwastheprobableresult.  Next,weconsiderwhethertheevidencewassufficienttoconvictthedefendantasanaiderandabettorasdefinedbythestatuteprecedingtheadoptionofthe1989Act.Thelawgoverningaidingandabettingprovidedasfollows:8 8 ӜAllpersonspresent,aidingandabetting,orreadyandconsentingtoaidandabet,inanycriminaloffense,shallbedeemedprincipaloffenders,andpunishedassuch.Tenn.CodeAnn.391303(repealed1989).Clearlytherewasareasonablebasisforthejurysconclusionthatthedefendantwasanaiderandabettor.Firingthe.38caliberpistol,evenifdoneatYoungscommand,qualifiedasassistinginthekilling.Thatthedefendanttoldothersthat wekilledaguyimpliesactiveparticipationinthecrime.Underpriorlaw,adefendantwhoaidedandabettedwasdeemeda principaloffenderandcouldbeconvictedofinvoluntarymanslaughter.
