àWhether€the€trial€court€erred€in€failing€to€instruct€the€jury€on€theÏlesser€included€offense€of€assault;ÌÌà0 à2.à0 àWhether€the€indictment€contained€a€fatal€œdefect;Ì›Ìà0 à3.à0 àWhether€trial€counsel€was€œineffective;Ì›Ìà0 à4.à0 àWhether€the€trial€judge€erred€in€allowing€the€prosecutor€to€cross„examine€the€appellant€about€prior€arrests€and€convictions;€andÌÌà0 àà0 à5.à0 àWhether€the€trial€court€erred€in€failing€to€give€a€limitingÏinstruction€as€to€the€use€of€the€prior€arrests€and€convictions.ÌÌÌÓÓFollowing€our€review,€we€affirm€the€judgment€of€the€trial€court.ÌÌà àThe€victim€testified€that€he€was€outside€his€motherððs€home€on€DecemberÍ25,€œ1994,›€when€he€observed€a€red€Chevrolet€Blazer€drive€past.€€He€describedÏan€incident€involving€the€Blazer€which€had€occurred€the€previous€night.× ƒ9 ××  ×€ÏRealizing€œthat€trouble›€could€ensue,€the€victim€œordered›€the€œchildren›€œinto›€theÏhouse.€€When€the€Blazer€stopped€at€the€end€of€the€street,€the€appellant€andÏothers€exited€the€vehicle.€€Though€the€testimony€was€somewhat€conflicting,€œitÏappears€that€at›€least€four€men€were€in€the€vehicle.€€The€appellant€and€œa›€manÏnamed€Torry€approached€the€victim.€€The€appellant€asked€the€victim€if€he€wasÏRoosevelt€œWillis.›€œ€The›€victim€responded,€ð ð[w]hat€if€it€is?ðð€€The€appellant€then€saidÏð ðyou€gonna€die€mother€f_€_€_€er,€you€kicked€my€truck€last€night.ðð€€The€victim€saidÏthe€appellant€œthen€cocked›€a€small€pistol€he€was€holding€in€his€hand.ÌÑ H Ñà àThe€victim€testified€that€he€œwas€frightened€and€thought›€he€was€going€toÏbe€œshot.›€€He€said€that€he€œasked›€the€appellant€to€get€estimates€œof€the€damage€toÏthe€vehicle€and›€œtold€him€he›€would€pay€for€the€repairs.€€When€the€victimððs€motherÏcalled€the€police,€the€appellant€and€others€left€in€the€œBlazer.›ÌÌà àThe€victimððs€girlfriend€and€mother€corroborated€the€victimððs€testimony.€ÏThe€girlfriend€had€seen€the€small€pistol€in€the€appellantððs€hand€and€had€heardÏthe€victim€being€threatened€by€the€appellant.€€The€victimððs€mother€heard€theÏappellant€repeatedly€threatening€the€victim€and€saw€an€object€that€appeared€toÏbe€a€gun.ÌÌà àThe€appellant€testified€in€his€own€behalf.€€He€said€that€when€he€arose€onÏChristmas€day,€his€cousin€told€him€that€someone€had€kicked€the€œBlazer›€the€nightÏbefore.€€When€he€saw€the€damage,€the€appellant€and€œhis€friends›€got€œinto›€theÏœBlazer›€and€went€œlooking€for›€the€victim.€€The€appellant€did€not€know€the€victim€butÏknew€from€his€cousin€that€he€drove€a€silver€car.€€He€said€that€he€drove€to€theÏvictimððs€house€to€discuss€the€damages€to€his€vehicle.€€The€appellant€admittedÏthat€he€was€angry€but€denied€that€he€carried€a€pistol.€€Two€defense€witnessesÏalso€denied€the€presence€of€a€gun.€€The€appellant€said€that€when€the€victimÏoffered€to€pay,€he€immediately€calmed€down.€€€€ÌÌà@ àI.Ìà àIn€appellantððs€first€issue€he€contends€that€the€trial€court€committedÏreversible€error€by€failing€to€charge€the€lesser€included€offense€of€assault.€€œIt€isÏwell€settled€that€a€trial›€court€has€a€duty€to€instruct€the€jury€on€all€lesser€includedÏoffenses€whether€or€not€it€is€requested€to€do€so.€€òòState€v.€Jonesóó,€889€S.W.2dÏ225,€230€(Tenn.€Crim.€App.€1994).€€However,€where€the€evidence€clearlyÏestablishes€the€appellantððs€guilt€on€the€greater€offense,€it€is€not€error€to€fail€toÏcharge€on€a€lesser€included€offense.€€òòState€v.€Kingóó,€718€S.W.2d€241,€245€(Tenn.Ï1986).€€ÌÌà àThe€state€presented€evidence€to€support€its€claim€that€the€appellantÏcommitted€aggravated€assault€by€displaying€a€deadly€weapon.€€The€appellantÏtestified€that€he€did€not€have€a€gun€and€did€not€threaten€the€victim.€€By€his€ownÍproof€and€position€at€trial,€the€appellant€œnegated€the€elements›€of€simple€assault.€ÏAs€argued€by€the€state,€the€nature€of€the€evidence€left€the€jury€with€an€all€orÏnothing€œdecision.›€€The€appellant€could€be€found€guilty€of€aggravated€assault€orÏno€offense€at€all.€€œHere,€the€jury€chose€to€believe€the€stateððs€witnesses.€€The›€trialÏjudgeððs€failure€to€charge€the€lesser€included€offense€of€simple€assault€was€notÏreversible€error.€€€€€ÌÌà@ àII.Ìà àIn€his€second€issue,€the€appellant€challenges€a€defect€in€the€indictment.ÏDuring€the€trial,€the€judge€recognized€surplusage€in€the€indictment€and€œinformedÏthe›€attorneys.€€The€appellant€was€charged€in€the€indictment€with€aggravatedÏassault€which€œrequires€the›€mental€elements€of€intentionally€or€knowingly.€€Tenn.ÏCode€Ann.€ðð€39„13„102€(1991).€€However,€the€indictment€erroneously€includedÏthe€mental€element€of€recklessly.€€No€objection€was€made€at€that€time.€€ÌÌà àObjections€based€on€defects€in€the€indictment€must€be€raised€prior€to€trial.€ÏTenn.€R.€Crim.€P.€12(b)(2).€€Thus,€this€issue€is€waived.€€Nonetheless,€when€theÏtrial€judge€read€the€jury€charge,€he€properly€cited€the€requisite€elements€ofÏaggravated€assault.€€Error,€if€any,€was€harmless.€ÌÌà@ àIII.Ìà àThirdly,€the€appellant€argues€that€he€received€the€ineffective€assistanceÏof€counsel.€€However,€this€issue€is€prematurely€before€this€Court.€€The€Post„Conviction€Procedure€Act€calls€for€a€full€and€complete€hearing€on€ineffectiveÍassistance€of€counsel€claims.€€Tenn.€Code€Ann.€ðð€40„30„201€(Supp.€1995).€€ÌWithout€such€a€hearing,€we€are€unable€to€determine€why€defense€counselÏpursued€a€line€of€questioning€found€objectionable€by€appellate€counsel.€ÏFurther,€Ñ ° Ñœthe›€appellant€must€meet€his€burden€of€establishing€a€deficientÏperformance€and€resulting€prejudice€as€set€forth€in€òòStrickland€v.€Washingtonóó,Ï466€U.S.€668€(1984)€and€òòBaxter€v.€Roseóó,€523€S.W.2d€930€(Tenn.€1975).€ÏœWithout€counselððs€testimony,€it€is€unlikely€he€could€meet€this€burden.›ÌÌà@ àIV.Ìà àIn€his€fourth€issue,€the€appellant€complains€that€the€trial€court€erred€whenÏit€allowed€the€prosecutor€to€cross„examine€him€concerning€prior€charges€andÏconvictions.€€On€direct€examination,€the€appellant€testified€that€the€only€time€heÏhad€been€in€trouble€was€when€he€was€arrested€as€a€juvenile€on€a€disorderlyÏconduct€charge.€€However,€on€cross„examination€the€appellant€admitted€that€heÏhad€an€earlier€trespassing€charge€also€as€a€juvenile.€€He€further€rememberedÏtwo€convictions€for€driving€on€a€revoked€license.€€œThe€appellant›€now€complainsÏthat€this€questioning€was€improper€and€did€not€go€to€his€credibility.€€WeÏdisagree.ÌÌà àBecause€the€appellant€testified€that€he€had€been€in€trouble€only€one€time,Ïhe€ð ðopened€the€doorðð€to€the€stateððs€questioning.€€He€cannot€create€this€falseÏimpression€before€the€jury€and€expect€the€state€to€sit€idly€by.€€The€appellant€tookÏthe€shield€which€protected€him€from€a€general€attack€on€his€credibility€and€usedÍit€as€a€sword€by€interjecting€an€apparently€false€statement.€€òòState€v.€Brayóó,€669ÏS.W.2d€684,€687„88€(Tenn.€Crim.€App.€1983).€€Because€the€appellant€leftÏhimself€open€to€impeachment,€we€find€that€the€trial€judge€did€not€abuse€hisÏdiscretion€in€allowing€the€complained€of€cross„examination.Ì€Ìà@ àV.Ìà àFinally,€the€appellant€argues€that€the€trial€court€errantly€failed€to€give€aÏlimiting€instruction€as€to€the€use€of€the€testimony€concerning€the€prior€arrestsÏand€convictions.€€The€appellant,€however,€failed€to€request€a€limiting€instruction.€ÏTherefore,€this€issue€is€waived.€€òòSeeóó€òòState€v.€Cameronóó,€909€S.W.2d€836€(Tenn.ÏCrim.€App.€1995);€òòPennington€v.€Stateóó,€573€S.W.2d€755€(Tenn.€Crim.€App.Ï1978).€€Additionally,€the€failure€to€give€limiting€instructions€was€neitherÏfundamental€nor€prejudicial€error.€€òòState€v.€Howellóó,€868€S.W.2d€238,€255„56Ï(Tenn.€1993).€€ð ð[T]he€blame€for€the€failure€to€give€limiting€instructions€ððmust€beÏlaid€at€the€defendantððs€feet.ðððð€€òòIdóó.€(citation€omitted).€€This€issue€is€without€merit.€€€€ÌÌà
