OnNovember15,1994,theappellantfiledaprosepetitionforpostconvictionrelief.Thepetitionallegesthat:8  Petitionerhassufferedviolationsofrightsinthathewasdeniedeffectiverepresentationofcounsel,sufferedfromandasaresultofmisconductbytheprosecution,andwasdenieddueprocessandwasprejudicedbyanabuseofdiscretiononbehalfofthetrialcourt.8  Duetotheviolationsofpetitioner'srightsthepleabargainwasnotvoluntary,intelligent,norknowinglyenteredinthecourt.Hadpetitionerbeenawareoftheunusualcircumstancessurroundingthepleabargain,hewouldhavewithdrawnhisguiltypleaandinsistedongoingtotrial.Theappellantproceededwithouttheassistanceofcounsel.  OnFebruary15,1995,thetrialcourtdeniedtheappellant'spetitionwithoutgrantinghimanevidentiaryhearingandwithoutappointingcounsel.Theorderdenyingthepetitionrecites:"[t]hepetitionermakesnospecificallegations,nordoesheallegeanydetailsofanabridgementofanyconstitutionalright.Thepetition...merelystatesconclusionswithoutallegingsomefactstosupporthisconclusions.TheCourtfindsthatthepetitionerhasfailedtostateacolorableclaimforrelief...."@ Analysis  Thecourtmayproperlydismissapetitionwherethepetitionhasbeencompetentlydraftedandallpleadings,filesandrecordsconclusivelyshowthatthepetitionerisnotentitledtorelief. &   ׀Tenn.CodeAnn.4030109(a)(1)(1990).However,apetitionshallnotbedismissedfortechnicaldefects,incompletenessorlackofclarityuntilafterthepetitionerhashadreasonableopportunity,withtheaidofcounsel,tofileamendments. '   ׀Tenn.CodeAnn.4030107(1990).Althoughtheappellant'sprosepetitionfailstosupporthisclaimwithfactualallegations,theappellantisentitledtofileanamendedpetitionwiththeaidofappointedcounsel.
