àMrs.€Sanford€was€in€the€bathroom€attempting€to€wipe€the€blood€off€herÏhead€and€face€when€the€three€intruders€returned.€€Co„defendant€HollinsÏattempted€to€help€Mrs.€Sanford€by€wiping€her€head€with€a€damp€towel.€€TheÏman,€whom€Mrs.€Sanford€was€unable€to€identify,€began€searching€through€herÏdresser€for€money.€€He€told€her€that€if€she€would€give€him€five€dollars€he€wouldÏget€her€a€taxi€or€find€another€way€to€take€her€to€the€hospital.€€€ÌÌà àIn€this€instance,€the€jury€resolved€the€conflicting€evidence€in€favor€of€theÏstate.€€While€it€is€true€that€Mrs.€Sanford€was€unable€to€identify€appellant€as€theÏman€who€stole€her€television,€the€jury€chose€to€accredit€his€co„defendant'sÏconsistent€and€compelling€testimony€rather€than€appellant's€self„serving€andÏincredible€statements.€€Although€appellant's€shoes€did€not€match€the€bloodyÏfootprints€at€the€scene,€his€fingerprint€was€found€on€a€plastic€watch€case€on€theÏvictim's€bedroom€dresser.€€While€appellant€claimed€that€he€was€unable€to€carryÏthe€television€set€for€any€distance€because€of€an€impaired€right€arm,€the€jury,€byÏits€verdict,€rejected€that€argument€and€must€have€concluded€that€appellant€wasÏassisted€by€an€unidentified€third€man.€€The€evidence€presented€at€trial€wasÏsufficient€for€a€rational€trier€of€fact€to€conclude€that€appellant€was€guilty€of€theÏcrimes€for€which€he€was€convicted€beyond€a€reasonable€doubt.€€ÌÌÌà@ àò òAdmissibility€of€Appellant's€First€Statementó óÌÌà ƒe ××  ×€€This€issue€is€without€merit.ÌÌÌà@ àò òDenial€of€Continuanceó óÌÌà àNothing€in€the€record€indicates€that€Owens€refused€to€talk€to€appellant'sÏcounsel€or€that€she€had€invented€the€story€about€the€pillow€at€the€last€moment.€€IfÏappellant€was€"surprised"€by€Owens'€testimony€at€trial,€the€surprise€was€of€hisÏown€making.€€òòSeeóó€Tenn.€R.€App.€P.€36(a).€€Technical€noncompliance€with€theÏdirective€statute,€under€these€circumstances,€did€not€justify€a€continuance€orÏdisqualification€of€the€witness.€€òòSeeóó€òòState€v.€Crabtreeóó,€655€S.W.2d€at€177.ÌÌà àMoreover,€we€find€nothing€in€the€record€to€indicate€that€appellant€wasÏunfairly€disadvantaged€at€trial.€€Defense€counsel€had€full€opportunity€to€cross„examine€Owens€rigorously.€€òòSeeóó€òòState€v.€Morrisóó,€750€S.W.2d€at€749;€òòThomas€v.ÏStateóó,€465€S.W.2d€at€890.€€Nothing€in€the€record€indicates€that€appellant€couldÏhave€changed€his€defense€strategy€with€earlier€notice€or€that€he€could€haveÏproduced€evidence€to€refute€Owens'€statements.€€Statements€made€by€Mrs.ÏSanford€and€co„defendant€Hollins€corroborated€much€of€Owens'€testimony.€€TheÏrecord€does€not€show€that€appellant€was€placed€in€a€less€favorable€position€byÏthe€late€announcement€than€he€would€have€been€had€Owens'€name€been€listedÏas€a€witness€on€the€indictment€or€had€the€continuance€been€granted.ÌÌà àòòò òConsecutive€Sentencingóóó óÌÌà àThe€appellant€contends€that€the€imposition€of€consecutive€sentences€inÏhis€case€is€contrary€to€Tenn.€Code€Ann.€ðð€40„35„115€(1990)€and€results€in€aÏsentence€that€is€disproportionate€to€the€crime,€his€age,€and€his€prior€record.€€TheÏState€concedes€that€the€trial€court€improperly€applied€one€factor,€but€argues€thatÏthe€record€supports€a€finding€that€the€appellant€is€a€dangerous€offender€and€thatÏconfinement€for€thirty„five€years€is€necessary€to€protect€the€public.€€For€theÏreasons€discussed€below,€we€affirm€the€appellant's€consecutive€sentences€ofÏtwenty„two€years€for€especially€aggravated€robbery,€ten€years€for€attemptedÏsecond€degree€murder,€and€three€years€for€simple€burglary.ÌÌà àWhen€there€is€a€challenge€to€the€length,€range€or€manner€of€service€of€aÏsentence,€it€is€the€duty€of€this€court€to€conduct€a€òòde€novoóó€review€with€aÏpresumption€that€the€determinations€made€by€the€trial€court€are€correct.€€Tenn.ÏCode€Ann.€ðð€40„35„401(d)(1990).€€This€presumption€is€"conditioned€upon€theÏaffirmative€showing€in€the€record€that€the€trial€court€considered€the€sentencingÏprinciples€and€all€relevant€facts€and€circumstances."€€òòState€v.€Ashbyóó,€823ÏS.W.2d€166,€169€(Tenn.€1991).€€The€Sentencing€Commission€CommentsÏprovide€that€the€burden€is€on€the€defendant€to€show€the€impropriety€of€theÏsentence.ÌÌà àOur€review€requires€an€analysis€of€(1)€the€evidence,€if€any,€received€atÏthe€trial€and€sentencing€hearing;€€(2)€the€presentence€report;€(3)€the€principles€ofÏsentencing€and€the€arguments€of€counsel€relative€to€sentencing€alternatives;€(4)Íthe€nature€and€characteristics€of€the€offense;€(5)€any€mitigating€or€enhancingÏfactors;€(6)€any€statements€made€by€a€defendant€on€his€or€her€own€behalf;€andÏ(7)€defendant's€potential€for€rehabilitation€or€treatment.€€Tenn.€Code€Ann.€ðððð€40„35„102,€„103,€&€„210€(1990€&€1994€Supp.);€€òòState€v.€Smithóó,€735€S.W.2d€859,Ï863€(Tenn.€Crim.€App.€1987).ÌÌà àThe€trial€court€applied€three€enhancement€factors,€presumably€to€eachÏoffense:ÌÒ ` ÒÒ ` ÒÓÓ(1)à àprevious€history€of€criminal€behavior€in€addition€toÏthat€necessary€to€establish€the€appropriate€range;€Tenn.ÏCode€Ann.€ðð€40„35„114(1)€(1994€Supp.);ÌÌ(2)à àleader€in€the€commission€of€the€offense;€Tenn.€CodeÏAnn.€ðð€40„35„114(2)€(1994€Supp.);€andÌÌ(3)à àvictim€was€particularly€vulnerable€because€of€ageÏand€physical€disability;€Tenn.€Code€Ann.€ðð€40„35„114(4)Ï(1994€Supp.).ÌÌÒ  ÒÒ ° ÒÓÓEvidence€in€the€record€supports€applicability€of€these€factors.€€The€trial€courtÏfound€no€mitigating€factors,€nor€do€we.€€Based€on€our€review€of€the€entire€record,Ïwe€conclude€that€the€appellant's€sentences€are€justified.ÌÌà àWith€respect€to€consecutive€sentencing,€the€trial€court€found€thatÏconsecutive€sentencing€is€appropriate€since€the€appellant€had€committed€theÏcrime€while€he€was€on€probation€and€since€he€was€a€dangerous€offender€asÏdefined€by€statute.€€Tenn.€Code€Ann.€ðð€40„35„115€(b)(4)€&€(6).€€The€appellantÍcontends€that€the€resulting€thirty„five€year€sentence€is€disproportionate€and€thatÏthe€multiple€conviction€factors€were€inappropriately€applied.ÌÌà àConsecutive€sentencing€may€be€imposed€in€the€discretion€of€the€trialÏcourt€upon€a€determination€that€one€or€more€of€the€following€criteria€exist:ÌÒ ` ÒÒ ` ÒÓÓ(1)à àThe€defendant€is€a€professional€criminal€who€hasÏknowingly€devoted€himself€to€criminal€acts€as€a€majorÏsource€of€livelihood;ÌÌ(2)à àThe€defendant€is€an€offender€whose€record€ofÏcriminal€activity€is€extensive;ÌÌ(3)€€à àThe€defendant€is€a€dangerous€mentally€abnormalÏperson€so€declared€by€a€competent€psychiatrist€whoÏconcludes€as€a€result€of€an€investigation€prior€to€sentencingÏthat€the€defendant's€criminal€conduct€has€beenÏcharacterized€by€a€pattern€of€repetitive€or€compulsiveÏbehavior€with€heedless€indifference€to€consequences;ÌÌ(4)à àThe€defendant€is€convicted€of€two€(2)€or€moreÏstatutory€offenses€involving€sexual€abuse€of€a€minor€withÏconsideration€of€the€aggravating€circumstances€arising€fromÏthe€relationship€between€the€defendant€and€victim€orÏvictims,€the€time€span€of€defendant's€undetected€sexualÏactivity,€the€nature€and€scope€of€the€sexual€acts€and€theÏextent€of€the€residual,€physical€and€mental€damage€to€theÏvictim€or€victims;ÌÌ(6)à àThe€defendant€is€sentenced€for€an€offense€committedÏwhile€on€probation;€orÌÌ(7)à àThe€defendant€is€sentenced€for€criminal€contempt.ÌÌÒ  ÒÒ ° àThe€State€concedes€and€we€agree€that,€since€the€appellant€was€notÏsentenced€to€probation€until€March€3,€1993,€this€factor€is€inapplicable€inÏsentencing€for€a€crime€committed€prior€to€that€date.€€Tenn.€Code€Ann.€ðð€40„35„115(b)(6).€€We€must€now€determine€whether€consecutive€sentences€are€justifiedÏbecause€the€appellant€is€a€dangerous€offender.× ƒg ××  ×€à àÌÌà àThe€appellant€contends€that€the€trial€court€erred€in€enhancing€hisÏsentences€and€ordering€them€to€be€served€based€upon€the€same€criteria.€€ThisÏargument€has€been€rejected€by€this€court€on€several€occasions.€€òòSee,€e.g.óó,€òòStateÏv.€Meeksóó,€867€361€(Tenn.€Crim.€App.),€òòperm.€to€appeal€deniedóó,€(Tenn.€1993).ÌÌà àWe€also€conclude€that€consecutive€sentences€were€proper€in€this€case.€ÏAn€accused€qualifies€as€a€ð ðdangerous€offenderðð€when€his€ð ðbehavior€indicatesÏlittle€or€no€regard€for€human€life,€òòandóó€[he€has]€no€hesitation€about€committing€aÏcrime€in€which€the€risk€to€human€life€is€high.ðð€€Tenn.€Code€Ann.€ðð€40„35„115(b)(4).€€This€language€is€essentially€a€codification€of€our€supreme€courtððsÏholding€in€òòGray€v.€Stateóó,€538€S.W.2d€391,€393€(Tenn.€1976).€€òòSeeóó€òòState€v.ÏWilkersonóó,€905€S.W.2d€933,€938€(Tenn.€1995).€€In€òòGrayóó,€our€supreme€courtÏqualified€this€classification€by€requiring€the€court€to€find€aggravating€factorsÍpresent€before€a€defendant€may€be€classified€as€a€ð ðdangerous€offender.ðð€€òòGrayóó,Ï538€S.W.2d€at€393.ÌÌà àIn€òòState€v.€Wilkersonóó,€905€S.W.2d€at€933,€our€supreme€court€reaffirmedÏthese€principles€and€provided€additional€guidelines€for€finding€a€defendant€toÏbe€a€ð ðdangerous€offender.ðð€€The€court€held€that€proof€that€a€defendant€was€aÏð ðdangerous€offender,ðð€standing€alone,€was€not€enough€to€sustain€the€impositionÏof€consecutive€sentences.€€òòIdóó.€at€938.€€Consequently,€under€òòWilkersonóó,€beforeÏthe€sentencing€court€may€discretionarily€impose€consecutive€sentences€for€oneÏclassified€as€a€ð ðdangerous€offender,ðð€the€following€criteria€must€be€met:€€€€ÌÒ ` ÒÒ ` ÒÓÓ(1)€the€defendantððs€ð ðbehavior€indicates€little€or€no€regard€forÏhuman€life,€and€[he€has]€no€hesitation€about€committing€aÏcrime€in€which€the€risk€to€human€life€is€high;ððÌÌ(2)€aggravating€factors€must€be€present;ÌÌ(3)€the€terms€imposed€are€reasonably€related€to€the€severityÏof€the€offenses€committed;ÌÌ(4)€consecutive€sentences€are€necessary€in€order€to€protectÏthe€public€from€further€criminal€acts€by€the€offender;€andÌÌ(5)€€the€sentence€is€in€accordance€with€the€principles€setÏforth€in€the€Sentencing€Reform€Act.ÌÌÌÒ  ÒÒ ° ÒÓÓ€òòIdóó.× ƒh ××  ×€ÌÌà àUpon€a€òòde€novoóó€review€of€the€record,€we€conclude€that€the€appellantÏmeets€these€requirements.€€First,€the€appellant€acted€with€ð ðlittle€or€no€regard€forÏhuman€lifeðð€and€he€did€not€hesitate€ð ðabout€committing€a€crime€in€which€the€riskÏto€human€life€is€high.ðð€€The€record€reflects€that€the€appellant€and€his€co„defendants€were€willing€to€trade€the€life€of€an€elderly€woman€for€a€single€rock€ofÏcrack€cocaine.€€Second,€there€are€aggravating€circumstances€present.€€The€trialÏcourt€found€the€appellant€to€be€the€leader€in€the€commission€of€the€offenses.€ÏThe€appellant€and€his€co„defendants€inflicted€multiple€blows€with€a€hammer€toÏthe€head€and€face€of€the€victim,€smothered€her€with€a€pillow,€and€left€her€forÏdead.€€The€victim€of€the€brutal€assault€was€seventy„nine€years€old.€€She€stillÏsuffers€from€dizziness€and€blackouts,€and€requires€surgery€on€her€broken€finger.€ÏShe€has€moved€from€her€residence€for€her€protection.€€These€circumstances€areÏbeyond€those€necessary€to€commit€the€crimes€for€which€the€defendant€wasÏconvicted.€€Additionally,€we€find€that€the€aggregate€length€of€the€sentencesÏreasonably€relates€to€the€severity€of€the€crimes€for€which€the€defendant€standsÏconvicted.€€We€have€previously€concluded€that€the€actions€of€the€appellant€andÏhis€co„defendants€were€brutal€and€vicious.€€ÌÌà àMoreover,€the€aggregate€sentence€imposed€is€necessary€to€protect€theÏpublic€from€further€criminal€acts€by€the€appellant.€€After€a€review€of€the€record,Ïwe€conclude€that€the€appellantððs€history€does€not€suggest€amenability€toÏrehabilitation.€€Although€the€appellant€was€only€twenty€years€old€when€theÏoffense€was€committed,€his€record€indicates€an€extensive€criminal€history€forÍsomeone€his€age.€€The€appellantððs€criminal€history€is€in€dispute€as€to€severalÏconvictions.× ƒi ××  ×€€However,€the€presentence€report€and€the€appellantððs€ownÏadmissions€reflect€adult€convictions€for€felony€theft€of€property,€publicÏintoxication,€theft€of€an€automobile,€and€a€weapons€violation.€€The€appellantÏalso€has€numerous€convictions€as€a€juvenile,€including€grand€larceny€andÏweapons€and€drugs€violations.€€Additionally,€both€of€the€appellantððs€co„defendants€testified€that,€on€the€evening€of€the€offense,€the€appellant€stated€thatÏhe€was€going€to€break€into€someoneððs€house.€€Thirty€minutes€prior€to€theÏoffense,€the€appellant€grabbed€co„defendant€Hollins,€put€a€knife€to€her€throat,Ïand€stated€ð ðB„„„„,€Iððll€kill€you!ðð€€After€their€arrest€on€the€present€charges,€theÏappellant€wrote€to€Hollins€in€an€attempt€to€suborn€perjury€by€fabricating€eventsÏwhich€placed€all€the€blame€upon€the€co„defendant€Owens.€€Thus,€there€is€little,€ifÏanything,€in€the€record€to€indicate€that€the€appellant€could€be€released€intoÏsociety€anytime€in€the€near€future€without€risk€to€society.€€€Finally,€we€concludeÏthat€an€aggregate€sentence€of€thirty„five€years€is€consistent€with€the€principles€ofÏsentencing.€€Based€upon€the€foregoing€and€consistent€with€the€holding€in€ÏòòWilkersonóó,€we€conclude€that€the€trial€court€did€not€err€in€imposing€consecutiveÏsentences.ÌÌà
