TheappellantinitiallyacknowledgesthattheTennesseeSupremeCourthaspreviouslydecidedthisissueinStatev.Conley,639S.W.2d435,436437(Tenn.1982)(holdingthataproceedingtohaveadefendantdeclaredanhabitualoffenderandtohavehisdrivingprivilegesrevokeddoesnotsubjecthimtodoublejeopardy).InConley,thecourtobservedthattherevocationofalicensewas"nothingmorethanthedeprivationofaprivilege,...'remedialinnature,'and...notintendedtohavetheeffectofimposing'punishment'inordertovindicatepublicjustice."Id.at437.Nonetheless,theappellantassertsthatrecentfederalcases,i.e.,UnitedStatesv.Halper,490U.S.435,109S.Ct.1892(1989);UnitedStatesv.Austin,U.S.,113S.Ct.2901(1993);andDepartmentofRevenuev.KurthRanch,U.S.,114S.Ct.1937(1994),mandateadifferentresult,asthesecasesprovidethat"thelabels'criminal'and'civil'arenotofparamountimportance"indeterminingwhetherasanctionconstitutespunishmentfordoublejeopardypurposes.Halper,490U.S.at447,109S.Ct.at1901.Moreover,eventhoughheacknowledgestheCourt'srecentdecisiononasimilarissueinUnitedStatesv.UrseryandUnitedStatesv.$405,089.23inUnitedStatesCurrency,U.S.,116S.Ct.2135(1996)(holdingthat,althoughcertainpunitiveaspectsarepresent,inremforfeituresserveimportantnonpunitivegoalsandareneither"punishment"nor"criminal"fordoublejeopardyconsideration,thus,theforfeitureofpropertyasaresultofacivilcomplaintdoesnotbarasubsequentcriminalprosecution),hecontendsthat(1)UrserydoesnotoverruletheholdingsinHalper,Austin,andKurthRanch;(2)thatUrserydoesnotapplytothepresentcasebecausethepresentcaseisnotaninremproceedingandbecausetherevocationofalicenseisclearlyapenalty; &   ׀and(3)that,evenifthereisnoviolationofthefederalDoubleJeopardyClause,thiscourtcanconcludethatthereisaviolationoftheDoubleJeopardyClausefoundinArticleI,Section10oftheTennesseeConstitution.
