Theappellantwastriedandconvictedofaggravatedsexualbattery,aClassBfelony,byajuryofhispeers.Thetrialcourt,findingthattheappellantwasastandardoffender,imposedaRangeIsentenceconsistingofconfinementforten(10)yearsintheDepartmentofCorrection.ThisCourtaffirmedtheappellant'sconvictionandsentence. (   ׀NoapplicationforpermissiontoappealwasfiledwiththeClerkoftheSupremeCourt. TheDistrictPublicDefenderwasappointedtorepresenttheappellantpriortotrial.ThepartiesstipulatedthattheassistantpublicdefenderwhorepresentedtheappellantonappealdidnotwithdrawascounselofrecordpursuanttoRule14oftheTennesseeSupremeCourt.Nordidthisassistantdistrictpublicdefenderfileanapplicationforpermissiontoappealoradvisetheappellantthathecouldfileanapplicationforpermissiontoappeal.ThepartiesfurtherstipulatedthatnootheremployeeoftheDistrictPublicDefendereithermovedtowithdrawascounsel,filedanapplicationforpermissiontoappeal,oradvisedtheappellanthecouldfileanapplicationforpermissiontoappealprose. Thetrialcourtentereditswrittenfindingsoffactandconclusionsoflaw.Theordersetforththestipulationofthepartiesand,baseduponthestipulationconcluded:    1.ThatthePetitionerhassustainedhisAmendedPetitionforPostConvictionReliefinthathiscounsel,throughthefirsttierofappellatereviewintheCourtofCriminalAppeals,failedtofileaMotionpursuanttoRule14oftheRulesoftheSupremeCourtofTennesseeaskingforpermissiontowithdrawandfailedtoadvisethePetitionerofhiswithdrawal,therebydeprivinghimofhisrighttoseekasecondtierreviewbyvirtueofanApplicationforPermissiontoAppealtotheTennesseeSupremeCourt.2.ThatthisCourthasnojurisdictiontooverruleorotherwiseaffectaCourtofCriminalAppealsJudgment,therefore[,]thePetitionisdismissed.   X Thestipulationofthepartiessupportstherulingofthetrialcourt. Whenanattorneyisappointedtorepresentanaccused,andtheattorneyappealsasofrighttothisCourt,theattorneyhastherighttowithdrawascounselfollowingthefilingofthisCourt'sjudgment. )   ׀Iftheattorneydoesnotseektowithdrawascounselofrecord,theattorneyisobligatedtofileanapplicationforpermissiontoappealwiththeClerkoftheSupremeCourt.Inshort,theattorneymusteither"fishorcutbait"theattorneycannotstandmuteandtakenoaction.Iftheattorneydoesnotadvisetheaccusedthathewillseektowithdrawascounselofrecordandprovidetheinformationrequiredbytheappropriaterule,theaccusedhastherighttoassumethatappointedcounselisprotectinghisrighttoanappealbypermissionintheSupremeCourt. +    Thetrialcourttooktheappropriateactioninthiscase.Thecourtmadeafindingoffactsbaseduponthestipulation.ThecourtalsoproperlydismissedthepetitionbecauseonlytheCourtofCriminalAppealscantaketheappropriateactiontopermitanaccusedtherighttofileanapplicationforpermissiontoappeal.ThisisaccomplishedbythisCourtvacatingitspreviousjudgmentandreinstatingthejudgment.
